AN ORDINANCE ORDERING A SPECIAL CITY ELECTION
To BE CONDUCTED BY THE LANE COUNTY ELECTION
DEPARTMENT ON NOVEMBER 5, 1985 FOR THE PURPOSE
OF REFERRING To THE LEGAL ELECTORS OF THE
CITY OF EUGENE A CHARTER A1~ENDMENT CREATING AN
INCOME TAX, LIMITING RATE AND DEDICATING
REVENUES; PROVIDING FOR ALL ACTS NECESSARY
FOR THE CARRYING ON OF SAID ELECTION; AND
DECLARING AN EMERGENCY.
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. The City Council does hereby order an election
to be held in the City of Eugene, Oregon concurrently with the
special election on Tuesday, November 5. 1985, at which time there
shall be submitted to the electors of the City for their approval
or rejection, the following Measure, to-wit:

Charter Amendment creating income tax, limiting rates and
dedicating revenues.
Should there be a City income tax for capital expenditures
initially limited to 4/14 of taxable income and later l/4~?
Charter Amendment creates city income tax. Limits
tax rate to 4/14 of taxable income. Limits tax rate to 1/4%
of taxable income when final payment for city airport and
library improvements has been made. Dedicates income tax revenue
solely to improvements to the city airport and library,
other city capital expenditures and administration of the tax.
THE CITY 4F EUGENE DOES ORDAIN AS FOLL4wS;
BE IT ENACTED BY THE ELECTORS OF THE CITY GF E~7GENE,
that the Charter of the City of Eugene is hereby amended
to add the following provision thereto:
There shall be a city tax on the income of residents of
the city from whatever source derived, and on the income of
nonresidents of the city derived from sources within the
city. The tax shall not exceed the rate of four-tenths of one

percent of taxable income, When all financial obligations
incurred prior to January 1, 1996 for capital improvements at
the Municipal Library and Airport have been paid, the rate of
City income tax shall not exceed 1/4~ of taxable income.
Revenue derived from the imposition of a city income tax is
hereby dedicated solely to improvements to the municipal
airport and library, other city capital expenditures and to
administration of the tax.
This Measure shall become effective upon its approval
by the electors of the C i ty of Eugene ,
Sec ti an ~. The proposed Measure shall be placed upon the
official ballot by the City Recorder, There shall be furnished
to the County Clerk for Lane County certified copies of the
ballot title for the Measure. The City Attorney shall prepare
and the City Recorder shall furnish the ballot title for the
Measure and direct that the County Clerk for Lane County place
the Measure upon the ballot to be used at the special city election
to be held on November 5, 1985, to be voted upon by the electors
of the City.
Section 3. The necessary poll boobs, ballot boxes, tally
sheets and other such supplies for each precinct as are necessary
for the carrying on of the election shall be furnished by the
County Clerk for Lane County, and the supplies shall be delivered
to the Election Board,
Section 4. The City Council hereby orders that the election
shall be held concurrently with the special election on November
5, 1985 and hereby designates as the polling places for the
election in the City of Eugene the polling places established
and designated for the special elect ion , and the C i ty Counc i 1
does hereby appoint the Clerks appointed to serve at that special

election to serve in each of the polling places for the City
election .
Section 5. The polls shall be open in each of the voting
precincts at 5:00 o'clock a.m., Pacific Standard Time, and shall
be kept open until 5:00 0' clock p.m. , Pacific Standard Time,
on election day.
Section 6. The Clerk acting as chairperson of the Election
Board in the special election shall be chairperson of the same
Board of which he or she is a member in the City election, and
the ballots shall be counted and tabulated and the results certified
as provided by law.
Section 7. The City Recorder is directed to give not less
than ten days notice of the election by publication of one notice
thereof in the Register Guard, a newspaper published in the City
and of general circulation therein.
Section ~. The matters contained herein concern the peace,
health, and safety of the citizens of Eugene, and in order to
comply with the directives contained herein, an emergency is
hereby declared to exist, and this Ordinance shall become effective
immediately upon its passage by the City Council and approval
by the Mayor.
