THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section I. Pur ose and Findin s. The purpose of this Act is to estab- lish Eugene as a Nuclear Free Zone in which wank on nuclear wea ons is ro- p p hibited. The people of Eugene find that the presence of nuclear wea ons P facilities within Eugene is in direct conflict with the maintenance of the City's publ i c health, safety, morals, economic wel 1-bei n , and enera1 g 9 welfare. Section 2. Definitions. As used herein: ~a} "Component" means any device that is specially manufactured to be installed in a nuclear weapon. fib} "Direct activities of the federal government" means actions of the federal government or any agency thereof, but excludes actions of independent contractors. ~c} "Nuclear weapon" means any bomb or warhead, the ur ose of p p which is use as a weapon, weapon prototype, or a wea on test device p , the intended detonation of which results from the ever y released b g y fission or fusion reactions involving atomic nuclei. ~d} "Person" means a natural person, a corporation, institution or other entity, but does not include a gavernment or any political subdivision or agency thereof. Section 3. Prohibition of Nuclear Wea ons Wank. ~a} No persan shall knowingly design, develop, manufacture, pro- duce, test, maintain or store nuclear weapons or their components Ordinance - I within the city limits of Eugene. fib} Nothing in this section shall be construed to prohibit: 1. Basic research; or 2. Direct activities of the federal government. Section 4. Enforcement, violation of this ordinance sha11 be punish- able by a fine of a minimum of $50.00 to a maximum of $750.00. The Nuclear Free Eugene Act, adopted by the voters an Novem- ber 4, 1986, and Eugene Ordinance No. 19449, amending Section 5 ~ of that ~~ Acts are repealed.
