HomeMy WebLinkAboutOrdinance No. 19395ORDINANCE NO. ~'S~ AN ORDINANCE APPROVING AND ADAPTING THE ALTAN BAKER PARR MASTER PLAN AS A REFINEMENT OF THE EUGENE-SPRINGFIELD METROPOLITAN AREA GENERAL PLAN« The City Counc i 1 of City of Eugene finds that A. In April, 1972 the Lane County Board of Commissioners established the Alton Baker Park Advisory Committee, which in- cluded representatives from Eugene, Springfield, Lane County, EWEB and other members the Board deemed appropriate. One of the Com-- mittee's responsibilities was .to "Guide the preparation of a General Park Master Plan for the consideration and approval of the Board , " B. On June 18, 1986 the Lane County Board of Commissioners adopted the Alton Baker Park Master Plan, including the revisions thereto recommended by the Lane County Planning Commission, attached as Exhibit "B" to Ordinance PA No, 914. C. 0n June 18, 1986 the Joint Parks Committee concluded that the Alton Baker Park Master Plan as adopted by the Lane County Baard of Commissioners is consistent with the Eugene-Springfield Metropolitan Area Plan, in compliance with Land Conservation & Development Commission Statewide Land Use Planning Goals 5, 8, and l5, and recommended its adoption by the Eugene City Council as a refinement of the Eugene-Springfield Metropolitan Area General Plan. NAW,'THEREFARE THE CITY AF EUGENE DOES ORDAIN AS FALLAWS: Section 1. The above findings, the findings and recommen- dations set forth in the Alton Baker Park Master Plan, and the findings of compliance with Statewide Land Use Planning Goals 5, 8 and 15 set forth in the Appendix to the Alton Baker Park Master Plan are hereby adopted. Section 2. The Alton Baker Park Master Plan as adopted by the Lane County Board of Commmissioners by Ordinance No. PA 914 on June 18, 1986 is hereby approved as being in compliance with the Eugene-Springfield Metropolitan Area General Plan and Statewide Land Use Planning Goals 5, 8 and 15, and is adapted as a refine- ment plan to the Eugene~Springf field Metropolitan Area General Plan. Section 3. The City Recorder is requested to attach a copy of the Alton Baker Park Master Plan which incorporates the revi-~ sions set forth in Exhibit "B" to Ordinance No. PA 914 of the Lane Ordinance - 1 County Board of Commissioners to this ordinance. Section 4. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held in- valid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions hereof. PA 914 _ ~ IN THE MATTER OF ADOPTING THE ALTON BAKER PARK MASTER PLAN, A REFINEMENT PLAN Ta THE LANE COUNTY PARKS MASTER PLAN AND THE EUGENE-SPRINGFIELD METROPOLITAN AREA GENERAL PLAN WHEREAS, the Lane County Board of Commissioners by Order No,. 72-4-5- ?, established the Alton Baker Park Citizens' Advisory Committee, whose duties include among others: "guide the preparation of a general park master plan for the consideration and approval of the Board"; and WHEREAS, the Alton Baker Park Citizens' Advisory Committee has prepared and issued the Alton Baker Park Master Plan; and WHEREAS, the Alton Baker Park Master Plan provides policy direction and recommendations for uses and development of the Park; and c WHEREAS, the Board has received from the Lane County Planning Commission` a, recommendation to approve the proposed Master Plan, with some mod~f ~catzons; and WHEREAS, the Board of County Commissioners has conducted a public hearing and is now ready to take action; NOW ~ ' THEREFQRE, the Board of County Commissioners Ordains as follows: 1. The Alton Baker Park Master Plan as set forth in attached Exhibit 'A' as amended by Revisions to the March, 19$6, Alton Baker Park Master Plan as recommended by the Lane County Planning Commission attached hereto and indicated as Exhibit 'B' be Adopted. Modify the first sentence in the first paragraph on page 5 under Sub- Zone 1 A -Meadows by deleting phrase "constituting the greatest area of the park", a v. c ~'. Under the heading "Specific Criteria for Opportunity Area": a} madif y no. 6 to read: "The developer of a project must provide bonding on other financial guaranty to protect the County and City from financial adverse impacts." b} add a new criteria no. 7: nAll uses proposed for the opportunity area shall be in compliance with zoning and the Metropolitan Plan. . A citizen committee appointed by the City and County shall hold a public hearing on any proposed uses." Under the heading Sub - Zo~ne_ 1D -East Gate woodlands madif third Y paragraph by: a} deleting "If and"; and b} adding "~willamette Nature Center}" after redeveloped. Under the heading Plan Amendment Process, on page l6: a modify no. 1 to read: "Any proposed change must be consistent with the Master Plan and provide enhancement or support to the park." b} delete no's. 2, 5, and 6. c} ~ modify no. 4 to read: "All requests must be reviewed by a citizens- committee appointed by the Board of County Commissioners and the Eugene City Council to determine if the criteria have been met and if not, why not. d) modify no: 7 by deleting the phrase "unless that plan is amended." L Alton Baker Park Master Plan, March, 1986, is not attached; it is on file and available by written request to the Eugene City Recorder's Office.
