HomeMy WebLinkAboutOrdinance No. 19507ORDINANCE N4 , i 95 0 7 AN ORDINANCE REGARDING ENFORCEMENT CF SOLAR ACCESS REGULATIONS; AMENDING ORDINANCES NOS, 19400, 19401, AND 19402; REPEALING ORDINANCE NO. 19490; AND DECLARING AN EMERGENCY. The City Council of the City of Eugene finds that: on two previous occasions the Council has amended the effec- tive date in Ordinance Nos, 19400, 19401, and 19402 with res ect P to enforcement of the solar access regulations provided far there- in. Ordinance No. 19490, passed by the Council and ap raved b P Y the Mayor on July 8, 1987 amended the effective date provisions in ordinance Nos. 19400, 19401, and 19402 to provide that the Cit Y Building Official need not consider or apply the solar setback requirements of those ordinances when issuing buildin ermits g p until October 1, 1987. The Council has determined that further review and evaluation of these solar setback requirements is necessary and desirable and it would be in the public interest to defer their enforcement until that review is completed, Now, therefore, THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. ordinance No. 19494 passed by the Council and approved by the Mayor on July 8, 1987 is repealed. Section 2. Section 25 of Ordinance No, 19400, passed b the Y Council and approved by the Mayor on August 13, 198 is amended to read and provide: Section,,,_25, Effective Date. This Ordinance shall be effective vn January 1, 1987, however, when issuin g building permits the city building official need not ordinance - 1 consider or apply the solar setback requirements of this ordinance ar any amendments thereto until a review and evaluation of those requirements has been completed, the Council has held a public hearing thereon, and has determined at the conclusion thereof, by motion or other action, to amend the provisions, repeal the provisions, or direct enforcement of the provisions as contained herein. Section 3. Section 2 of ordinance No. 19401, passed by the Council and approved by the Mayor on August 13, 1986 is amended to read and provide: Section 2. This ordinance shall become effective on January 1, 1987, however, when issuing building permits the city building official need not consider or apply the solar setback requirements of this ordinance or any amendments thereto until a review and evaluation of those requirements has been completed, the Council has held a public hearing thereon, and has determined at the conclusion thereof, by motion or other action, to amend the provisions, repeal the provisions, or direct enforcement of the p rovisians as contained herein. Except as herein amended, all other provisions of ordi- nance No. 19329 remain in full force and effect, to which the City Recorder is requested to append this ordinance. Section 4. Section 2 of ordinance Nv. 19402 passed by the Council and approved by the Mayor on August 13, 1956 is amended to read and provide; Section 2. This ordinance shall became effective ordinance - 2 on January 1, 1987, however, when issuing building permits the city building official need not consider or apply the solar setback requirements of this Ordinance or any amendments thereto until a review and evaluation of these requirements has been completed, the Council has held a public hearing thereon, and has determined at the conclusion thereof, by motion or other action to amend the provisions, repeal the provisions, or direct enforcement of the provisions as contained herein. Except as herein amended, all other provisions of Ordi-~ nance No. 18081 remain in full force and effect, to which the City Recorder is requested to a end this pP Ordinance. Sect,,,ion".5.
