HomeMy WebLinkAboutOrdinance No. 19488ORDINANCE N0. 19488 AN ORDINANCE CONCERNING LOCAL IMPROVEMENTS AND CONSTRUC- TION AND USE IN PUBLIC WAYS; AMENDING SECTIONS 7.160, 1.165, AND 1.295 OF THE EUGENE CODE, 1971; AND DECLARING AN EMERGENCY. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section ~. Subsection ~6} of Section 1.160 of the Eugene Code, 1911 is amended to read and provide: 7.160 Local Im rovements - Initiation. ~6} The city engineer, except when proceeding under subsection 7.160~~~}~~8}r, following initiation of consideration shall furnish the council a report containing the following information and whatever additional information the council requires: ~a} A map showing the general nature, location, and extent of the proposed local improvement and the contemplated district within which land would be assessed for the cost of the ro osed p p improvement. fib} A list of all parce]s of land in the district and of their owners. ~d} An estimate of the total cost of the proposed im rove- p ment with a breakdown showing the estimated amount and its ercent- p age of the total estimate to be borne by any petitioner prior to assessment, by local improvement assessments against specially benefitted property, by the city and by any others. Section 2. Subsection ~1}~c} of Section 7.165 of the Eu ene Code 1971 g is amended to read and provide: Ordinance - 1 7.165 Local Im rovements - Public Natice and Call for Bids. ~1~ In a newspaper of general circulation in the city the city engineer shall give public notice of the proposed local improvement at least ten days before the public hearing vn the award of the contract far construc- tion of the improvement. The notice sha11 state: ~c~ The adoption date and number of the resolution directing preparation of plans and specifications for the improvement, or the date and description of the city engineer's finding required by subsection 7.160{f6}}~. Section 3. Subsection ~4~ of Section 1.295 of the Eugene Code, I971, is amended to read and provide: 1.295 Public wa Construction and Use - Permit A lication. ~4} If the city engineer denies a permit, or revokes a ermit be- cause of a failure to com 1 with the rovisions of this cha ter ar because another ublic ur ose is to be accom lished which is inconsistent with the ermittees use of the ublic wa the applicant or ~erm~ttee shall have the right of appeal to the city manager as provided in section 3.060 of this code. Section 4. The provisions of this amendment to Section 1.295 of the Eugene Code, 197 shall apply to all existing revocable permits previously issued by the City Engineer. Section 5. That the matters contained herein concern the public welfare and safety and therefore, an emergency is hereby declared to exist, and this Ordinance shall became effective immediately upon its passage by the City Ordinance - 2 Council and approval by the Mayor.
