HomeMy WebLinkAboutOrdinance No. 19368ORDINANCE No. ~9368~ AN ORDINANCE ADJUSTING 1~TS AND oAii o~'ERPARK SPECIAL BENEFIT ASSESSMENTS AND DECLARING AN EMERGENCY. The City Council of the City of Eugene finds that: 1. qn July 11, 1984 the City Council adopted Resolution No. 3568 directing the extinguishment and adjustment of the 10th and oak Cverpark ~ 4verpark } special benefit assessments ~ Assessments } in a manner that will insure that the net assessment against all affected properties will be just and reasonable. The Resolution further directed the staff to proceed in the manner required for levying assessments for off-street parking facilities. 2. Adequate provision has been made for the retirement of all outstanding unpaid 10th and Oak gverpark Bancroft Improvement Bonds issued by authority of grdinance No. 15635 approved April 29, 1969 and Ordinance No. 17481 approved May 21, 1974, 3. As of September 30, 1985, there exists within the loth and qak gverpark Fund ~No. 521 ~ , $652, 869.38 available for adjustment of the original assessments, This balance will remain in Fund -~-~ ~Na. 521} following .application of all rebates due property owners and payment of the Fund's ~No. 521} obligations to the Downtown Development District Fund ~No. 113} and of other lawful expenses charged to the Fund ~No. 521} This balance consists of investment income on assessment payments and of assessment receiv-~ ables. The disposition of this balance is within the City Council's discretion, which~discretian it is exercising by enacting this grdinance. 1 -~ grdinance 4. The balance in the 14th and Oak Overpark Fund ~No. 521} represents 30.86 of the total amount of the original Overpark Assessment 4$2,115,584.59. Reducing each parcel's original assessment by this percentage preserves each property's proportionate benefit as determined by the original assessments. 5. The City Finance Officer's report of November 5, 1985, the staff report of and the staff response to the staff hearing held on November 14 , and any revisions made to the Finance 4 f f i ce r' s report as a result of settlement agreements reached in the litigation referred to in subparagraph 64h7 below are hereby incorporated herein by reference, approved and declared to be the correct application of the City Ordinances and Council policies regarding the calculation of the amount to be returned or applied to unpaid deficit assessments for each parcel assesesd and the proper identification of the person or the person's personal representative, who made the last payment prior to the satisfaction of the adjusted original assessment. 6. After taking into account: ~a~ The commitments which may hava h~Pn mar~P t-n thA -~- owners of property originally assessed for the Overpark; ~bj The use of public investment in the Overpark to obtain urban renewal grants f or the revitalization of the Eugene downtown; ~c~ The ability of the City to construct other off-street parking facilities without assessing specially benefitted properties; 2 - Ordinance ~d~ The delay of the City in applying net operating revenues to the reduction or extinguishment of the original assessments; fey The assets accumulated in the 10th and Oak Overpack Fund ~ No . 5 21 ~ ; ~ f } The objections to the proposed assessment adjustments heard by the Council; tg~ The City's desire to complete an equitable, fair and just distribution of these accumulated assets; ~h~ The objectors' position and the public expense in pursuing the special proceedings in the Circuit Court of the State of Oregon f or the County of Lane entitled "In the Matter of City of Eugene, a Municipal Corporation, Petitioner vs. Ebella Corporation, et al, objectors",Case No . 1~-84-~64G~, and the willingness of the objectors to withdraw from the court proceedings and allow entry of a default judgment based on settlement agreements in the matter subject to the approval of the Circuit Court; the adjustments herein enacted are fair, just and equitable. ._ .. 7. The City Finance Officer on the 5th day of November, 1985 filed with the City Recorder the proposed adjustments to the original assessments and posted notice thereof on the bulletin board at City Hall. Further, the notice was published in f our successive publications of the Register Guard, a newspaper of general circulation within the City of Eugene on the following dates: November 5, 6, 7 and 8, 1985, and individual notices were sent by certified mail to the owners of the previously assessed 3 -- Ordinance property and other persons affected by the proposed assessment adjustments on the 6th day of November, 1905, which was more than 14 days p r io r to the Counc i 1 hearing on the proposal and the Councils final consideration of this Ordinance and within five days of the first publication of the notice of original assessment adjustment. This notice being more than required, but in compliance with provisions of Sections 7.500 and 7.520 of the Eugene Code, 1971. 8. On the 25th day of November, 1985, at the time and place appointed in the notice of proposed adjustment, the City Council met to hear objections to the proposed assessment adjustments. Objections regarding Acct. Nos. 690011-0049 and 690011-0149 by Schaefers Building Joint Venture Acct. Nos. 690011-0035 and 690011-0135 by St. Mary's Episcopal Church and The Salvation Army were heard and the staff response thereto considered. No further objections or protests have been made or received, 9. Prior to the enactment of this Ordinance, but after the public hearing on the proposed adjustments, the Circuit Court entered a j udgment and approved settlement agreements executed by the parties in Lane County Circuit Court referred to in sub- paragraph 6~h} above, THB CITY OF BIIGBNB DUBS ORDAIN AS FOLLOWS: Section 1. That it is hereby determined that the original assessment for each lot, part of lot and parcel of land previously levied is hereby adjusted by reducing the principal amount as shown next to the description of each lot, part of lot or parcel of land on the attached Exhibit A which is incorporated herein by reference. Section 4. That the City Council does hereby determine that each lot, part of lot or parcel of land is specially benefitted .. to the extent of the total of the original assessments less the adjustment set forth in Section 3 and the deficit assessments, and does hereby declare each and all of said assessments which remain unpaid after this adjustment to continue as liens upon the respective lots, parts of lots or parcels of land, to be collect- ed as required in the Eugene Code, 1971. Section 5. Any excess principal paid on each original assessment after the reconstruction of the original assessment account by the application on an annual basis of excess net 6 -- Ordinance operating revenues and after reduction of the original assessment shall be returned to the person or the person's legal re resentative p , who made the last payment prior to the. satisfaction of the on final 9 assessment, Section 6.
