AN ORDINANCE CONCERNING THE HULT CENTER FOR THE PERFORMING
ARTS; AMENDING SECTIONS 2.013, 2.630, 2.632, 2.634, AND
2.636 DF THE EUGENE CODE, 1911; AND DECLARING AN EMERGENCY.
THE CITY OF EUGENE DOES ORDAIN AS FD LLOWS:
Section 1. The designation for the Performing Arts Commission contained
in Section 2.013 of the Eugene Code, 1971 is amended and rearranged in
alphabetical order therein, to read and provide:

Section 2. Sections 2.630, 2.632, 2.634, and 2.636 of the Eugene Code,
1971, are amended to read and provide:
2.634 Hult Center Performin Arts Commission - Created. A performing
arts commission is established to serve as an advisory body to
the council on policy matters anal to the city manager and center director on
operational matters relating to the Hult Center for the Performing Arts.
2.632 Hul t Center Performi n Arts Commission ~- Duties.
~1) The commission shall consider, and when appropriate, submit
by resolution its recommendations on policy to the council and on opera-
tional matters to the city manager and center director. Recommendations of
the commission may include its consideration of such matters as:
~a~ Whether the center is meeting the needs of the community
to the degree possible, and the commission shall monitor community
opinion in arriving at its evaluations;
fib} Long-range plans for the operational use of the center;
~c~ Processes concerning types of tenant leases, subscription
programs, audience development programs, and other similar long-
term projects as may come before the board;
~d~ Coordination of center activates with other agencies
within and outside the jurisdiction of the city in a manner that
will manimi~e conflicts and duplication;

fie} Coordination with other groups and organizations in the
raising and receipt of private donations and funding far the
center's development and operation.
~2} The commission shall consider and submit by resolution,
recommendations on policy tv the council and on operational matters to the
city manager and center director as follows:
~a} An annual recommendation to the budget committee of the
city. The recommendation shall be specific and detailed. The
commission shall state in its recommendation the budgetary effects
of commission policies and shall give special attention to any
operating surplus or deficiency experienced in the immediately
preceding fiscal year and anticipated in the upcoming fiscal
year.
fib} As necessary, make recommendations to insure that
artistic freedom is preserved in the selection and giving of
performances at the center.
~c} Make any recommendations necessary to provide a diverse
and wide range of type of performances that will appeal to the
interests of a representative crass-section of the community.
~d} Recommend initial and review from time to time, rules,
regulations and operating policies concerning operation of the
center.
fie} Make an annual report to the council of the activities
and financial condition of the center, which information shall be
made available to other commissions and officials of the city as
i s necessary or desirable .
2.634 Hult Center Performin Arts Commission - Membershi Term of Office.
~~} The commission shall consist of nine members nominated by the
mayor and appointed by the council. The city manager shall serve as an ex
officio member of the commission.
~2} The term of office for each member, exclcusive of the ex
officio member, shall be for four years.
~3} A vacancy in the commission shall be filled in the same manner
as original appointments far the unexpired term of the. predecessor member.
A vacancy shall occur upon:
~a} The death or resignation of a member;
fib} A member ceasing to be qualified for original appaint-
ment;
~c} Termination of a member's term pursuant to section
2.6363}; or
~d} Removal of the member by an affirmative vote of the
council.
2.636 Hutt Center Performin Arts Commission - Officers, Meetin s Rules
and Procedure.
t1} The officers of the cornmissian shall be a president and a
vice-president elected by the members of the commission. Initial officers
shall serve for terms of three years or until a successor is appointed or
elected for the office. Subsequent officers shall serve for terms of two
years, or until a successor is appointed ar elected for the office. The
president shall preside aver meetings~of the commission and shall have the

right to vote. The vice-president shall perform the duties of the president
in the absence or disability of the president.
~~} The commission shall hold regular meetings at least once a
month, and at such other times as may be necessary tv properly perform its
dunes.
~3} The term of a commission member who fails to attend two
consecutive regular meetings shall automatically be terminated unless his ar
her absence has been excused by the president or by vote of the cammission.
~4} The commission shall adopt a plan of internal organization
and rules of procedure necessary for the conduct of its business, consistent
with state law, the charter, code, ordinances and resolutions of the city,
which shall be submitted to the council and become effective upon council
approval thereof. Meetings and other activities of the commission, its
officers and committees, shall conform to the rules, state statutes, charter
provisions, code, ordinances and resolutions of the city.
Section 3. That the matters contained herein concern the public wel-
fare, and in order to insure the timely appointment of members in accord-
ance with the provisions hereof an emergency is declared to exist, and this
ordinance shall become effective immediately upon its passage by the City
Council and approval by the Mayor.
