AN ORDINANCE CONCERNING THE D04~~NTOwN DEVELOPMENT DISTRICT
AND FEES FOR PARKING; AMENDI~JG SECTIONS 2.153, 2.812,
3.700, 5.233, 5.285, AND 5.335 DF THE EUGENE CODE, 1971;
PROVIDING AN EFFECTIVE DATE; APdD DECLARING AN EMERGENCY.
THE CITY OF EUGENE DOES ORDAI~J AS FOLLO~~S:
Section 1. Section 2.153 of the Eugene Code, 1971, is amended to read
and provide:
2.153 Downtawn Commission - Downtawn Devel opment District Activities.
e scope of actions to be undertaken by the commission to finance
in the Downtown Development District a program of economic promotion, down-
town development, and public parking which may include the promotion of para-
transi t, transit, walking and bicycling, include but are not limited to the
following:
~ a} Prepare and submit i n compliance with city budget proce-
dure and schedule, a preliminary budget for a program of economic
promotion, downtown development and the Downtown Development Dis-~
tri ct parking program, The budget shall estimate i ncorne and expen-
ditures for the immediately ensuing fiscal year and be in a format
-~- ~ prescri bed by the city r~anager.
~b~ Submit to the city manager or hislher designee in com-
pliance with the city budget schedule, a written proposal of the
.rates of ad valorem and busi Hess-and-occupation taxation that the
commission deems necessary to finance the downtown development and
parking program during the next year.
~c~ All proceeds from ad valorem and business-and-occupation
taxes specially levied i n the Downtown Development District to
finance the promotion, development, and parking program and al l
other income generated by Downtown Development District funds or
programs shall be credited to a fund known as the Downtawn Develop-
ment Fund, The commission shall have power to expend the fund
solely to implement the program within the Downtown Development
District,
Section 2. Subsection ~2~4a~ of Section 2.812 of the Eugene Code, 1971,
is amended to read .and provide:

city parks and. recreati on areas, city buildings, or other city

Section 3. Subsections 42}, 43}, and 44} of Section 3.700 of the Eugene
Code, 1911, are amended to read and provide:
3.100 Downtown Develo meet District Tax - Lev .
42} Except as provided i n subsections 43} and 44} of this section
and except for professionals, for those exempt under state law from municipal
taxation, and for an owner or occupant of property exempt from taxation under
section 3.755 of this code, each person who engages in a business in the
Downtown Development District during part or all of a quarter of a year shall
pay to the city far that quarter a tax of $3.50 per $1,000 of the gross re-
tail sales and receipts from the business during that quarter. A minimum tax
of $10.0o shall be charged each quarter of a year for each business,
.43} Each person engaged in banking or a savings and loan associ-
at~on business ~n the Downtown Development District during part or all of a
quarter of a year, shall pay t0 the city for that quarter a tax of $3.50 per
$1,000 of one and three-quarters percent 4.0115} of the total demand deposits,
and of $3,50 per $1,000 of five-tenths of one percent 4.005} of the total
time deposits. Total time and demand deposits of banks shall be the total
daily average deposits during that quarter as reported on the Federal Reserve
Call; and total time deposits of savings and ]oan associtions shall be the
total daily average of all savings deposits during that quarter. Whenever
savings and loan associations receive demand-type deposits, the tax rate on
those deposits shall be $3.50 per $1,000 of one and three-quarters percent

44} Each person engaged i n a consumer finance business i n the
Downtown Development District during part or all of a quarter of a year shall
pay to the city far that quarter a tax of $3.50 per $1,OOo of five percent
4.05} of the total principal balance of direct loans outstanding at the end
of that quarter, excluding finance charges.
Section 4, Subsection 42} of Section 5.233 of the Eugene Code, 1911,
is amended to read and provide:
5.233 Information for Control of Parkin in Downtown Develo ment
District.
42} The information required by this section shall be supplied
in a mode and on forms prescribed by the city manager or the manager's
designee.
Section 5. Subsections (5) and (6) of Section 5.285 of the Eugene
Code, 1911, are amended to read and provide:
5.285 Ch arges fOr,Off-Street Parking.
45} Except for the airport as defined in section 2.415 of
this Code, the following maximum charges are hereby established for

ci fi c facility or part thereof and the conditions upon which parking i s auth-~
on zed shat l be established by administrative action of the city manager
except he may not establish the charges or conditions for parking facilities
within the Downtown Development District without first receiving the recom-
mendati on of the Downtown Commission;

{ a} ~~ai ve all or part of the charges established i n subsec-
ti on { 5 ~ of this section far persons who ri de-share, carpool or
ride motorcycles and park them in designated spaces, for physi-
cally disabled persons, for participants in special events of
community interest, for city sponsored events, for persons re-
quired to park at city hall in order to perform their offic7al
duty or far persons obligated under a contract to perform services
at city hal 1 when the cost of such parking would be passed on to
the city as part of the contractual obligation to pay for the
services.
{b~ Collect all charges on an annual basis or any part
thereof ,
{ c~ Establish discount rates for purchasing parking permits
i n bulk or for multiple months,
Section 6, Section 5.335 of the Eugene Code, ~97~, is amended to read
and .provide ;
5.335 On-Street Parking Meter Rates.
The m~n~mum and maximum charges for on-street parking in park-
ing meter zones are hereby established at between $D,25 and $2.44 for one
hour.
{2~ The city manager when designating parking meter zones, hourly
rates and ti rye l i a~i tati ons by administrative action r,~ay adjust the time re-
cei ved for depositing less than atwenty-five cent coin to approximate the
rates established. ~n making this adjustment consideration shall be given
to the cost of modifying the parking meters affected and the denand for park-
ing in the zone.

when no parts are available, the city manager may continue to use parking
meters which have a rate ~ ess than the rate established i n subsection { 1 ~

1, 1986,

and welfare and therefore, an emergency is hereby declared to exist, and
this ordinance shall become effective immediately upon its passage by the
City Council and approval by the P~ayor.
