HomeMy WebLinkAboutOrdinance No. 19531ORDINANCE NO. ~ S 31 AN ORDINANCE LEVYING ASSESSMENTS FOR PAVING OF ROYAL AVENUE FROM 600 FEET WEST OF CANDLELIGHT DRIVE TO TERRY STREET; AMENDING THE ASSESSMENT ROLL ATTACHED TO ORDINANCE N0. 19521; AND DECLARING AN EMERGENCY. The City Council of the City of Eugene finds that: 0n November 16, 1987, ordinance No. 19521 was passed by the Council and approved by the Mayor, levying assessments against the properties listed on the Assessment Roll attached thereto for paving Royal Avenue from~~600 feet West of Candlelight Drive to Terry Street. Included in the Assessment Roll attached to Ordinance No. 19521 was an assessment in the amount of $8,013.92 designated as account number 8b0007-0120. Notice thereof was provided the presumed owners of record, Stanley L. Davis and Nancy M. Davis Thompson. Subsequent to the adoption of Ordinance No. 19521, the finance officer has been advised that the subject property was divided into two separate tax lots, neither of which are in the ownership of Stanley L. Davis and Nancy M. Davis Thompson. The assessment heretofore levied as evidenced by account number 86aao7-0120 should be allocated between these two new tax lots, and the Assessment Roll attached to Ordinance No. 19521 amended by deleting account number 8&0007-0120 therefrom and substituting two new accounts therefor. Notice of the assessments and an opportunity to be heard thereon has been provided the owners of the newly created tax Ordinance - 1 lots as required by Sections 7.185 and 7.187 of the Eugene Code, 1971. The allocation of the assessment between these two tax lots will not affect the amounts levied against other properties included on the Assessment Roll attached to Ordinance No. 19521. Now, therefore, THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS; Section 1. Based upon the above findings, which are hereby adopted, and the recommendation of the hearings official, the Assessment Roll attached to Ordinance No. 19521, passed by the Council and approved by the Mayor on November 16, 1987, is amended by deleting therefrom the assessment in the amount of $8,013.92 as represented by account number 860007-0120, Stanley L. Davis and Nancy M. Davis Thompson, and substituting therefor: Account Na. Name Amount 860107-0010 Judith L. and Gerald P. Braun $3,566.38 860107-0020 Shawn M. and Barry D. Bokn $4,447.54 Section 2. The finance officer is directed to make the above corrections to the Assessment Roll attached to Ordinance No. 19521 and to the docket of city liens, and to send a notice of the assessment to the property owners set forth in Section 1 above. Section 3. Except as herein specifically amended, all other provisions of Ordinance No. 19521 and the assessments provided for therein remain in full force and effect, Section 4. That the matters contained herein concern the public welfare and safety, and it is necessary that the above corrections be made as soon as passible, and therefore, an emergency is hereby declared to exist, and this Ordinance shall Ordinance - 2 become effective immediately upon its passage by the City Council and approval by the Mayor.
