HomeMy WebLinkAboutOrdinance No. 19382ORDINANCE N0.1~ AN ORDINANCE AMENDING THE EUGNE-SPRINGFIELD METROPOLITAN AREA GENERAL PLAN The City Council of the City of Eugene finds that: 1. The Eugene-Springfield Metropolitan area General Plan Metropolitan Plan was originally adapted by the Eugene City Council on July 28, 1980, by Eugene Drdi Hance No . 18921 and has served since that time as the basic 1 and use planning guide for the City of Eugene. That Plan was acknowledged by the Land~Conservation and Development Commission in 1982 up to the urban growth boundary. The remainder of the Plan was adapted on September 9, 1985 by Eugene Ordi Hance 19345 and was acknowledged i n September of 1985. 2. 1n September of 1984, a work program fora 2 1/2 Year Mid-Period Review for the Metropolitan Plan was adopted by the Metropalitan Policy Committee MPC}. 3. Public notification of the upcoming Mid-Period Review was conducted through newsletter mai 1 i ngs to i ndi vi dual s on the mai 1 i ng 1 i st of the Metropalitan Area Planning Advisory Committee ~MAPAC}, through news ref eases, 1 egal nati fi cati on and public meeting announcements . 4. A Status Report and a Monitoring Report on the Metropolitan Plan were ref eased for publ i c review i n early January 1955. 5. The Lane County, Eugene and Springfield Planning Commissions conducted public meetings on MidwPeriod Review Plan amendment proposals in January 1985. fi. Proposed amendments to the Metropolitan Plan were first reviewed by MAPAC and MPG. A document entitled "MPC`s Plan Review Report, l~ol`s 1 & 2" was prepared to aid MPC in its review of these amendments, ?. In accordance with the Post ~4cknowledgment plan review rocedures of DRS p 191.610 - .550, the proposed amendments to the Metropolitan Plan, as contained i n "MPC ` s Plan Review Report" , were transmitted to the Department of Land Conservation and Development an October 21, 1955. S. The Metropalitan Policy Committee released its recommendation regarding the proposed amendments to the Metropoi i tan Plan on October 1, 1985, 9, The metropolitan area's three planning commissions held a joint public hearing on MPC`s recommendations regarding the proposed amendments to the Metropalitan P1 an on October 28, 1985. 1- .Ordinance 19382 1d. The Lane Caunty, Springfield and Eugene Planning Commissions adopted recommendations to their respective governing bathes concerning the prapased amendments to the Metropolitan Plan on November 12, November 6, and November 25, respectively. 11. The governing .bodies of Lane County, Springfield and Eugene held a joint public hearing an December 3, 1986 regarding the planning commissions' recommendations on the proposed amendments to the Metropolitan P1 an . 12. The Department of Land Conservation and Development presented the Metropolitan Area wi th a Past Acknowledgment review report on the proposed amendments to the Metrapol i tan P1 an on December 19, 1985. 13. The governing bodies of Lane County, Springfield and Eugene took initial action an the proposed amendments to the Metropolitan Plan on March 11, January 6 and January 8, respectively. The eight propased amendments which did not recei ve a consensus vote by~. the governing bodies were sent back to the MPC far the formulation of a consensus position . 14. The Metropolitan Policy Committee forwarded a compromise recommendation on the eight non consensus amendments to the governing bodies of Lane Caunty, Springfield and Eugene on March 25, 1985. 15: The governing bodies of Lane County, Springfield and Eugene took final and unan i maus action on the proposed amendments to the Metropolitan Plan on May 14, May 5 and Apri 1 23, respectively. 16. Exhibit "A" to this Grdinance, which contains, in legislative format, the revisions to the Metropolitan Plan, is incorported herein as though fully set Earth. 1?. Findings i n support of the revisions to the Metrapo1 i tan P1 an, as contained i n Exhibit "A" to this Grdinance, are contained i n Exhibit "B" , Cumulative Impact Analysis; Exhibit "C", Statewide Goal Findings; Exhibit "D", Findings Supporting Diagram Amendment Denials; Exhibit "E", Additional Findings For MPC' s Plan Review Report Val ume 1; Exhibit "F" , MPC' s P1 an Review Report Vol ume 1; and Exhibit "G" , MPC' s Plan Review Report Val ume 2. These exhibits are also i ncorparated herein as though fully set forth. NOVA, THEREFORE, THE CITY OF EUGENE DOES ORDAIN AS FOLLOV~S: Section 1. The Metropolitan Plan i s amended according to the 1 anguage contained in Exhibit "A", incorporated herein by reference. 2- Ordinance ~ Section 2. The findings set forth above are adopted with the findings contained i n the amendments and supporting e~hi bi is and i n the on gi nal Metrapol i tan Plan which are incorporated herein by reference. ' Section 3. ~f any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction , such portion shal 1 be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions hereof.
