AN ORDINANCE REGARDING THE SETTING OF MUNICIPAL FEES;
AMENDING SECTION 2.020 OF THE EUGENE CODE, 1971; AND
DECLARING AN EMERGENCY.
THE CITY OF EUGENE DOES ORDAIN AS FOLLOI~S:
Section 1. Section 2.020 of the Eugene Code, 1971, is amended to read
and provide:

~1} Except as this code provides to the contrary, the cet mana er
shall determine and set all y g
fees imposed by the city for services, goads, use
of municipal property, licenses and permits. As used herein, "cit mana er"
means the cit mana er yr h' y g

~2} In determining the amount of any such fee the city mana er
shall consider: g
~a} Applicable policies, enactments and directives of the
counc~ l ;
fib} The amount charged by the city in the past;
~c} The full costs of providing the service supported b
the fee• y
~d} The amounts charged by other comparable providers;
and,
fie} The revenue needs of the city as determined by the
adopted city budget.
~3} At least 30 days prior to the initiation of anew fee or
change in the amount of such a fee, the city manager shall eve notice of

~a} Making copies of a notice of intended charges available
to the mayor and city council.

to any persons who have requested such notice;

~d} Posting such notice at two locations at city ha11.
~4} The notice shall state the current and proposed fee, and the
time, place and manner in which interested persons may present written com-
ments an the proposed fee. Defective notice shall not be grounds for invali-
dating any fee ar charge.
~5} After considering any written comments, the city mana er shall
set the fee b administrate g
y ve order. All such administrative orders shall be
compiled and retained at the city recorder's office. Copies of an adminis-

g or changing a general fee which ~s or ~s likely to be
$250.00 ar greater shall be provided to the mayor and cit council.

Section 2. The City Manager shall:
~a} Report to the Council on a periodic basis and during the

annual budget process, on the degree to which fees pay fvr the cast
of providing municipal services, particularly those fees relating to
the development of real property in general and the use of commercial
and industrial lands;
fib} Recommend to the Cauncil general policies on user fees
~e.g, low-income subsidies, fee differentials by geographic area ;

~c} Recommend to the Cauncil appropriate Cade changes to imple-
ment the process set out above; and
~d} Inform the Council of changes in market conditions, govern
ment regulations, ar other factors affecting municipal fees.
Section 3. Any resolution establishing fees or a process far settin

fees inconsistent with the provisions of this Ordinance is re Baled.

effect until changed under the procedures set forth in this Ordinance.
Section 5. The City Recorder, at the request of or with the concurrence
of the City Attorney, is authorized to administratively correct an references

contained elsewhere within the Eugene Code, 197I to the provisions amended
or repealed herein,
Section 5. That the matters contained herein concern the public welfare
and safety and therefore, an emergency is hereby declared to exist, and this
Ordinance shall become effective immediately upon its passage by the Cit
y
Council and approval by the Mayor.
