PASSED: 7:0 REJECTED: OPPOSED: ABSENT: Keating CONSIDERED: September 25, 2023 Eugene RESOLUTION NO.5384 A RESOLUTION APPROVING AND ACCEPTING AMENDMENTS TO THE CHARTER FOR ACTIVE BETHEL CITIZENS NEIGHBORHOOD ASSOCIATION TO CHANGE THE NAME OF THE NEIGHBORHOOD ASSOCIATION FROM "ACTIVE BETHEL CITIZENS" TO "ACTIVE BETHEL COMMUNITY." The City Council of the City of Eugene finds that: A. The Active Bethel Citizens neighborhood association is formally recognized by the City of Eugene as a neighborhood association pursuant to Resolution No. 2554, Neighborhood Organization Recognition Policy. The Active Bethel Citizens, neighborhood association charter was approved and accepted by the City Council through approval of Resolution No. 3596 on October 14, 1981. B. The City has an expectation that all formally recognized neighborhood associations be representative and inclusive of their membership. When the Active Bethel Citizens charter was drafted in 1981, referring to those who live in the area as "citizens" was common vernacular. The neighborhood association wants to change their name from "Active Bethel Citizens" to "Active Bethel Community" to better reflect the values of the association and the Bethel community. This name change is in alignment with the Office of Equity & Community Engagement's collaboration with neighborhoods to promote more inclusion in all association areas. It is also consistent with the directive in the Neighborhood Organization Recognition Policy that neighborhood associations "shall be open to the total area and diversity of interests present in the neighborhood." C. Consistent with the requirements in Article X of the Active Bethel Citizens charter, at their general membership meeting on October 20, 2021, the membership of the Active Bethel Citizens voted to amend the charter to change the name of the neighborhood association from "Active Bethel Citizens" to "Active Bethel Community." The association is now seeking City Council approval and acceptance of this charter amendment. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a Municipal Corporation of the State of Oregon, as follows: Section 1. The Active Bethel Citizens charter, amended to change the name of the neighborhood association from "Active Bethel Citizens" to "Active Bethel Community" as provided in Exhibit A attached to this Resolution is hereby approved and accepted. CSity Rezli r Resolution - Page 2 of 2 Exhibit A Charter of the Active Bethel Community Recognition — May 1974 Revised and Approved by membership on October 20, 2021 Approved by Eugene City Council September 2S, 2023 Article I. Name: This neighborhood association shall be known as the Active Bethel Community (ABC). Article II. Statement of Purpose: Section 1 It is the purpose of the ABC to advise the City of Eugene, the Bethel School District (#52), and other public or private bodies concerning the improvement of the livability of the Bethel community. Section 2 ABS has been formed to help resolve the concerns of the people of the neighborhood. These concerns include but are not limited to: land use and planning, social, recreational, educational, economic development and transportation needs; and to promote a sense of community cohesiveness and self-reliance. Section 3 ABC will also serve in an education capacity to inform the citizens in this community, and to continue the planning process by periodically reevaluating its goals, objectives, and recommendations. Article III. Geographic Boundaries: The Bethel community is bounded on the east by US Highway 99; on the south by the Southern Pacific Railroad Coos Bay line; on the west by Green Hill Road; and on the north by Clear Lake. Article IV. Participation: Participation in the ABC is open to persons who are interested in life in the Bethel community. Article V. Officers Section 1 The officers of ABC shall include a chairperson, a vice -chairperson, a secretary, and a treasurer. Ar The officers of the ABC shall include co -chairperson's, a secretary, and a treasurer. Section 2 The qualifications for these offices and the duties of these officers shall be set forth in the bylaws. Section 3 Each officer shall serve for a one (1) year term, or until a successor is elected. Exhibit A Section 4 Any officer may be removed through the following procedure: 1. the motion to remove shall be made and seconded at a regular meeting; 2. the minutes of that meeting shall serve as notice of the proposed removal; 3. the motion shall be considered at the next regular meeting; 4. the motion must receive a three-quarters (3/4) vote of the voting members present for passage. Article VI. Committees Section 1 The ABC may create such committees, both standing and interim, as they deem advisable in accomplishing their purpose. Section 2 Procedures for the creating of committees and selection of their membership shall be set forth in the bylaws. Article VII. Meetings Section 1 The ABC shall meet regularly as set forth in the bylaws Section 2 Special meetings of the ABC may be called by the chairperson upon adequate notice. Adequate notice shall be five (5) days written notice to all persons on the ABC mailing list, or announced at a regular meeting. Special meetings shall be held at a time and place designated by the chairperson. Section 3 Ten (10) voting members of the ABC shall constitute a quorum to do business at a regular or special meeting. Article Vlll. Membership and Voting Section 1 Membership in ABC shall be open to any resident, property owner, or business owner of the Bethel community as defined in Article III. Section 2 Voting is restricted to members eighteen (18) years of age or older. Article IX. Bylaws The ABC shall adopt such bylaws as are necessary to implement this charter. Article X. Amendments Amendments to this charter shall be made through the following procedure: 1. The motion to amend this charter shall be made and seconded at a regular or special meeting; 2. Written notice of proposed changes shall be forwarded to all members (mass distribution) prior to the voting; 3. The motion shall be considered and voted upon at the next regular meeting; 4. The motion must receive a three-quarters (3/4) vote of the voting members present for passage.
