AN ORDINANCE CONCERNING SEWER USER CHARGES; AND AMENDING
SECTIONS 7.01x, 7.020, 7.023, 7.025, 1,030, 7.035, 1.040,
AND 7.045 OF THE EUGENE CODE, 1971.
THE CITY OF EUGENE DOES ORDAIN AS FOLLD~S:
Section 1. Section 7.010 of the Eugene Code, 1971 is amended to read
and provide:
7,x10 Definitions. For purposes of this chapter, the following words
and phrases shall have the meanings ascribed to them by this sec-
ti on
B.O.D. Biochemical oxy en demand. Quantity of oxygen
uti 1 i zed i n the bi ochem~i ca~~l~ oxi dati~on of organic matter under
standard laboratory procedure in five days at 20 degrees Centigrade
expressed in parts per million weight.
Building drain. That part of the lowest horizontal piping of
a drainage system which receives the discharge from soil waste,
and other drainage pipes inside the walls of the building and con-
veys i t to the bui 1 di ng sewer, beginning five f=eet outside the
interface of the building wall .
Buildin sewer, The extension from the building drain to the
public sewer or other places of disposal.
Combined sewer. A sewer receiving bath surface run-off and
sewage.
Domestic sewa e. Sanitary sewage derived principally from
dwellings, business buildings and institutions.
Duplex. A building designed and used exclusively for occu-
pancy by two families living independently of each other.
Dwellin unit. As defined in section 9.015 of this code.
Garba e. Solid wastes from the preparation, cooking and
dispensing of food, and from the handling, storage and sale of
produce.
General customer. ~ For regional portion of rani tar~r sewer
user cnargej:
~a} Low stren th. Users with combined BOD and SS load-
ings equal to or less than 400 milligrams per liter ~mgll~.
These low strength loadings are typical of domestic sanitary
waste loadings.
~b~ Medium stren th. Users with combined BOD and SS
strengths greater than 400 mg/1 but not greater than 800 mg/1.
These medium strength loadings are typical af: grocery
stares, hotels and motels, commercial laundries and theaters.
~c~ Hi h stren th. Users with a combined BDD and SS
wastewater strength of greater than 800 mg/1. These high
strength loadings are typical af: restaurants, bakeries and
' food processors dairies, bottlers, etch.

industrial waste or trade waste, Liquid wastes from indus-
trial processes including suspended solids.
Mul ti pl_e dwelling . A bui 1 di ng designed for or occupied by
three or mare families living independently of each other.
Natural outlet. An outlet into a watercourse, pond, ditch,
lake or other body of surface ar ground water.
~N. The logarithm of the reciprocal of the weight of hydrogen
ions ~n grams per liter of solution.
Pro erly shredded arba e. Waste from the preparation, caak-
ing, and dispensing of foods that have been shredded to such degree
that all particles will be carried freely under the flow conditions
normally prevailing in public sewers, with no particle any greater
than one-half inch in any dimension.
Public sewer, A sewer in which all owners of abutting pr~p-
erties have equal rights and is controlled by public authority.
Sanitary sewer. A sewer which carries sewage, into which
storm, surface and ground waters are not intentionally admitted.
5ani tary sewer user. A faci 1 i ty which discharges directly or
indirectly to the city sanitary sewerage system, or has a sanitary
sewer available as provided in section ~.OlC of this Cade.
Se~cwa e. a combination of the water-carried wastes from resi-
dences, business buildings, institutions and industrial establish-
ments together with ground, surface and storm waters as may be pre-
sent.
Sewer. A pipe or a conduit for carrying sewage.
Sewer service. includes, but is not limited to, construc-
tion, reconstruction, extension, operation, management and debt
retirement of a sewerage system.
Sewera e system. The equipment, pipe line system and facili-
ties as are needed far and are pertinent to the disposal of sewage
and water, and sewage treatment plant or separate pipe lines for
storm, surface and subsurface water,
Sin le dwellin unit. A facility designed for permanent or
semi-permanent occupancy by a single family and provided with mini-
mum kitchen , sleeping and sanitary faci 1 i ti es .
Storm sewer and storm drain. A sewer which carries storm and
surface waters and drainage but excludes sewage and polluted
industrial wastes.
Storm sewer user. Any water user within the city,
Storm water or storm sewa e. Excess water from rainfall ar
continuously following therefrom.
Surface water, Water other than storm water flawing on or
over the surface ground.
5u- speeded solids or SS. Solids that either float on the sur-
face ar are suspended~~~in water sewage or other liquids and which
are removable by laboratory filtering.
Transient rooms, motels hotels and student uarters. A
building or portion thereof containing four or more sleeping roams
customarily occupied as a more ar less temporary sleeping place for
persons for which compensation is paid. "Student quarters" in-
clude but are not limited to quad or quint dwellings as defined
in section 9.x15 of this code whether or not the unit is occupied
by students.

Water course. A channel in which a flow of water occurs
either continuously or intermittently.
Mater user. Except for public water districts that purchase
water at bulk rates, any property or facility inside or outside
the city using water directly or indirectly provided by the Eugene
Water & Electric Board or by another water utility or district.
section 2. Section 7.D~0 of the Eugene Cade, 1971, is amended to read
and provide;

and equitable monthly rates and charges for sanitary sewer service and storm
sewer service as provided in this chapter.

