HomeMy WebLinkAboutOrdinance No. 19352ORDINANCE N4. 19352 AN ORDINANCE ADOPTING THE RIVERFRQNT RESEARCH PARR URBAN RENEWAL PLAN. The City Council of the City of Eugene finds that: A. In recognition of the importance of the University of aregon to the area's economic future, and in realization of the economic potential for development near the University, the Council commissioned a Riverfront Park Study and appointed a study committee . B. A draft Riverfront Park Study containing a recammenda~- taon that an urban renewal distract be created within the Study area was completed in April, 1985 and submitted to the City Planning Department for review and comment. C. At a public hearing before the Planning Commission on May 20, 1985, attended by aver 75 persons, over 24 individuals presented oral testimony on the draft Study. At the conclusion of the meeting, the record was left open until May 30, 1985 for the submission of additional written materials, and 19 groups ar individuals responded with written testimony for the Commission's consideration. D. Seven study sessions were conducted by the Planning Commission, and an Tune 24, 1985 the Commission recommended that the draft Riverfront Park Study be approved, subject to certain modifications. E. 0n July 8, 1985 the City Council held a public hearing on the draft Riverfront Park Study and Planning Commission recommendations. This hearing was preceded by a tour of a 1 - ordinance primary portion of the area and a work session with the Planning Commission . Public testimony was received at the hearing , and the written record remained open until July 17, 1985. At its July 17- 1985 meeting the Council conceptually approved the Riverfront Park Study as modified, and stated its intent to adopt the Study by Ordinance as part of its planned amendment to the Metropolitan Area General Plan. F. The Eugene Renewal Agency, by Resolution No. 914 adopted on June 1~, 1985, created an advisory committee to provide recommendations on the establishment of a tax increment district in the Riverfront Park Study area. The Committee was specifically charged with addressing methods of correcting blighting conditions within the area in a manner consistent with the policies recommended in the Riverfront Park Study. The Committee has developed the proposed Riverfront Research Park Urban Renewal Plan and Report ~Plan~. G. On August 13, 1955, the Planning Commission held a public hearing on the proposed Plan. Following that hearing the Planning Commission voted to recommend to the City Council that the proposed Plan be adopted with certain modifications. H. T he Eugene Renewal Agency has considered the proposed Riverfront Research Park Urban Renewal Plan and Report, and has by Resolution recommended its adoption by the Council. I. After public notice, the Council conducted a public hearing on September 9, 1985 on the proposed Riverfront Research Park Urban Renewal Plan and Report. Based on the recommendations of the Eugene Renewal Agency and the Planning Commission, and the 2 -- Ordinance written and oral testimony before the Planning Commission and the Council, the Council specifically finds and determines that: ~1} The area defined in the Riverfront Research Park Urban Renewal Plan is blighted; ~2} Rehabilitation and redevelopment as proposed in the Plan is necessary to protect the public health, safety and welfare of the City; ~3} The Plan is in conformity with the Metropoli- tan Area General Plan, State Land Use Planning Goals, the Gre enway Plan, the Economic Diversification Plan, the Riverfront Park Study, and other adopted. City plans and policies, and provides an outline for accomplishing the urban renewal projects proposed in the Plan. Such conformity is shown by the findings adopted in Eugene Qrdinance No. 19348, which finding s are incorporated herein as though fully set forth; ~4} The Plan provides that the Eugene Renewal Agency will prepare, adopt and maintain a Relocation Policy providing for the housing of displaced persons, in accordance with ORS 281.045 to 281.145, and without displacing persons already waiting for existing federally subsidized housing, if the Agency acquires property which is occupied; ~5} The acquisition of real property provided for in the Plan is necessary to carry out the purposes and policies of the Plan ; 3 - Ordinance ~6} .I t i s economically sound and feasible to adopt and carry out the Plan; and, ~7} The C i ty will assume and complete all activities prescribed in the Plan to be performed by it. I. All of the area within the boundaries of the proposed Plan is within the corporate limits of the City of Eugene, and no approval of any other municipality is required. N4W~ THEREFQRE, THE CITY of EUGENE DOES ORDAIN AS FQLLOWS: Section 1. Based upon the above findings, which are hereby adopted, the Riverfront Research Park Urban Renewal Plan, which is incorporated herein as though fully set forth, is hereby approved and adopted as the urban renewal plan for the area set forth therein. Section ~. The City Recorder is directed to publish a notice of the adoption of the Plan in the Register Guard, a newspaper published within the City of Eugene and having the greatest circulation therein, no later than four ~4} days following the date this Ordinance is adopted. The notice shall further contain a statement in accordance with the provisions of ORS 457.135 that the Plan shall be conclusively presumed valid for all purposes 90 days after its adoption by this Ordinance and no direct or collateral attack an the action adopting the Plan may be commenced thereafter. Section 3. The City Recorder is further requested to forward a copy of this Ordinance to the Eugene Renewal Agency, 4 ~ Ordinance which Agency will cause the Plan to be recorded in the official records of Lane County, Oregon. Section ~. The City Recorder is further requested to forward a copy of this Ordinance and the Plan to the Lane County Assessor and request that the Assessor perform t he du t i e s directed by 4RS 457.434 through ORS 457.454.
