AN ORDINANCE ~.EVYING ASSESSMENTS FOR
paving, storm sewers and sidewalks on Willakenzie Raad from 300 feet east of
Coburg Road to the east boundary of Willakenzie Schaol,~ and paving, curbs,
gutters and sidewalks on east side of Best ~.ane from 417 feet north of
Willakenzie Raad to 600 feet north of Willakenzie Road in the Gity of Eugene,
' lane county, Oregon.
The City Council of the City of Eugene finds that:
After considering the report, the Gity Council did by Resolution No. 4011,
adapted an the 27th day of October, 1986, order the local improvement consist-
ing of construction of paving, storm sewers and sidewalks in the vicinity of
Willakenzie Road from 300 feet east of Coburg Road to the east boundary of
Willakenzie School, and on east side of Best Lane from 477 feet north of
Willakenzie Road to 60o feet north of Willakenzie Road, be made and directed
the Gity Engineer to prepare plans and specifications for the local improvement
and to call for bids on the construction contract.
After due notice and a public hearing thereon before the hearing official,
and no remonstrances having been filed, the City Council authorized the
execution of a contract for the construction of the local improvement nn the
13th day of July, 1987.
The actual cost thereof is ascertained, and the initial amount to be
assessed in accordance with applicable provisions of the Eugene Code, 1911 has
been determined to be:

The City Counci 1 has established the method of calculating 1 oval improve-
ment assessments in Sections 1.174 and 7.175 of the Eugene Gade, 1911.
A notice containing the information required by Section 7,185 of the
Eugene- Code, 1911 has been posted on bulletin board at City Hall and given by
certified mail to the owners of the parcels of real property subject to the
assessment mare than ten days prior to the public hearing before the hearing
official. At the time and place specified therein, a hearings official heard
all evidence and argument presented, has fully considered the same,-and na
remonstrances having been filed, has reported his or her adopted findings to
the City Council. The Council has reviewed and considered the assessment
report of the City Engineer and Finance Officer and the hearings official's
findings and summary of the hearing, and based thereon,
THE CITY OF El1GENE DOES ORDAIN AS FOLEOWS:
Section 1. The Summary of the hearing conducted by the hearings official
are hereby made apart of the Council's record in these proceedings, and the
hearings official's findings, including thane regarding compliance with
Sections 7.164 to 7.190 of the Eugene Cade, 1971, attached as Exhibit A hereto
and i ncorparated herein by reference are adopted .
Section ~. That the actual cost of paving, storm sewers and sidewalks on
Willakenzie Road from 344 feet east of Coburg Raad to the east boundary of
Willakenize School, and paving, curbs, gutters and sidewalks an east side of
Best Sane from 477 feet north of .Willakenzie Raad to 644 feet north of
Willakenzie Road,' a local improvement in the City of Eugene is the sum of
$117,474.14 which is by this ordinance assessed against the parcels of property
hereinafter described in the amounts set apposite, respectively.

Section 3. That the City Council does hereby determine and assess each lot and
part of lat being within the described 1aca1 improvement district as set forth
on the assessment roll attached as Exhibit B hereto and incorporated herein by
reference.
Section 4. That the City Council does hereby determine that each parcel
of 1 and or 1 at herei nabove described i s specially benef i tted to the extent of
the initial assessment set forth. The Finance Officer shall give notice of the
assessments to the owners of the assessed parcels advising them the assessment
may be paid in full, without interest, within ten days of the date of adoption
of this ordinance. Assessments that remain unpaid after the ten day period are
declared to be liens upon the respective lots, parts of lots ar parcels of land
against which said several amounts are assessed, and may be paid in up to
twenty equal semi-annual installments, including principal and interest at the
rate set by the City Manager as provided in Section 2.022 thru 2.024 of the
Eugene Cade. The City Recorder is directed to enter in the docket of City
Liens a statement in connection with each unpaid assessment containing the
following:
4.1 A description of each lot, part of lot or acreage liable for
such improvement;
4.2 The name of the owner or reputed owner thereof, that the name of
the owner is unknown; and
4.3 The sum assessed upon said property, the amount and date from
which interest accrues, and the date of entering the same in the docket of
City Liens.
Section 5. Upon enactment of this ordinance, the City Finance
Officer shall send notice of the assessments by first class to the owners of

