AN ORDINANCE LEVYING ASSESSMENTS FOR
paving, curb, sidewalks and street lighting an north side of 5th Avenue from
Willamette Street to Pearl Street in the City of Eugene, Lane County, Oregon.
The City Caunci 1 of the City of Eugene finds that:
After considering the report, the City Council did by Resolution Na. 3965,
adapted on the 24th day of February, 1986, order the local improvement consist-
ing of construction of paving, curb, sidewalks and street lighting be made and
directed the City Engineer to prepare plans and specifications far the local
.improvement and to call for bids an the construction contract.
After due notice and a public hearing thereon before the hearing official,
and na remonstrances having been filed, the City Council authorized the
execution of a contract for the construction of the local improvement on the
13th day of July, 1987.
The actual cast thereof is ascertained, and the initial amount to be
assessed in accordance with applicable provisions of the Eugene Cade, 1971 has
been determined to be:

The City Council has established the method of calculating local improve-
ment assessments in Sections 7.170 and 1.175 of the Eugene Cade, 1971.
A notice containing the information required by Section 1.185 of the
Eugene Code, 1911 has been posted on bulletin board at City 11x11 and given by
certified mail to the owners of the parcels of real property subject to the
assessment mare than ten days prior to the public hearing before the hearing
official. At the time and place specified therein, a hearings official heard
all evidence and argument presented, has fully considered the same, and na

remonstrances having been filed, has reported his or her adapted findings to
the City Council, The Council has reviewed and considered the assessment
report of the City Engineer and Finance Officer and the hearings official's
findings and summary of the hearing, and based thereon,
THE CITY OF EPICENE DOES ORDAIN AS FOLLOWS:
Section 1. The Summary of the hearing conducted. by the hearings official
are hereby made a part of the Council's record in these proceedings, and the
hearings official's findings, including those regarding compliance with
Sections 7.160 to 7.190 of the Eugene Cade, 1871, attached as Exhibit A hereto
and incorporated herein by reference are adapted.
Section 2. That the actua] cast of paving, curb, sidewallc~s and street
lighting, a local improvement in the City of Eugene is the sum of $155,89.31
which is by this ordinance assessed against the parcels of property hereinafter
described in the amounts set apposite, respectively.
Section 3. That the City Council does hereby determine and assess each
lot and part of lot being within the described local improvement district as
set forth an the assessment roll attached as Exhibit S hereto and incorporated
herein by reference.
Section 4. That the City Council does hereby determine that each parcel
of land or lot hereinabave described is specially benefitted to the extent of
the initial assessment set forth. The Finance Officer sha11 give notice of the
assessments to the owners of the assessed parcels advising them the assessment
- may be paid in full, without interest, within ten days of the date of adoption
of this ordinance. Assessments that remain unpaid after the ten day period are
declared to be liens upon the respective lots, parts of lots ar parcels of land
against which said several amounts are assessed, and may be paid in up to

twenty equal semi-annual installments, including principal and interest at the
rate set by the City Manager as provided in Section 2.022 thru 2.024 of the
Eugene Code. The City Recorder is directed to enter in the Jacket of City
~.iens a statement in connection with each unpaid assessment containing the
following:
4.1 A description of each tat, part of lot ar acreage liable for
such improvement;
4.2 The name of the owner or reputed owner thereof, that the name of
the owner is unknown; and
4.3 The sum assessed upon said property, the amount and date from
which interest accrues, and the date of entering the same in the Jacket of
City ~.iens.
Section 5. lfpon enactment of this ordinance, the City Finance
Officer shall send notice of the assessments by first c1 ass to the owners of
the assessed parcels containing the information required by Section 7.190 of
the Eugene Cade, 1971, and enclose therewith an application far paying the
assessment in installments according to the terms set forth in Section ~ of
this ordinance.

FINDINGS AND RECOMMENDATIONS
PAVING, CURB AND SIDEWALKS ON NORTH SIDE OF 5TH AVENUE FROM
WILLAMETTE STREET TO PEARL STREET (JOB #223$) (CONTRACT ~$7-13)
Background
This project was initiated by City Council Resolution No. 3965 on
February 24, 1986. The project was advertised on June l3, 1987,
and bads were opened on June 3U, 1987. The low bid was submitted
by Wildish Corvallis Construction Company for $109,879.8Q.
The project was awarded on July 13, 1987 and property owners were
notified lQ days prior to the hearing.
Pr~ect
The project includes paving, curb, sidewalks, street lights,
landscaping and brick bands on the north side of 5th Avenue from
Willamette Street to Pearl Street.
Assessment
Under City of Eugene assessment policy, most of the costs are
assessed to the abutting property owners. The final costs to be
assessed are shown below:
Paving $ 69.39/front foot
Sidewalks $ 26.20/front foot
Driveways $ 3.15/square foot
The costs listed below are the Engineer's estimate and prelimi-
nary costs quoted to property owners at the inititation hearing
following bid opening.
Paving $ 69.39/front foot
Sidewalks $ 26.23/front foot
Driveways $ 3.37/square foot
Recommendation
Costs are comparable to costs quoted at the initiation hearing.
Staff recommends approval of the assessment distribution.
A hearing regarding this project was scheduled for May la, 1988,
at 7:DO P.M, at the McNutt Roam. The Hearings Official received a
memorandum from Les Lyle, City Engineer, which set forth the
information provided above. No persons appeared at the hearing.
The Hearings Official recommends tha~~ the City Council approve
the levyang of the assessments as set forth above.
