HomeMy WebLinkAboutOrdinance No. 19569ORDINANCE NO. ~CQ~ AN ORDINANCE AUTHORIZING THE INSTITUTIQN OF PROCEEDINGS IN EMINENT DOMAIN FOR THE ACQUISITION BY CONDEMNATION OF PROPERTY INTERESTS IN THE vICINITY OF THE RIDGELINE PARK FOR THE PURPQSE OF THE EXPANSION OF THE RIDGELINE PARK ~,ND TRAIL SYSTEM, AND OTHER PUBLIC PURPOSES; AND DECLARING AN EMERGENCY. The City Council of the City of Eugene finds that: The City Council has authority under provisions of the Cit Charter and a livable state ~ 'y s pp law to institute proceedings in eminent domain for the acquisition by condemnation of rivate propert for ubliv ur os ~ P Y p p p es, including the expansion of Clty parks, trails, and other public purposes. The City of Eugene is in the process of ex andin the Ridgeline Park and Tr p g ,ail system, which necessitates the acquisition of property interests in that vicinity. The proposed expansion of the Ridgeline Park and Trail system is consistent with the adopted goals and ob'ectives of the Cit 's South Hills S ~ Y tudy, and other applicable pola.cies of the City of Eugene, Now, therefore, THE CITY CF EUGENE DQES ORDAIN AS FOLLOWS: Section ,,1, Based upon the above findin s which are incorporated herein b re g y ference and hereby adapted, the City Council of the City of Eugene does hereby find, declare and determine it necessary to acquire certain ownershi in fee interest or recreatio p n easements consisting of up to approximately 15.0 acres in the northeast corner of the arcel of real pro ert more articula ~ ~ p p Y p rly described an Exhibit A attached hereto and incorporated herein by reference in order to ex and the Ridgeline Park and Trail s s p y tem. Section 2. The City Council does hereby direct that the City of Eugene shall institute proceedings in eminent domain for the condemnation of the real property interests described in Section 1, and, at least 20 days prior to the filin of an action for condemnation to g Y make a written offer to the owners or parties having an interest therein of a stated amount as compensation therefor and for any compensable dams es to remainin ro ert g gp p Y Section 3. The City Council hereby declares that the acquisition above set forth is for a public purpose, is necessar Y Ordinanve - 1 for the public welfare and is authorized under the laws of the State of Oregon and Charter and ordinances of the City of Eugene. Section 4. The City Council further declares that the real property interests described in Section 1 shall be used by the City of Eugene for park ar other public purposes at the earliest possible date and, in any event, no later than ten years from the date this Ordinance is adopted by the Council and approved by the Mayor. Section 5. The expansion of City parks concerns the public welfare and safety and therefore, an emergency is hereby declared tv exist, and this ordinance shall become effective immediately upon its passage by the City Council and approval by the Mayor.
