AN ORDINANCE CONCERNING REFUSE COLLECTION
RATES; ADDING A MECHANIZED CURBSIDE COLLECTION
MINIMUM FEE SCHEDULE FQR -~0- To 9Q GALLON
CONTAINERS; AND DECLARING AN EMERGENCY.
The City Council of the City of Eugene finds that:
Under the provisions of the Eugene Code, 1971, the Council
has the authority and responsibility to establish minimum rates
for collection of refuse within the City.

A mechanized curbside refuse service for ~0- to 90 anon

containers has recently been introduced by local refuse collectors
for which no minimum fee schedule has been established.
The Refuse and Recycling Board has reviewed information and
testimony from the refuse hauling community, City staff, Lane
County Solid i~aste Management staff, and the public in order to
develop a recommendation on a minimum rate to be charged far this
service. At its public hearing of May 12, 1987, the Refuse and
Recycling Board recommended adoption of a minimum monthly rate of
$10.04 for weekly service x$7,65 collection fee, $2.35 ti in

feed. The Board further recommended that a limited review of this
rate, as well as .the City's provisions relating to refuse and
recycling practices, license fees, and other rate structures be
undertaken between now and May 1, 1988 and reconsidered at that
time.
The Refuse and Recycling Board also recommended that the
Cauncil adopt a policy that declares a service utilizing a con-
tainer larger than 94 gallons constitutes a new service. An

refuse collector who wishes to provide that service should be
ordinance - l
required to so notify the City at least 60 days prior to implemen-
Cation of the service.
The Council has considered the Board's recommendations and
finds that the proposed minimum collection rate takes into consid-
eration the current schedule of rates charged by Lane Count ;

takes into account the expressed concerns and proposals of the
local refuse collectors; is just, fair and reasonable in light of
the interests of the public and collectors; and should be a roved

and established.
Now, therefore,
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. Based upon the above findings, which are hereb

adapted, and pursuant to the authority of Section 3.275 of the
Eugene Code, 1971, the following minimum refuse collection rates
are hereby approved and established:

I NON-MECHANIZED 32-GALLON CAN BASE RATE - MONTHLY
A. Not Within a Mobile Home Park Condominium or A artment

1. Single, 32-gallon can, once a week ....$ 5.54
2. Each addition 32-gallon can, once
a week, 60% of single can rate ........ 3.30
3. For removal down or upstairs, through
a narrow corridor, or from an attic,
basement, or other place posing extra-
ordinary difficulties, a surcharge of
not more than 50~ of the applicable
charge in 1 or 2 above.
B. Inside a Mobile Home Park Condominium or A artment
Complex:

1. Single, 32-gallon can, once a week
in a back yard, 75~ of the single-
can monthly rate outside a mobile
home park, condominium or apartment
complex ...............................$ 4.13
2. The rate in B.1 above shall apply
when the mobile home park, condo-
minimum or apartment complex manage-
ment is billed for refuse removal
within the mobile home park, condo-
minimum or apartment complex; however,
the rates for refuse removal outside
a mobile home park, condominium or
apartment complex shall apply when
the residents thereof are billed
individually.
C. Conditions and Surchar es:
1. The above base rates do not include the Lane
County tipping fee set forth in paragraph vII.
2. Cans shall not exceed 75 pounds in weight when
filled.
3. Cans shall have lids, solid bottoms, and
adequate hand halds, and service for them may
be refused if the lids, bottoms, or hand holds
are not adequate.
4. Extra charges of not less than $1.00 shall be
made far extra refuse, brush, debris, or other
material which may not exceed six feet in
length.
5. Service of any type more frequently than once
a week shall be chargeable at the monthly rate
multiplied by the number of times that service
is provided during the week.
II MECHANIZED CURBSIDE -~- TG 90 GALLON CONTAINERS BASE RATE-~
MONTHLY;
A. Cne -0- to 90 gallon mechanized container
once a week ...............................$ 7.65
B. Each additional container per week, 1000
of the base rate in II A above.
C. Containers larger than 90 gallons within this
category constitute a new service requiring a
ordinance - 3
notification to the City at least 60 days
prior to implementation of the service.

made f or extra rubbish, brush, debris, or
other material which may not exceed six feet
in length.
E. Service of any type more frequently than once
a week shall be chargeable at the monthly rate

F. Rates for this category refer to curbside
service only, The customer places the con-
tainer at the curbside for collection and the
customer retrieves the container after collec-
tion. Pack-out or conventional non-mechanized
rates of $11.30 per month for one -0- to 90
gallon container once a week will apply if
curbside requirements are not adhered to.
G. The above rates do not include the Lane County
tipping fees set forth in Paragraph vII.

D. other Fees:
A fee of $18.0 0 ,per ,ton, or $7.8 0 per yard shall be charged
for refuse nat specified in A and B above.
Section 2. A limited review of the rates provided for herein
and the City's provisions relating to refuse and recycling collec-
tion practices, and license fees shall be undertaken prior to May
1, 1988, for consideration by the Council at that time.
Section 3. Ordinance No. 18816 and any ordinances or resvlu-
bons in conflict herewith are hereby repealed.
Section 4. That matters concerning refuse collection within
the City affect the public health, safety and welfare and there-
fore, an emergency is hereby declared to exist and this Ordinance
shall become effective immediately upon its passage by the Council
and approval by the Mayor.
