AN ORDINANCE LEVYING ASSESSMENTS FDR paving, sanitary sewers, storm sewers, and bridge located in Sand Avenue from Country Club Road to Poal Street and in Sand Avenue and Trap Lane within the Country Club West Subdivision; also, sanitary sewers along the north boundary of Country Club West Subdivision from Poal Street to 548 feet east in the City of Eugene, Lane County, Oregon. The City Council of the City of Eugene finds that: On the 2th day of duly, 1981, as authorized in the Eugene Code 1.1608} the City Engineer initiated the proposed local improvement consisting of paving, sanitary sewers, storm sewers, and bridge construction on Sand Avenue from Country Club Road to Pool Street and in Sand Avenue and Trap Lane within the Country Club West Subdivision; also, along the north boundary of Country Club West Subdivision from Paol Street to 548 feet east. After due notice and a public hearing thereon before the hearing official, and no remonstrances having been filed, the City Council authorized the execution of a contract for the construction of the local improvement on the 3rd day of August, 1987. The actual cost thereof is ascertained, and the initial amount to be assessed in accordance with applicable provisions of the Eugene Code, 1971 has been determined to be: Items 1 to 24 from Page 1 of PW ordinance} The City Council has established the method of calculating local improve meat assessments in Sections 1.170 and 7.I75 of the Eugene Cade, 1971. A notice containing the information required by Section 7.185 of the ORDINANCE - 2 Eugene Cade, 1971 has been posted an a bulletin board at City Hail and given by certified mail to the owners of the parcels of real property subject to the assessment more than ten days prior to the public hearing before the hearing official. At the time and place specified therein, a hearings official heard all evidence and argument presented, has fully considered the same, and no remonstrances having been filed, has reported his or her adapted findings to the City Council. The Council has reviewed and considered the assessment report of the City Engineer and Finance Officer and the hearings official's findings and summary of the hearing, and based thereon, THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. The Summary of the hearing conducted by the hearings official are hereby made apart of the Council's record in these proceedings, and the hearings official's findings, including those regarding compliance with Sections 7.1GD to 1.190 of the Eugene Code, 1971, attached as Exhibit A hereto and incorporated herein by reference are adopted. Section 2. That the actual cast of paving, sanitary sewers, storm sewers and bridge construction in Sand Avenue from Country Club Road to Pool Street and in Sand Avenue and Trap Lane within the Country Club West Subdivision; also, sanitary sewers along the north boundary of Country Club West Subdivision from Pool Street to 5~8 feet east, a 1oca1 improvement in the City of Eugene is the sum of $308,54.08 which is by this ordinance assessed against the parcels of property hereinafter described in the amounts set opposite, respectively. Section 3. That the City Council does hereby determine and assess each lot and part of lot being within the described local improvement district as set forth on the assessment roil attached as Exhibit 8 hereto and incorporated herein by reference. That the City Council does hereby determine that each parcel of land ar lot hereinabave described is specially benefitted to the extent of the initial assessment set forth. The Finance Officer shall give notice of 'the assessments to the owners of the assessed parcels advising them the assessment may be paid in full, without interest, within ten days of the date of adoption of this ordinance. Assessments that remain unpaid after the ten day period .are declared to be liens upon the respective lots, parts of lots or parcels of 1'and against which said several amounts are assessed, and may be paid in up to twenty equal semi-annual installments, including principal and interest at the rate set by the City Manager as provided in Section 2.022 thru 2.024 of the Eugene Code. The City Recorder is directed to enter in the docket of City liens a statement in connection with each unpaid assessment containing the fallowing: 4.1 A description of each tat, part of lot ar acreage liable for such improvement; 4.2 The name of the owner ar reputed owner thereof, that the name'of the owner is unknown; and 4.3 The sum assessed upon said property, the amount and date from. which interest accrues, and the date of entering the same in the docket'of City Liens. Section 5. Upon enactment of this ordinance, the City Finance Officer shall send notice of the assessments by first class to the owners of the assessed parcels containing the information required by Section 7.190 of'. the Eugene Code, 1971, and enclose therewith an app1icatian for paying the assessment in installments according to the terms set forth in Section 4 of this ordinance. Passed by the City Council this ~~d of 198 ~ i y Record Approved by the Mayor this day, 198 ~' r ayar ORDIfVAfVCE - 5 EXHIBIT "A'~ FINDINGS AND RECOMMENDATIONS PAVING, SANITARY AND STORM SEWERS AND BRIDGE LOCATED IN SAND AVENUE FROM COUNTRY CLUB ROAD TO POOL STREET AND IN SAND AVENUE-AND TRAP LANE WITHIN THE COUNTRY CLUB WEST SUBDIVISION: .ALSO SANITARY SEWERS ALONG THE NORTH BOUNDARY OF COUNTRY CLUB WEST SUBDIVISION FROM POOL STREET TO 548 FEET EAST (JOB #2321) (CONTRACT #87-17) Background This project was initiated by a petition from Country Club West Assoca~ates requesting the necessary public improvements to serve the 29 lot Country Club West Subdivision. In addition two pro- perty owners along the north boundary of this subdivision sub- mitted a petition requesting that sanitary sewers be extended to the~.r properties. Based on the petition, the City Engineer initiated the project, as provided for in Eugene Code 7.160(8), on July 2, 1987. Property owners were notified of the pending award hearing and the project was advertised on July 10, 1987 and bids were opened July 22, 1987. The low bid was submitted by Eugene Sand and Gravel, Inc., for an amount of $196,090.65. The project was awarded on August 3, 1987 and property owners were notified of an assessment hearing 10 days prior to the hearing, Pr,~ect The project includes 28-foot paving, sanitary and storm sewers, brick crossings, sidewalks, and bridge. Assessment Under City of Eugene assessment policy, most of the costs are assessed to the abutting property owners. The costs to be assessed are shown below: 28-foot paving $ 51,10/front foot Sanitary sewer-lateral $ 0.141/square foot Sanitary sewer -service $352.90/each Sanitary sewer-trunk levy $ 0.025/square foot Storm sewer $ 0.090/square foot The costs listed below are. the Engineer's estimate and prelimi- nary costs quoted to property owners at the initiation hearing following bid opening. FINDINGS & RECOMMENDATIONS - 1 28-foot paving $ 45.96/front foot Sanitary sewer-lateral $ 0.131 square foot Sanitary sewer-service $335,50/each Sanitary sewer-trunk levy $ 0.025/square foot Storm sewer $ 0.062/square foot Recommendation Costs are comparable to those quoted at the initiation hearing. The paving costs increased due to additional work requested by the owner e,g,, brickpaver crossing in several locations. Staff recommends approval of the distribution, A hearing regarding this project was scheduled for May 10, 198$, at 7:00 P,M,, at the McNutt Room. The Hearings Official received a memorandum from Les Lyle, City Engineer, which set forth the information provided above. No persons appeared at the hearing.
