HomeMy WebLinkAboutOrdinance No. 19376ORDINANCE NO. 19375 AN ORDINANCE CONCERNING LAND USE; AMENDING SECTIONS S.8Z3, 9.ab0, 9.384, 9.38b, 9.54b, AND 9.b74 OF THE EUGENE CODE, 1971; AND DECLARING AN EMERGENCY. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS; Section 1. Section 8.823 of the Eugene Cade, 1971 is amended to read and provide: S.8Z3 Decision and A eat Authority. If a sign district boundary change. . is for property proposed for annexatian to the city, the planning commission shall recommend a sign district designation to the council in con- junction with the annexation, unless it denies the annexation. The city council shall act on planning commission recommendations for city sign dis- tri ct designations i n conjunction with annexations an an appeals from cammi s- cion denials. Except as otherwise provided in this section, the council shall follow the procedures in Chapter 9 of this code for annexations when considering sign district designations for properties also being considered far annexatian. If a sign district boundary change only includes property already in the city, it shall be approved, modified and approved, or denied by the hearings official. The planning commission shall act on appeals from decisions of the hearings official. Commission decisions are final. A11 final sign district boundary change decisions shall be by order which sha11 mandate in relevant cases that the Sign District Map be amended to reflect the a1lawed change of sign district. Section Z. The provisions for Alley access parcels contained in sub- section ~a~4. of Section 9.Ob0 of the Eugene Code, 1971, are amended to pro- vide 9.0b0 Plattin and Ma in Standards - Lots and Parcels. A11 lots and parcels shal 1 comply with the following requirements. In thi s section "lots" and "parcels" are used interchangeably. When more restric- tive, related provisions in the zoning ordinance apply. ~a~ Lot Area Minimums. 4. The matrix set forth in Section 9.384 of the Eugene Code, 1971 is amended by deleting the "P" from the RA and R-1 columns in connec- tion with "Dwellings, Multi-family": 9.384 RA R1 R2 R3 R4 Dwellings Multi-family Std 17} ................ P P P Section 4. Subsection (11} of Section 9.356 of the Eugene Code, 1971, is amended by amending subparagraphs (b) and (c), relettering the current subparagraphs (d) to (q) to (e) to (r), and adding a new subparagraph (d), to read and provide; 9.3$5 S ecial Standards Far Certain Uses In Residential Districts. X11} Alley Access Parcel: The planning director may authorize creation of an alley access parcel if it will conform to the following criteria: ~a} The alley access parcel will be created from an existing 1 of or parcel i n a residential zoning district. fib} Except as provided in subsection ~d} below, the original lot or parcel contains at least 7,200 square feet in the R-2, R-3, and R~4 districts and 9,004 square feet in RA and R-1 districts. ~c} Except as provided in subsection ~d} below, bath result- ing parcels will be at least 4,540 square feet in area in RA or R-1 districts, and 3,500 square feet in R-2, R-3, and R-4 districts. ~d} In the R-2, R-3, and R-4 districts, the planning direc- tor may approve an alley access parcel with a minimum of 2,250 square feet provided: 1. The original parcel legally existed on February 10, 1986. Ordinance - 2 2. The original parcel contains at least 4,500 square feet. 3. The street front parcel will contain at least 2,250 square feet. 4. All other a11ey access parcel standards in this~sec- tion wi11 be observed. 5. 1f the a11ey access parcel will be less than 3,500 square feet, it wi11 comply with the special small lot stand- ards in this section, except those regarding minimum frontage, minimum front setback, minimum lot depth, and minimum front 6. 1f the new street front parcel will be less than 3,500 square feet, it will also comply with all the sma11 tat standards in this section. Section 5. Subsection ~5~ of Section 9.546 of the Eugene Code, 1911, is amended to read and provide: 9.546 Lot ar Deve1a ment Site Area Re uired Per Dwel1in Unit, (5~ In the GO district, the minimum lot or development site area required per dwelling unit sha11 be the same as the area required in the R-3 district. Section 6. Section 9.674 of the Eugene Cade, 1971, is amended to read and provide: 9.674 Decision and A eal Authority. If a zone change is for property proposed far annexation to the city, the planning commission shall recommend a city zoning district designation to the council in conjunction with the annexation, unless it denies the annexation. The city council shall act on planning commission recommendations for city zoning district designations i n conjunction with annexations and on appeals from commission denials. Section 7. That the matters contained herein concern the public we1- fare and safety, and in order to insure the orderly implementation of the Ordinance - 3 provisions hereof an emergency is hereby declared to exist, and this Ordi- nance shall become effective immediately upon its passage by the City Council and approval by the Mayor.
