An Ordinance initiating the vacation of the following des-
cribed street, to-wit:
As described on Exhibit A, attached hereto
and incorporated herein by reference, City
of Eugene SV 86-002
THE CITY CF EUGENE DQES ORDAIN AS FoLLOT~S:
Section 1. The City Council of the City of Eugene herein
initiates the vacation proceedings on its own authority without
petition or consent of the property owners, except as provided by
statute, of the above described street.
Section 2. A hea r i ng shall be held upon the proposal to
vacate the street as herein provided, and the hearing shall be
held on the 22nd day of September , 1986 at 7 : 3 0 p , m. , Pac i f i c
Daylight Time at the Council Chambers at City Hall, Eugene,
Oregon, at which time all persons will be heard upon objections
or suggestions with regard to the vacation, and at said time the
Council will provide for the vacation or deny such vacation, and
in case the vacation is made, will provide and make provision for
any damages sustained by local assessment.
Section 3. The City Recorder is hereby directed to immedi-~
ately publish once each week for four consecutive weeks in a
newspaper published in Eugene, Lane County, Oregon, notice of the
proposed vacation. The notice shall give a description of the
area to be vacated as herein set out; state the date when this
Ordinance was passed, the name of any petitioners petitioning for
the vacation, and the date when the petition, together with any

objections or remonstrances which may be made in writing and
filed with the Recorder of the City of Eugene prior to the date
of the hearing, will be heard and considered.
Section 4. The City Recorder shall forthwith, and within
five days after the f first publication of the notice post, or
cause to be posted, at or near each end of the proposed vacation
a copy of the foregoing, which shall be headed "Notice of Street
vacation", and which notice shall be posted in at least two
conspicuous places in or on the area proposed to be vacated.
The posting and the first day of publication of the natice
shall be nat less than twenty-eight ~28~ days before the time set
for hearing.

VACATION DESCRIPTION FOR A PORTION OF EDISON STREET
A parcel of land in the Northeast quarter of the Northwest quarter of
Section 26, Township 17 South, Range 4 West of the Willamette Meridian
and beingx more particularly described as follows:

Beginning at a point on the Northerly line of the Soloman Zumwalt and
Wife Donation Land Claim No. 41, Notification No. 2091, Township 17
South, Range 4 West of the Willamette Meridian, said beginning point
being the intersection of the the Easterly right. of way line of the
Oregon Electric Railroad know know as Burlington Northern} X100.00
feet wide} with the Northerly line of said donation land claim, and
being North $9° 46' 40" East 338.91 feet from the Northwest corner
thereof: thence South 33° 58' East along said Easterly right of
wayline, $69.84 feet; thence leaving said Easterly right of way line
and run South 89° 27t East 335.43 feet to a point which is 30.0 feet
when measured at right angle from the Northerly prolongation of the ~ --
Westerly line of the Replat of Blocks 4,7 and 8 and the South half of
Blacks 5 and 6 of the Plat of Bethel, has platted and recorded in
Volume 11, page 2S of Lane County Oregon Plat Records}, said last
mentioned point being the TRUE POINT OF BEGINNING of this description;
thence North DO° 07' East 59.83 feet parallel with the Northerly
prolongation of the Westerly line of said replat; thence South 89° 45'
East 60.OD feet to a point 30 feet East of the Northerly prolongation
of the Westerly line of said replat; thence South DO° 07 West 268.25
feet along a line 30 feet East of and parallel to said Northerly
prolongation of the Westerly line of said replat to the North line of
Be11 Street; thence continue South 00° 07~ West 15.60 feet; thence.

of Edison Street X40 feet wide} as shown on said Replat; thence North

Electric Railroad; thence leaving the westerly right of way line of
said Replat and run North 05° 26' 30" West 309.87 feet; thence North

description, all in Section 26, Township 17 South, Range 4 West of the
Willamette Meridian and containing 35,804.50 square feet.
The intent herein being to vacate all of that property deeded to the
City of Eugene by Reel 276D, Instrument No. 25191; by Reel 276D,
Instrument No. 25192; Reel 275D, Instrument No. 22745; Reel 2$8D,
Instrument No. 48634 of the Lane County Oregon Deed Records.
