The council is asked to adopt the attached resolution initiating the withdrawal of recently annexed areas from special districts by setting the date for a public hearing. The hearing is currently scheduled for the council’s February 27, 2006, meeting. BACKGROUND Withdrawals routinely come before the council once each year. Properties annexed during previous months are batched together to facilitate this process. This batch consists of 2005 and some 2006 annexations for which withdrawal from one or more special districts is necessary. Financial and/or Resource Considerations Failure by the City to withdraw properties from special districts before the County Tax Assessor creates the new tax rolls for the coming year results in the property remaining on the tax roll of the special district that no longer provides service. Timing If the withdrawal ordinance is not effective by March 31, 2006, these properties will remain on the tax roll of the special service districts during the coming fiscal year. Since this is a routine action, staff will request that the council take action following the public hearing on February 27, 2006. Stakeholder Perspective All annexations were initiated at property owner request, usually to facilitate development. The change to City tax rolls was expected by the applicants. Maps showing the location of each annexed property subject to withdrawal from a special district will be included in the council packet for the public hearing. The attached resolution includes some properties for which the annexation effective dates are expected to occur prior to February 27, 2006, but are currently not effective. Should unforeseen circumstances prevent any of the pending annexations from L:\CMO\2006 Council Agendas\M060123\S0601232C.doc becoming effective by the date of council action, staff will request that they be removed from the ordinance at the time of the public hearing. RELATED CITY POLICIES None. Properties are withdrawn from special districts upon annexation to the City because the City takes over responsibility for providing urban services. Withdrawal of properties from rural fire protection districts occurs automatically upon annexation, while a separate process is required by State law for withdrawals from many other special districts. COUNCIL OPTIONS There are few options and action is time-sensitive. If the ordinance approving withdrawals from special districts is not effective by March 31, 2006, the properties will remain on tax rolls for special districts for the coming fiscal year. CITY MANAGER’S RECOMMENDATION The City Manager recommends adoption of the resolution calling for a public hearing to occur on February 27, 2006. SUGGESTED MOTION Move to adopt Resolution 4857 calling a public hearing to consider proposed withdrawal of territories from the River Road Water District and River Road Park and Recreation District and from the Santa Clara Water District. The Lane County Local Government Boundary Commission by its Notice dated January 9, 2006, advised that pursuant to ORS 199.466 and ORS 199.519, the following described real property was annexed to the City of Eugene, effective May 9, 2005: Tax Lot 300, Assessor's Map 17-04-23-20 and a portion of Rosy Turn right-of-way, located in the River Road region of north Eugene, south of Beltline Road, west of River Road, west of Lake Drive, north of Rosy Turn, and more particularly described on Exhibit 1 attached hereto and incorporated herein by reference. The Lane County Local Government Boundary Commission is expected to act on, and issue, a Notice advising that pursuant to ORS 199.466 and ORS 199.519, the following described real property will be annexed to the City of Eugene, with an effective date prior to February 27, 2006: Tax Lots 4800, 4900 and 5000, Assessor's Map 17-04-23-44, located in the River Road region of north Eugene, east of Northwest Expressway, south end of Filbert Avenue, east side of Filbert Avenue, to be more particularly described on Exhibit 12 which will be attached to the Ordinance approving the withdrawal. