HomeMy WebLinkAboutOrdinance No. 19528ORDINANCE N0. 19528 AN ORDINANCE CONCERNING NOTICE REQUIREMENTS FOR CERTAIN LAND USE APPLICATIONS; AMENDING SECTIONS 8.820, 9.035, 9.154, 9.512, 9.672, AND 9.106 OF THE EUGENE CODE, 1911; AND DECLARING AN EMERGENCY. THE CITY DF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. Subsection ~3} of Section 8.820 of the Eugene Code, 1911, is amended to pravide; 8.820 A lication, Fee, and Public Hearin Notice. ~3} At least ten days before the hearing, the planning department shall mail a notice thereof and information on the nature of the re nest to the a licant owner q pp s and occupants of the affected property, and owners and occupants of property located within 30o feet of the perimeter of the subject property. If the requested sign district change is from residential to an other d~str~ct the notice re y qu~red hereunder shall be expanded to include owners and occupants of property located within 500 feet of the perimeter of the subject property. At least ten days prior to the hearin , the lannin de artment shall g p g . p also past notices of the nature of the request and the hear- ing ~n at least three locations within 300 feet of the perimeter of the sub- ject property. Section 2. Subsection 43} of Section 9.035 of the Eugene Code, 1971 is amended to pravide: 9.035 Major Partition and Subdivision Tentative Plan Procedure. ~3~ Tentative Plan - Notice to Other Pro erties. Within ten da s of rece~ t of a cam lete and acc y p p urate application and at least ten days be- fore the planning director makes a decision, the planning de artment shall p magi notice of the request to owners and occupants of praperty located within 300 feet of the perimeter of the subject property. Section 3. Subsection 43} of Section 9.154 of the Eugene Code, 1971, is amended to pravide: 9.154 A lication, Fee, and Public Hearin Notice. ~3} At least ten days before the hearing, the planning department shall ma~1 a notice thereof to the applicant, all owners and occupants of property included in the application, and owners and occupants of properties Ordinance - 1 located within 300 feet of the perimeter of the subject ro ert . Section 4. Subsection ~5} of Section 9.512 of the Eugene Code 1971 is amended to provide: 9.512 Tentative Plan Consideration. ~5} Notice of hearin . At least ten days before a tentative lan public hearin the lannin de ~ p 9! p g partment shall give notice of the proposal and the time, date, and place of the hearing by; ~a} Mailing written notice to owners and occupants of ro - ert located w~th~n 300 p p y feet of the perimeter of the subject prop- erty; and . ~~b} Posting notice of the hearing in at least three locations within 300 feet of the perimeter of the subject property. Section 5. Section 7. The City Recorder, at the request of or with the concurrence of the City Attorney, is authorized to administratively correct an reference Y errors contained herein or in other sections of the Eugene Cade, 1971, to the provisions amended herein. Section S. That the matters contained herein concern the ublic welfare p , and in order to insure the orderly implementation of the rovisions contained p herein, an emergency is hereby declared to exist, and this Ordinance shall become effective immediately upon its passage by the Cit Council and Y approval by the Mayor.
