City of Eugene/EWEB Sv 85-~ ~ THB CITY OF EUG$NE DOGS ORDAIN AS FoLLQWS: Section 1. The City Council of the City of Eugene herein initiates the vacation proceedings on its own authority without petition or consent of the property owners, except as provided by statute, of the above described streets and alleys. Section 2. A hea r i ng shall be held upon the proposal to vacate the streets and alleys as herein provided, and the hearing shall be held on the 18th day of December, 1985 at noon, Pacific Time at the Council Chambers at City Hall, Eugene, Oregon, at which time all persons will be heard upon objections or suggestions with regard to the vacation, and at said time the Council will provide for the vacation or deny such vacation, and in case the vacation is made, will provide and make provision for any damages sustained by local assessment. Section 3. The City Recorder is hereby directed to immediately publish once each week for four consecutive weeks in a newspaper published in Eugene, Lane County, oregon, notice of the proposed vacation. The notice shall give a description of the area to be vacated as herein set out; state the date when this Ordinance was passed, the name of any petitioners petitioning for the vacation, and the date when the petition, together with any objections or Ordinance - 1 remonstrances which may be made in writing and filed with the Recorder of the City of Eugene prior to the date of the hearing, will be heard and considered, Section 4. The City Recorder shall forthwith, and within five days after the first publication of the notice post, or cause to be posted, at or near each end of the proposed vacation a copy of the foregoing, which shall be headed "Notice of Street and Alley Vacations", and which notice shall be posted in at least two conspicuous places in or on the area proposed to be vacated. The posting and the first day of publication of the notice shall be not less than twenty-eight X28 ~ days before the time set for hearing. Parcel 1: That portion of Mill Street lying between the South margin of East 4th Avenue and the South line of the East-West alley extended. Parcel 2: The entire East-West alley lying between the East margin of High Street and the West margin of Mill Street. Parcel 3: The North-South alley lying between the South line of the East~West alley and the North line of East 5th Avenue , Parcel 4: That portion of East 5th Avenue lying East of Southern Pacific Railroad and terminating at a point 51.4 feet East of the East margin of the North--South alley. RESBRVING HBREIN an easement for public utility purposes upon and across all the above described parcels, and the right +to enter thereupon for purposes of construction, installata.on, maintenance and repairs.
