AN ORDINANCE AUTHORIZING AND CREATING PROCEDURES FOR THE
DISPOSITION OF SURPLUS REAL PROPERTY BY THE EUGENE WATER
& ELECTRIC BOARD; ADDING A NEW SECTION 2.196 To THE
EUGENE CODE, 1971; AND DECLARING AN EMEREGENCY.
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. Anew Section 2.196 is hereby added tv the Eugene Code, 1971,
to read and provide;

board may dispose of real property not needed for utility ur oses
in accordance with state 1 p p
aw. In the event the board or its designee deter-
mines that real property is not needed for utility purposes, it shall afford
the city the opportunity to obtain the property for other munici al ur oses

by not~fy~ng the city manager of its availability. If the cit desires to

city manager and the board's general manager shall ne otiate an a reement to

shall be completed within five t5~ years from the date of notification. The
board may dispose of the property by such means and terms as it deems a ro-

pleted within five ~5} years of that notification.
Section 2. That the matters contained herein concern the ublic health

welfare and safety and therefore, an emergency is hereby declared to exist