Local Sanitary Sewer Rates (by Volume)
General Customer:

~c} when the sanitary sewer rate specified in this section
is based on volume, the volume shall be calculated:
1. By actual measurement of the sewage discharged the
cost of measurement sha11 be borne by the sewer user}, or
2. By an estimate based on:
a. The sanitary sewer user`s average monthly water
consumption during the previous December through April
period; or
b. If no water consumption figures are available
for at least three full months during the period stated
~n c 2.a, above:
i . For residential sanitary sewer users the
average monthly water consumption shall be based on
the water consumption of other similar sanitary sewer
users, and,
ii. Far all other sanitary sewer users the
actual monthly water consumption shall be used until
the rate can be calculated under ~a} above.
~2} The monthly charge for storm sewer service:
~a} Ta single family dwelling units and far each dwelling
unit within a duplex within the city shall be $2.41;
fib} For all other storm sewer users the charge shall be based
an the size of the water meter as follows:

~c} For water users at the time of the adoption of this sub-
section, the size of the water meter in use an July 1, 19$5, shall
be used in determining the storm sewer service charge unless the
charge is adjusted under sectian 7,x23 or increased because of the
insta1latian of a larger water meter.

~3~ Each customer shall be notified, at least annually in con~unc-
tion with a regular bill, of the rate and allocation of revenue approved by
the budget process for the sewer user charges.
Section 3. Section 7.423 of the Eugene Code, X971, is amended to read
and provide:
7.023 Char es - adjustments.
~1} Upon forms provided, or acceptable customer data, any user
paying more than the minimum monthly charge established in section 7.020 may
apply to the city manager or his/her designee to reduce the monthly charge.
No charge shall be reduced below the minimum set in section 7.D20.
~2~ The monthly sanitary sewer user rates and charges may be re-
duced based on:
~a~ The amount of water consumed and not discharged into the
sanitary sewer system, or
(b} Customer provided information indicating improper re-
s gional general customer classification. This information must in-
clude BOQ and SS test data from a qualified wastewater testing
1 aboratory and/or tests samples by the city or regi anal sewerage
agency, that adequately represent their BOD and SS wastewater char-
acteri sti cs .
~3~ Except for monthly storm sewer service charges for single
family and duplex dwellings, which may not be reduced, the monthly storm
sewer charge may be reduced;
~a~ If a significant portion of the meter size ~50~ or more
is designated for fire flow;
(b} If the water user can demonstrate the user is paying a
disproportionate share of the storm drainage costs.
~4~ The city manager or the manager's designee shall investigate
the application and certify to the Eugene Water & Electric Board a reduction,
if any, in the applicant's monthly sanitary or storm sewer user charges and
the conditions and duration of the reduction. If it is determined that the
applicant has paid excessive charges resulting from conditions beyond the
applicant's control, a credit for the excess paid during all or part of the
12 montha preceding the application may also be allowed, The full cost of
investigating the application authorized by this section and any conditions
required by the city manager or the manager's designee shall be borne by the
applicant. The city manager's decision regarding an application shall be
final .
Section 4. Section 7.D25 of the Eugene Code, ~97~, is amended to read
and provide
7.025 Char es - Collection and Payment. The Eugene Water & Electric
Board is directed to collect the rates and charges provided for in
this chapter from each water user. Charges levied in section 7.020 shall be
determined by the city manager or his/her designee and certified to the

Eugene Water & Electric Board. X411 revenue collected~by the Eugene Water &
Electric Board shall be paid monthly to the finance officer who shall deposit
i t i n the '€ sewer operati ngs f undf~ for use i n providing sewer service and such
other services as the council may direct.
Sectian 5. Section 7.034 of the Eugene Code, 1971, is amended to read
and provide:
7.030 Char es - Sewer Users Not Served by Eu ene Water & Electric Board.
Water users not served by the Eugene Water & Electric Board shall
install and maintain meters approved by the city manager or his/her designee
which accurately reflect the gallons of water consumed or which pass into
the sanitary sewerage system. The meter shall be conveniently available to
be read by the city.
Section 6. Section 7.035 of the Eugene Cade, 1971, is amended to read
and provide;
7. D35 Charges - Deli nque,n,ci es. The Eugene Water & Electric Board shal l
enforce the collection of rates and charges for sanitary and storm
sewer services and may do so by withholding delivery of water, steam or
electricity to any premises for which the sanitary ar storm sewer users
charges are delinquent, or by any other means of collection provided by the
laws of the state or permitted by the charter and ordinances of the city in-
cluding certification of delinquencies to the tax assessor of Lane County for
collection in the manner provided by ORS 454.25. Rates and charges far sani-
tary and storm sewer services shall be collected monthly and if not paid on
or before 14 days from and after the date the same shall be payable, the
rates and charges shall be deemed to be delinquent. Any charge due which
shall not be paid when due may be recovered in an action at law by the city.
Section ~. Section 7.044 of the Eugene Code, 1971, is amended to read
and provide;
7.044 Charles - Penalty for Nonpayment. In the event it becomes neces-
sary to certify the sani~~tary or storm sewer user fees and charges
established because of nonpayment, there shall be added to the fees and
charges a penalty in the amount of 10 percent and the total amount due shall
bear interest at the rate established in section 2.OZ2 of this Code from the
date of the delinquency.
Section B. Section 7.045 of the Eugene Code, 1971, is amended to read
and provide;

~ .045 Char es_ -,,.Cost of Collection , The Eugene 4~ater & E1 ectri c Board
may withhold from payments directed by section 7.05 of this
chapter a reasonable fee for its actual casts of billing, collecting and
remitting sanitary and storm sewer user charges. The fee shall be based an
actual costs and established annually by agreement between the city manager
and E~IEB.
