HomeMy WebLinkAboutOrdinance No. 19530ORDINANCE N0. 19530 AN ORDINANCE CONCERNING SIGN CODE REGULATIONS; AMENDING SECTIONS 8.620, 8.630, 5.635, AND 8.640 OF THE EUGENE CODE, 1971; REPEALING SECTION 8.680 OF THAT CODE; AND DECLARING AN EMERGENCY. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. Section 8.620 of the Eugene Code, 1971, is amended by add- ing the following in alphabetical order therein: 5.620 Definitions. . Awns, A temporary shelter supported entirely from the exter- ~or wall of a bu~ld~ng. Section 2. Subsections ~a}2. and ~a}3, of Section 8.630 of the Eugene Code, 1971 are amended, and anew Subsection ~a}6, is added thereto, to ro- p vide: 8.630 Pedestrian-Auto District. This district is mainly found in the Eugene central business and retail district which is designated Major Retail Center in the Metropolitan Area General P1 an. Sign heights, locations, and dimensions in this district are based on the visibility needs of pedestrians and slow moving traffic. The following identity signs, and incidental signs shall be permitted on properties located within areas designated as "Pedestrian-Auto District" on the Sign District Map: ~a} Si ns on bui 1 di n wal 1 s located oral l el to the street ro ert l i nes . 2. Projectin si n. One projecting identity sign, which shall be entirely contained within the building occupancy area from not less than eight feet above the sidewalk or grade line. The surface area of a projecting sign shall be included in the total allowable sign area as provided in subsection~l. above. a. The maximum projection beyond the street prop- erty line shall be four feet six inches. The maximum width of a projecting sign shall be four feet two inches with an additional four Inches maximum provided for ancharage.of the sign to the building structure. A pro- 0ect~ng sign may not project within two feet of any curb ar driveway l7ne. b. A projecting sign may have an additional three inches in height per one inch reduction in allowable projection as specified above, but shall not extend into the adjacent story occupancy unless relinquished as pro- v~ded ~n subsection ~a}1.b. above, Ordinance - 1 c. Projecting signs located at street intersec- tions shall be governed by sign clearance lines from the near curb line of the adjacent street extending one foot into the street right-of-way for each five feet of dis- tance to the building and the building frontage. d. No projecting sign shall be erected within 20 feet of an adjacent wall or projecting sign measuring from center to center of adjacent projecting signs or from the center of a projecting sign to the edge of an adjacent wall sign, if such signs are in the same hori- zontal plane. 3, Ma~cr u~ee si ns. Signs located under marquees shall have a maximum projection of seven feet beyond the street property line and shall be not less than eight feet above the sidewalk or grade line. The surface area of signs on the face of a marquee shall be considered as part of the total sign surface area. Reader board signs on theater marquees complying with all other provisions of section 8,63o shall be permitted. 6. Awnin si ns. Signs located on or under awnings shall have a maximum projection of seven feet beyond the street property line and shall be not less than eight feet above the sidewalk or grade line. The surface area of signs on the face of an awning shall be considered as part of the total sign surface area. Section 3. Subsection ~c} of Section 8.635 of the Eugene Cade, I97Z, is amended to provide: 8.635 Inte~ra,ted Shop~,inc~District. This district covers shoppin areas develo ed g p, and managed under one ownership. These areas are gener- ally designated ether as neighborhood or community commercial in the Metro- politan Area General Plan. Another characteristic of these centers is common parking shared by the business tenants. This district allows one sho in pP g center sign per street frontage large enough to be readily visible to motor- ~sts on surraund~ng arterial or collector streets. The remainder of the si ns identif in indivi g y g dual businesses are wal 1 signs scaled to pedestrian needs the standards imposed in this district are intended to allow identification without undue intrusion of light and glare on adjacent residential proper- ties. The following signs shall be permitted on properties located within areas designated as "Integrated Shopping District" on the Sign District Map: . ~c} Mar uee si ns. One under marquee sign having a maximum pro~ect~on of seven feet, and not less than eight feet above the sidewalk or grade line . For purposes of computing sign area, signs on faces of a marquee shall be considered as part of the total surw face area. Section 4. Section 8.640 of the Eugene Code, I911, is amended by add- Subsection fie} thereto, to provide: Ordinance - 2 8.640 Outl in Commercial District. Areas in this district are usually designated,neighborhoad ar community commercial, or strip or street- or~ented commercial in the Metropolitan Area General Plan. They are approach- ed primarily by car at city arterial speeds. The businesses are not neces- sarily under one management so all the regulations applied to the integrated shopping district cannot be used. Projecting signs are allowed for each business, but none is as large as the single identity sign for an integrated shopping center. The brightness, intensity and location standards in these areas are intended to protect the surrounding residential areas. The follow- ing signs shall be permitted on properties located within areas designated as "Out]ying Commercial District" on the Sign District Map: fie} Marquee,,~sig,ns. One under marquee sign having a maximum projection of seven feet, and not less than eight feet above the sidewalk or grade line. Far purposes of computing sign area, signs on faces of a marquee shall be considered as part of the total sur- face area. Section 5. Section 8.680 of the Eugene Code, 1971, is repealed. Section 6. The Council specifically finds that the amendments provided for herein are necessary in order to comply with state mandated building code regulations and to facilitate the City~s adopted and funded awning program. Therefore, Statewide Land Use Planning Goals do not apply. Section 1. The City Recorder, at the request of or with the concurrence of the City Attorney, is authorized to administratively correct any reference errors contained herein or in other provisions of the Eugene Cade, 1971, to the provisions amended, added ar repealed herein, Section 7. That the matters contained herein concern the public wel- fare and safety, and an emergency is therefore declared to exist, and this Ordinance shall become effective immediately upon its passage by the City Council and approval by the Mayor.
