THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1, The designation of the "Hult Center Performing Arts Cammis- sion" set forth in Subsection ~1} of Section 2.013 of the Eugene Cade, 1911 s is amended, and shall be rearranged in alphabetical order therein to ravide: p 2.013 Cit Council - Boards, Commissions and Committees. 41} Eu ene Cultural Affairs Commission No. of Members: g Appointment Process: Mayor nominates, Council ap oints Term: p 4 years Authority: EC 2.630, EC 2.634 Section 2. Sections 2.630, 2.632, 2.634, and 2.636 of the Eu ene Code g 1971, are amended to provide: 2.630 Eu ene Cultural Affairs Commission - Created. .~1} As used in sections 2.630 to 2.636 of this code, the fallaw- ~ng words and phrases mean: ~a} Center. The Hult Center for the Performing Arts. fib} Commission. The Eugene Cultural Affairs Commission. ~c} Director. The person, or persons, designated as the directors} of the center and/or the cultural services division of the department of parks, recreation and cultural services. ~d} Division. The cultural services division of the cit 's y department of parks, recreation and cultural services. ,~2} The Eugene Cultural Affairs Commission is established to serve as an adv~sary body to the council an policy matters and to the cit mans er and directors an o er t' y g ~ } p a ~ona1 matters relating to the city's cultural affairs programs and the Hult Center for the Performing Arts. 2.632 Eu ene Cultural Affairs Commission -Duties. ~1} The commission shall consider, and when appropriate, submit b resolution its recommendations a ~ y . n policy to the council and on operational matters to the city manager and d~rector~s}. Recommendations of the commis- sion may include its consideration of such matters as: ~a} Whether the center and division are meeting the needs of the community to the degree possible, and the commission shall monitor community opinion in arriving at its evaluations; fib} Long-range plans for the operational use of the center Ordinance - 1 and facilities and programs under the supervision or control of the division; ~c} Processes concerning types of tenant leases, subscription programs, audience development programs, and other similar long- term projects as may come before the commission; ~d} Coordination of activates with other agencies within and outside the jurisdiction of the city in a manner that will minimize conflicts and duplication; fie} Coordination with other groups and organizations in the raising and receipt of private donations and funding for the development and operation of the center and other facilities and programs. ~2} The commission shall consider and submit by resolution, recom- mendat~ons on,pol~cy to the council and on operational matters to the cat y manager and directors} as follows: ~a} An annual recommendation to the budget committee of the city. The recommendation shall be specific and detailed. The comma ssi on shall state i n its recommendata on the budgetary effects of comma ssi on policies and shat l give special attention to an Y operating surplus or deficiency experienced in the immediately preceding fiscal year and anticipated in the upcoming fiscal year. . fib} As necessary, make recommendations to insure that artistic freedom ~s preserved in the selection and giving of performances. ~c} Make any recommendations necessary to provide a diverse and wide range of type of performances that will appeal to the interests of a representative cross-section of the community. ~d} Recommend initial and review from time to time, rules, reguiat~ons and operating policies concerning operation of the center and division. fie} Make an annual report to the council of the activities and f~nanc~al condition of the center and division, which informa- taan shall be made available to other commissions and officials of the city as is necessary or desirable. 2.34 Eu ene Cultural Affairs Commission - Membersha ,Term of Office. ~1} The commission shall consist of nine members nominated b the y mayor and appointed by the council. The city manager sha11 serve as an ex officio member of the commission. ~2} The term of office for each member, exclusive of the ex officio member, sha11 be for four years. ~3} A,vacancy an the commission shall be filled in the same manner as original appointments for the unexpired term of the predecessor member. A vacancy shall occur upon: ~a} The death or resignation of a member; fib} A member ceasing to be qualified for original appoint- ment; ~c} Termination of a member's term pursuant to section Z.636~3}; or ~d} Removal of the member by an affirmative vote of the counci 1. Ordinance - 2 2.636 Eu ene Cultural Affairs Commission - Officers, Meetin s Rules and Procedure. . .~1} The officers of the commission shall be a president and a vice-president elected by the members of the commission, Initial officers shall serve for terms of three years or until a successor is appointed or elected for the office. Subsequent officers shall serve for terms of two years, or until a successor is appointed yr elected for the office. The president shall preside aver meetings of the commission and shall have the right to vote, The vice-president shall perform the duties of the president ~n the absence or disability of the president. ~~} The commission shall hold regular meetings at least once a month, and at such other times as may be necessary to properly perform its duties. . ~3} The term of a commission member who fails to attend two consecutive regular meetings shall automatically be terminated unless his or her absence has been excused by the president or by vote of the commission. ~4} The commission shall adopt a plan of internal organization and rules of procedure necessary for the conduct of its business, consistent with state law, the charter, code, ordinances and resolutions of the cit which shall be submitte ~ ~y' d to the council and become effective upon council approval thereof., Meetings and other activities of the commission, its officers and committees, shall conform to the rules, state statutes, charter prov~s~ons, code, ordinances and resolutions of the city. Section 3. The City Recorder, at the request of or with the concurrence of the City Attorney, is authorized to administratively correct an reference y errors contained herein or in other sections of the Eugene Cade, 197 to pro- visions amended or referred to herein. Section 4.
