ADMINISTRATIVE ORDER NO. 58-05-13-F

ADOPTING A REAL PROPERTY
PURCHASE APPLICATION FEE
The City Manager of the City of Eugene finds as follows:
A. Sections 2.860 through 2.874 of the Eugene Code, 1971, authorize the City
Manager to dispose of real property pursuant to certain enumerated procedures set forth therein.
B. Section 2.020 of the Eugene Code, 1971 authorizes the City Manager to
determine and set fees and charges to be imposed by the City for services, goods, use of
municipal property, and licenses and permits. Following the procedures set forth therein, on
December 14, 2005 Administrative Order No. 58-05-13 was issued notifying the Mayor and City
Councilors that I intended to adopt a real property purchase application fee, as set forth in
Exhibit A thereto.
C. The Notice was also published in the Register Guard, a newspaper of general
circulation within the City and posted at two locations at City Hall on December 23, 2005, and
was made available for inspection by interested persons at the offices of the City's Public Works
Department, 858 Pearl Street, Eugene, Oregon 97401, during normal business hours (8:00 a.m.
to 5:00 p.m. Monday through Friday, exclusive of holidays). The Notice provided that written
comments would be received thereon for a period of fifteen days from the date of posting and
publication. No comments were received within the time and manner required by the Notice.
D. Based on the above findings, and the findings in Administrative Order No. 58-05-
13, I find that the real property purchase application fee as proposed is consistent with applicable
policies and directives of the City Council to recover the cost of services from the direct
beneficiaries of those services; is necessary in the order to defray the City's costs associated with
providing those services, and should be established as proposed.
On the basis of these findings I hereby order that:
1. An application fee in the amount of $1 ,000.00 is hereby established for processing
an application for the purchase of City-owned properties that have been declared to be surplus at
the request of a prospective purchaser of such property.
2. If the prospective purchaser requesting a declaration of property as surplus and
sale of such property is successful and completes the purchase of the property, the application fee
will be credited toward the purchase price. Failure to complete the purchase will result in
forfeiture of the application fee unless another bidder completes the purchase, in which case the

application fee is returned to the person submitting the fee and the fee is not credited to the
purchase price.
