AN ORDINANCE CONCERNING RATES AND CHARGES FOR SANITARY
SEWER SERVICE AND STORM SEWER SERVICES; AMENDING SECTIONS
7.010 AND 7.020 OF THE EUGENE CODE, 1971; AND DECLARING AN
EMERGENCY,
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. The definitions for "Industrial waste or trade waste,"
"Sewer user," "Suspended solids," and "Transient rooms, motels, hotels and
student quarters" set forth in Section 7.020 of the Eugene Code, 1911, are
amended, and new definitions for "General customer," "Storm sewer user," and
"Water user" are added in alphabetical order therein, to read and ravide:

General customer.
For regional portion of sanitary sewer
user cnarge~:
~a} Low stren tc~h. Users with combined BOD and SS load-
ings equal to or less than 400 milligrams per liter ~mg/1}.
These low strength loadings are typical of domestic sanitary
waste loadings.
fib} Medium stren th. Users with combined BOD and SS
strengths greater than 400 mg/1 but not greater than 800 mg/l.
These medium strength loadings are typical of: grocery
stores, hotels and motels, commercial laundries and theaters.
~ c} Hi h stren th . Users wi th a combined BOD and 55
wastewater strength of greater than 800 mg/1. These high
strength loadings are typical of: restaurants and bakeries.
Industrial strength. Any user with a combined BOD and SS
strength greater than 800 mg/1 and who is en a ed in manufacturin

and processing act~v~ties. Such users may be required to pay a
surcharge for waste loadings in excess of 200 mg/1 for both BOD and
SS.
Sanitar sewer user. A facility which discharges directly or
indirectly to the city sanitary sewerage system, or has a sanitar

sewer available as provided in section x.070 of this code.
Storm sewer user. Any water user within the city.

Transient rooms, motels, hotels, and student uarters. A
building ar portion thereof containing four or more sleeping rooms
customarily occupied as a mare or less temporary sleeping place for
persons for which compensation is paid. "Student quarters" include
but are not limited to quad or quint dwellings as defined in sec-
tion 9.015 of this code whether or not the unit is occupied by
students.
Water user. Except for public water districts that purchase
water at bulk rates, any property or facility inside or outside
the city using water directly or indirectly provided by the Eugene
Water & Electric Board or by another water utility or district.
Section 2. Section 7.020 of the Eugene Code, 1911, is amended to read
and provide;

~1~ There is hereby levied and imposed an all water users just
and equitable monthly rates and charges for sanitary sewer service and storm
sewer service as provided in this chapter.

General Customer:

~c} When the sanitary sewer rate specified in this section
is based on volume, the volume shall be calculated:
1. By actual measurement of the sewage discharged the
cyst of measurement shall be borne by the sewer user}, or
z. By an estimate based on:
a. The sanitary sewer users average monthly water
consumption during the previous December through April
period; or
b. If no water consumption figures are available
for at least three full months during the period stated
in ~c}z.a. above:
i. For residential sanitary sewer users the
average monthly water consumption shall be based on
the water consumption of other similar sanitary sewer
users, and,
ii. For all other sanitary sewer users the
actual monthly water consumption shall be used until
the rate can be calculated under ~a} above.
~z} The monthly charge for storm sewer service:
. ~a} ,To single family dwelling units and for each dwelling
unit within a duplex within the city shall be $z.65;
fib} For all other storm sewer users the charge shall be based
on the size of the water meter as follows:

,~c} Far water users at the time of the adoption of this sub-
sect~on, the size of the water meter in use an July 1, 1987, shall

be used in determining the storm sewer service charge unless the
charge is adjusted under section 1.023 or increased because of the
installation of a larger water meter.
~3~ Each customer shall be notified, at least annually in conjunc-
tion with a regular bill, of the rate and allocation of revenue approved by
the budget process for the sewer user charges.
Section 3, That the matters contained herein concern the public health,
welfare and safety and therefore, an emergency is hereby declared to exist,
and this Ordinance shall become effective immediately upon its passage by the
City Council and approval by the Mayor.