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. U. The Lane County Local Government Boundary Commission by its Final Order No. 1256, approved June 2, 2005, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective July 18, 2005: Tax Lot 3700, Assessor's Map 17-04-03-33, located in the Santa Clara region of north Eugene, north of Beltline Road, west of River Road, south of Irvington Drive, west of the Northwest Expressway, and more particularly described on Exhibit 21 attached hereto and incorporated herein by reference. (G&R Building Concepts; C EU 05-17) That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. V. The Lane County Local Government Boundary Commission by its Final Order No. 1262, approved August 4, 2005, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective September 19, 2005: Tax Lot 3500, Assessor's Map 17-04-01-33, located in the Santa Clara region of north Eugene, north of Beltline Road, east of River Road, north of Wilkes Drive, west of Banner Street, east of River Crest Drive, and more particularly described on Exhibit 22 attached hereto and incorporated herein by reference. (Greene; C EU 05-29) That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. W. The Lane County Local Government Boundary Commission by its Final Order No. 1265, approved August 4, 2005, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective September 19, 2005: Resolution - 8 Tax Lot 2200, Assessor's Map 17-04-11-13, and right-of-way of Quiet Lane, located in the Santa Clara region of north Eugene, north of Beltline Road, west of River Road, north of Federal Lane, west of Ava Street, east of Quiet Lane, and more particularly described on Exhibit 23 attached hereto and incorporated herein by reference. (Hammer/Quiet Lane; C EU 05-34) That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. X. The Lane County Local Government Boundary Commission by its Final Order No. 1264, approved August 4, 2005, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective September 19, 2005: Tax Lot 3000, Assessor's Map 17-04-10-42, located in the Santa Clara region of north Eugene, north of Beltline Road, west of River Road, north of Irving Road, east of the Northwest Expressway, west of Arrowhead Street, and more particularly described on Exhibit 24 attached hereto and incorporated herein by reference. (Geiger; C EU 05-33) That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. Y. The Lane County Local Government Boundary Commission by its Final Order No. 1263, approved August 4, 2005, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective September 19, 2005: Tax Lots 1000 and 1100, Assessor's Map 17-04-11-23, located in the Santa Clara region of north Eugene, north of Beltline Road, west of River Road, north of Irving Road, west of Stark Street, east of Hyacinth Street, including Bobolink Avenue, Webster Street and a portion of Maesner Street, and more particularly described on Exhibit 25 attached hereto (which excludes all road rights-of-way) and incorporated herein by reference. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. Resolution - 9 Z. The Lane County Local Government Boundary Commission by its Final Order No. 1269, approved October 6, 2005, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective November 21, 2005: Tax Lot 7100, Assessor's Map 17-04-11-42, located in the Santa Clara region of north Eugene, north of Beltline Road, west of River Road, south of Irving Road, west of Belmont Street, east of Newcastle Street, and more particularly described on Exhibit 26 attached hereto and incorporated herein by reference. (Besaw; C EU 49) That property is contained in and is a part of the Santa Clara Water District. The City desires that the property so annexed be withdrawn from that District and that the City assume proportionate liability for the part of the District so withdrawn. AA. The Lane County Local Government Boundary Commission by its Final Order No. 1268, approved October 6, 2005, advised that pursuant to ORS 199.490(1)(c), the following described real property was annexed to the City of Eugene, effective November 21, 2005: Tax Lot 2101, Assessor's Map 17-04-12-40, located in the Santa Clara region of north Eugene, north of Beltline Road, west of Moore Street, east of Ross Lane, south of Lone Oak Avenue, and more particularly described on Exhibit 27 attached hereto and incorporated herein by reference. The Lane County Local Government Boundary Commission advised that, pursuant to ORS 199.445 and ORS 199.490(1)(c) and (7), the annexation of the following described real property to the City of Eugene, will be approved and effective on January 30, 2006: Tax Lot 5500, Assessor's Map 17-04-11-13, located in the Santa Clara region of north Eugene, north of Beltline Road, west of River Road and Ava Street, north of Federal Place (the portion of W. The Lane County Local Government Boundary Commission advised that, pursuant to ORS 199.445 and ORS 199.490(1)(c) and (7), the annexation of the following described real property to the City of Eugene, will be approved and effective on January 26, 2006: Tax Lot 200, Assessor's Map 17-04-02-42, located in the Santa Clara region of north Eugene, north of Beltline Road, east of River Road, north of River Loop 2, west of Scenic Drive, east of Shannon Street, and more particularly described on Exhibit 29 attached hereto and incorporated herein by reference.
