HomeMy WebLinkAboutOrdinance No. 19454ORDINANCE NO. /~`/_.S~ AN ORDINANCE REQUESTING THAT JURISDICTION OVER PORTIONS OF GILHAM ROAD AND WILLAREN2IE ROAD BE TRANSFERRED TO THE CITY OF EUGENE; AND DECLARING AN EMERGENCY. The City Council of the City of Eugene finds that: The City Council deems it necessary and expedient and in the best interests of the City to acquire jurisdiction over the following county roads: a. Gilliam Road from Crescent Avenue to Honeywoad Avenue; b, willakenz ie Road fr. om Coburg Road east 1, 700 feet; all of which lie within the corporate limits of the City, to the same extent as .it has over public streets and alleys of the City. The Board of County Commissioners of Lane County, Oregon has authority under the provisions of ORS 373.270 to release juris diction over county roads within the limits of the City of Eugene, and should be requested to do so. NOW, THEREFORE, THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. Based upon the above findings, which are into r- porated herein by reference, the City Council of the City of Eugene finds it necessary and expedient and in the best interests of the City to acquire jurisdiction over the following County Roads a. Gilliam Raad from Crescent Avenue to Honeywaod Avenue; b. Willakenz ie Road from Coburg Raad east 1, 70~ feet; to the same extent as it has over other public streets and alleys Ordinance - 1 of the City . Section 2. The City Council directs that a copy of this Ordinance be forwarded to the Board of County Commissioners of Lane County, Oregon, which Board is requested to release juris-- diction of the above described County Roads to the City of Eugene in accordance with the provisions of ORS 373.270. Section 3. Upon receipt by the City Manager., within ninety days fr. om the date hereof , of a certified copy of an order of the Board of County Commissioners of Lane County, Oregon releasing j ur ~. sd i c t ion of the above described port ions of Gilham Road and Willakenzie Road to the City of Eugene, the City shall have the same control, power and jurisdiction aver the streets as it has over all other. streets and alleys within the City of Eugene, Section 4, In the event the Board of County Commissioners of Lane County fails to enter the order referred to in Section 3 above within ninety days from the date this Ordinance is adopted by the Council and approved by the Mayor, the request and authori- zation contained herein shall terminate as though this Ordinance had not been adopted. Section 5. That the matters contained herein affect the public welfare and safety and therefore, an emergency is hereby declared to exist, and this Ordinance shall become effective immediately upon its passage by the City Council and approval by the Mayor.
