ORDINANCE N0.
AN ORDINANCE LEVYING ASSESSMENTS FOR
paving, sanitary and storm sewers to serve Cameo Estates and area between
Gilliam Road to 300 feet East of Sarah Lane, from 2,000 feet Nar~h to 1,300 feet
North of Crescent Avenue in the City of Eugene, Lane County, Oregon.
The City Council of the City of Eugene finds that:
After considering the report, the City Council did by Resolution Na. 3991,
adopted on the 16th day of July, 1986, order the local improvement consisting
of construction of paving, sanitary and storm sewers i n the vicinity of Cameo
Estates and area between Gilliam Road to 300 feet East of Sarah Lane, from 2000
feet North to 1,300 feet North of Crescent Avenue, be made and directed the
City Engineer to prepare plans and specifications for the local improvement and
to call far bids on the construction contract.
After due notice and a public hearing thereon before the hearing official,
and no remonstrances having been f i 1 ed, the City Counci 1 authori xed the
execution of a contract far the construction of the local improvement on the
Ilth day of May, 1987.
The actual cast thereof is ascertained, and the initial amount to be
assessed in accordance with applicable pravisians.of the Eugene Cade, 1911 has
been determined to be:

The City Council has established the method of calculating local improve-
ment assessments in Sections 7.110 and 7.175 of the Eugene Cade, 1971.
A notice containing the information required by Section 7.185 of the

Eugene Code, 1971 has been pasted an bulletin board at City Nall and given by
certified mail to the owners of the parcels of real property subject to the
assessment mare than ten days prior to the public hearing before the hearing
official. At the .time and place specified therein, a hearings official heard
all evidence and argument presented, has fully considered the same, and na
remonstrances having been filed, has reported hi s or her adopted findings to
the City Council. The Council has reviewed and considered the assessment
report of the City Engineer and Finance Officer and the hearings official's
findings and summary of the hearing, and based thereon,
THE CITY OF EI~GENE DOES ORDAIN AS FOLLOWS;
Section 1. The Summary of the hearing conducted by the hearings official
are hereby made apart of the Council's record in these proceedings, and the
hearings official's findings, including those regarding compliance with
Sections 7.160 to 1.180 of the Eugene Code, 1971, attached as Exhibit A hereto
and incorporated herein by reference are adopted.
Section 2. That the actual cost of paving, sanitary and storm sewers to
serve Cameo Estates and area between Gi l ham Road to 300 feet East of Sarah
Lane, from 2,000 feet North to 1,300 feet North of Crescent Avenue, a local
improvement in the City of Eugene is the sum of $134,809.52 which is by this
ordinance assessed against the parcels of property hereinafter described in the
amounts set opposite, respectively.
Section 3. That the City Council does hereby determine and assess each
lot and part of lot being within the described local improvement district as

herein by reference.

Section 4. That the City Council does hereby determine that each parcel
of land ar lot hereinabove described is specially benefitted to the extent of
the initial assessment set forth. The Finance Officer shall give notice of the
assessments to the owners of the assessed parcels advising them the assessment
may be paid in full, without interest, within ten days of the date of adoption
of this ordinance. Assessments that remain unpaid after the ten day period are
declared to be liens upon the respective lots, parts of lots or parcels of land
against which said several amounts are assessed, and may be paid in up to
twenty equal semi-annual installments, including principal and interest at the
rate set by the City Manager as provided in Section 2.022 thru 2.024 of the
Eugene Code. The City Recorder is directed to enter in the docket of City
Liens a statement in connection with each unpaid assessment containing the
fallowing:
4.1 A description~of each lot, part of lot or acreage liable for
such improvement;
4.2 The name of the owner or reputed owner thereof, that the name of
the owner is unknown; and
4.3 The sum assessed upon said property, the amount and date from
which interest accrues, and the date of entering the same in the docket of
City Liens.
Section 5. I1pon enactment of this ordinance, the City Finance
Officer shall send notice of the assessments by first class to the owners of
the assessed parcels containing the information required by Section 7'.190 of
the Eugene Code, 1911, and enclose therewith an application for paying the
assessment in installments according to the terms set forth in Section 4 of
this ordinance.

This project was initiated by a petition and consists of newly
platted subdivision of 24 lots.
Based on the 100 percent petition for paving and 4l percent for
sanitary sewers the City Council initiated the peoject as pro-
vided ~n Eugene Code 7.160(8), on July 16, 1987. Property owners
were notified of the pending award hearing 10 days prior to the
hearing. Minutes and findings by the Hearing Official will be
subma~tted by C~.ty Staff to the Clty Counc~.l on February 22, 1988,
for approval to levy the assessment, The low bid was submitted
by Wildish Corvallis Construction for an amount of $101,270.15.

The project includes 1,584 Lin, Ft, of 8" PVC sanitary sewer
pipe, six manholes, service lines, and 951 Lin. Ft. of 28 foot
paving.
Under City of Eugene assessment policy, most of the cost is
assessed to the abutting property owners. The costs listed below
are the actual calculated assessment cost to property owners.
8" sanitary lateral $ 0.126 sq, ft.
6" service line $ 457,00 each
28' paving $ 32.85 front foot
Costs listed below are the Engineer's estimate and preliminary
costs quoted to property owners at the initial hearing following

8" sanitary lateral $ 0.135 sq, ft.
6" service line $ 380.00 each
28' paving $ 36.33 front foot
Recommendation
Costs are comparable to project of similar size. Staff recom-
mends appropriation of the assessment distribution,

A hearing regarding this project was scheduled for February 9,
1988, at 7:00 P.M, at City Council Chambers. The Hearings
Official received a memorandum from Les Lyle, City Engineer,
which set forth the information provided above. No persons
appeared at the hearing.
The Hearings Official recommends that the City Council approve
the levying of the assessments as set forth above.
