ORDINANCE N0. 1 Q 4 3 Z. AN ORDINANCE LEVYING/CONCERNING ASSESSMENTS FOR PAVING, SIDEWALKS AND STORM SEWER IN DIVISION AVENUE, FROM RIVER ROAD TO 15D0 FEET EAST; PAVING AND SIDEWALKS TN RIVER ROAD FROM DIVISION AVENUE TO 600 FEET NORTH; AND SANITARY SEWER AND STORM SEWERS TO SERVE THE AREA BETWEEN RIVER ROAD AND ROSS LANE AND BETWEEN BELTLINE ROAD AND 1200 FEET NORTH OF BELTLINE ROAD; AMENDING ORDINANCE NO. 19234; AND DECLARING AN EMERGENCY. The City Council of the City of Eugene finds that: On March 12, 1984, there was passed by the Council and approved by the Mayor, Ordinance Na. 19234, levying an estimated assessment against the properties listed an the Assessment Ro11 attached thereto for paving, sidewalks and storm sewer in Division Avenue, from River Road to 15o0 feet east; paving and sidewalks in River Road from Division Avenue to 600 feet earth; and sanitary sewer and storm sewers to serve the area between River Road and Ross Lane and between Beltline Road and 12DD feet north of Beltline Road. Final casts of the project have been calculated, and pursuant to the provisions of Sections 7.235 of the Eugene Code, 1911, the Council has by motion declared a deficit in the assessment for Accounts No, 840001--0010, 840001-oD20, 84x001-aD30, 840001-DD40, 840001-0010, 840D01-DD80, 840D01-OD90, 840001-0100, 840001-0110, 840a0~.--0111, 84000.-0112, 84aa01-0115, 84000.-x130 and 8400D~.-0150, and established December 1, 1986, as the time for hearing objections to the deficit assessment. Pursuant to the provisions of Section 7.24D of the Eugene Code, 1971, the assessment roll attached to Ordinance No. 19234 should be amended to reflect the reduced assessment for the remaining account, together with new Accounts Na. 840001-DD11, $40001-0021, 84aD01-0031, 840001-x041, 840001-0011, $40001-OD81, 840001-Da91, 840x1-0101, 8400x1-0113, 840001-D114, 84a001-~0116, 840001-0117, 840001-0131, and 84001-0151. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. Based upon the above findings, which are incorporated herein, and pursuant to the provisions of Sections 7.235 of the Eugene, Code, 1971, a deficit assessment is hereby declared for Accounts No. 840001-OD10, 840001.-0020, 84aoal-~DO3a, 84ooo1-DD4D, 84aoal-DD1a, 84DOal-DD8D, s40Da1-DagD, 84aoo~-a1aD, 840001-D11D, 840001-D111, 840001-D112, 840001-0115, 840001-0130, and 840001-0150, and Ordinance No. 19234 passed by the Council on March 12,,1984 and approved by the Mayor on March 12, 1984, is hereby amended by correcting the assessment call as attached hereto to reflect such deficit assessment. Section 2. Pursuant to the provisions of Section 7.240 of the Eugene Code, 1.911, Ordinance 19234 passed by the Council and approved by the Mayor on March 12, 1984 is hereby amended by correcting the Assessment roll attached hereto to reflect the reduced assessments for the remaining accounts 1i.sted thereon. Section 3. The finance officer is directed to make the above corrections to the docket of city liens and to send a corrected notice of assessment to the property owners set Earth in Sections 1 and 2 above. Section 4. Except as herein specifically amended, all other provisions of Ordinance No. 1.9234 and the assessments provided far therein remain in full force and effect. Section 5. It is necessary that the above corrections be made as soon as possible, and therefore, an emergency is hereby declared to exist, and this Ordinance sha11 be effective immediately upon its passage by the City Council and approval by the Mayor. RECITALS: The City Council of the City of Eugene did by Resolution Na. , 3 82 0 , adopted D , l9 83, determine to pave streets and construct sidewalks and storm sewers in Division Avenue from River Raad to 1500 east; pave streets and construct sidewalks i~n River Road fram Division Avenge to 600 feet earth; and construct sanitary and storm sewers to serve the area between River Road and Ross lane, and between Beltline Road and 1200 feet north of Beltline Road.
