An Ordinance vacating the following described street, to-
wit ;
That portion of the right-of-way of 12th Avenue
extending from the west margin of the right-~of-way of
Hilyard Street to the East margin of the right-of-way
of Patterson Street, between Blocks 2 and 5, Shaw's
Second Addition or Shaw and Patterson's Addition to
Eugene City know called Eugene, as platted and
recorded in Volume G, Page 364, Lane County, Oregon
Deed Records, in Lane County, Oregon. Sacred Heart,
SV 87--4 ~
RESERVING herein an easement 44 feet in width along the
northern margin of the above described property for its
entire length for use for emergency vehicles, far
pedestrian and bicycle access by the general public,
and far public utility purposes under the above
described property and the right to enter thereon for
purposes of construction, reconstruction and
maintenance. The easement reserved herein shall not
prevent building construction overhead above a
clearance of 15 feet.
On the 27th day of January, 1985, the City Council of the
City of Eugene passed Qrdinance No. 19535 settin a hearin to be

held at 7:30 p.m., Pacific Time on the 14th day of March, 1988
at the Council Chambers at City Hall, Eugene, Oregon, at which
time and place protests and remonstrances could be heard as to
the proposed vacation of the above described street.
Notice was duly and regularly given of the hearing and at
said time and place the hearing was postponed by the Council and
rescheduled far its meeting of April 11, 1958 pending a final
determination by the Planning Commission of an appeal from the
Hearings Official's decision granting a conditional use ermit

involving the above described property.
The Planning Commission has upheld the Hearings Official's
decision, and the Council has heard all objections to the
Ordinance - 1
proposed vacation.
All persons owning property abutting the street to be vaca-
ted have consented to the vacation and applied for the same.
THE CITY OF EUGENE DOES ORDAIN AS F4LI~OWS:
Section 1. The City Council of the City of Eu ene finds

that due and regular notice of the hearing was ublished and

posted as by law required and no valid objections have been made
at the hearing or filed. The consent of the owners of the
abutting property has been duly and regularl filed in the

proceedings and the public interest will not be re`udiced b the

vacation of the street.

1988 at 7:30 p.m., Pacific Time, at the Council Chambers Cit

Hall, Eugene, Lane County, Oregon, and all matters necessar to

Section 3. The hereinabove described street is hereb

vacated, and the street so vacated shall revert ursuant to the

statutes of the State of Oregon.
Section 4. The City Recorder is hereby directed to file a
certified copy of this Ordinance with the Recorder of L

County, Oregon, together with a map or plat of said rv ert and

a certified Copy of this Ordinance shall be filed with the La
ne
County Assessor and another certified copy shall be filed with
the Lane County Surveyor.