assessment in installments according to the terms set forth in Section 4 of

FINDINGS AND RECOMMENDATIONS
PAVING, STORM SEWERS AND SIDEWALKS ON WILLAKENZIE ROAD
FROM 300 FEET EAST OF COBURG ROAD TO THE EAST BOUNDARY
OF WILLAKENZE SCHOOL, AND PAVING CURBS, GUTTERS AND
SIDEWALKS ON EAST SIDE OF BEST LANE FROM 477 FEET NORTH
OF WILLAKENZIE ROAD TO 600 FEET NORTH OF WILLAKENZIE
ROAD (CONTRACT #$7-12)
BACKGROUND
Willakenzie Road from 200 feet east of Coburg Road to Kings West
Road is an old 20-foot wide county standard asphalt surface with
roadside ditches. It is a designated collector street carrying
3600 cars per day at the Coburg Road end, Four schools in the
area support student population which use Willakenzie Road as a
route to school. The schools are Willakenzie Elementary which is
located east of Best Lane on Willakenzie, James Monroe Junior
High on Bailey Lane east of Coburg Road, Saint Paul's on Satre
Street south of Bailey Lane, and Sheldon High on Willakenzie west
of Coburg Road. A number of parents and the neighborhood group
for the area have voiced concerns regarding school children and
bicycle safety. A staff hearing was held on September 4, 1986
and 18 property owners attended.
The asphalt mat was structurally inadequate to support the traf-
fic load and would continue to require more than routine main-
tenance. The project was included in the fiscal year 1987
Capital Improvement Project Program. City Council authorized the
City Engineer to prepare plans and specificiations by adoption of
Resolution #4x11 passed on actober ~7, 1987.
Property owners were notified of the pending award hearing 10
days prior to the hearing. The project was authorized on July
13, 1987. The low bid was submitted by Wildish Corvallis
Construction Co. for an amount of $137,765.40.
PROJECT
The project includes 46-foot wide paving, with curbs and gutters,
on street bicycle lanes, 7-foot wide sidewalks on both sides, and
street lights.
ASSESSMENT
Under City of Eugene assessment policy, mast of the cost is
assessed to the abutting property owners. The costs to be
assessed are shown below:
20 foot paving $ 21.50 per front foot
28 foot paving $ 28,58 per front foot
36 foot paving $ 33.36 per front foot
44 foot paving $ 44.61 per front foot
Sidewalks $ 10.93 per front foot

The costs listed below are the Engineer's estimates and prelimi-
nary costs quoted to property owners at the initial hear ing
following bid opening.
20 foot paving $ 25,73 per front foot
28 foot paving $ 28.~p per front foot
36 foot paving $ 37,90 per front foot
44 foot paving $ 42.84 per front foot
Sidewalks ~ 9.14 per front foot
RECOMiMENDATIQN
A hearing regarding these assessments was scheduled for 7:00 P.M.
on March 29, 1988 in the City Council Chambers. The staff had
previously received information from Mr, Harold Moody, an adja-
cent property owner. It appears that Mr. Moody feels that his
deed is in error because he does not own as much frontage as his
deed states. The deed calls for 72.7G feet of frontage.
Apparently Mr. Moody believes that should be closer to 70+ feet.
Mr. Moody did not appear at the hearing. However, the Hearings
Official did review the information provided by Mr. Moody and
discussed the matter with Les Lyle, City Engineer. Mr. Lyle
advised and it is the finding of the Hearings Official that prior
City practice has consistently been to rely on deed figures for
determining assessments. It is the finding of the Hearings
Official that it would be entirely too expensive in terms of staff
time to require actual surveys of each property to be assessed
and than that it is reasonable for the City to rely upon deed
measurements.
Therefore, it is the recommendation of the Hearings Official that
the City Council adopt an ordinance for assessment in accordance
with the project information contained in these findings.
