AN ORDINANCE CONCERNING OFF-STREET PARKING RE~UIRE-
MENTS; AMENDING SECTIONS 9.580, 9.582, AND 9.585 OF
THE EUGENE CODE, I97I;
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section I. Section 9.OI5 of the Eugene Cade, 197I, is amended by add-
the following definition in alphabetical order therein:
9.OI5 Definitions. As used in this chapter, unless the context requires
otherwise, the following words and phrases mean:
I9th and A ate Area. The C-1 zoned properties fronting Agate
Street between East ISth Avenue and East 24th Avenue, and the C-I
zoned properties fronting East I9th Avenue between Emerald Street
and Columbia Street as depicted in the I9th and Agate Special Area
Study adopted by the council by ordinance number I9564 on July 11,
I988.
Section 2. Section 9.580 of the Eugene Cade, I971, is amended to ro-
p
vide:
9.580 Descri tion and Pur ose. The purpose of sections 9.584 to 9.598
is to set forth the off-street parking requirements for the various
buildings and uses.
Section 3. Subparagraph ~b~ of Section 9.582 of the Eugene Code, I97I
is amended to provide:

as follows:
~b~ In the C-1 district, on the development site far all
uses, except employee and employer parking may be located adjacent
to or directly across the street from the property location of the
use served if the following criteria are met:
I. The parking area must be clearly posted for and used
by employers and employees only, except parking areas serving
the C-I zoned properties in the I9th and Agate Area may also
be posted for and used by customers; and
2. The traffic engineer must determine that the arrange-

went will not likely cause a vehicular or pedestrian hazard,
interfere with safe and convenient access, ar be detrimental
to appropriate development of properties in the general area.
If the C-1 zoned properties are within the 19th and Agate Area,
employee, employer, and customer parking may be provided within
600 feet of the property if the above criteria are met.
Section 4. Subparagraph ~c~ of Section 9.586 of the Eugene Code, 1971,
is amended, and anew subparagraph ~e~ added thereto, to provide:

required shall be no less than as set forth in the following:

1. If four or fewer parking spaces are otherwise required by subsec-
tion 9.586~c}, no parking spaces are necessary when the building

provided within 100 feet of the entrance to the business,
2. If five to eight parking spaces are Otherwise required by subsec-
tion 9.586~c}, the required parking can be reduced by four spaces
if the prov~s~ons of subsection 9.586~e}1. are met, and the
building official determines that the use will be a neighborhood-
oriented bakery, barber shop, beauty shop, book store, candy store,
drug store, dry cleaner, food and dairy product store, Laundromat,
magazine and newspaper store, restaurant, service station, variety
store, and other business of a similar nature.
3. If nine or more parking spaces are otherwise required by subsec-
tion 9.586~c}, the required parking can be reduced by four spaces
~f the prov~s~ons of subsections 9.586~e}1. and 9.586~e}~, are met,
and ~f the bu~ld~ng official further determines that the following
conditions will be satisfied:
a. The business wi11 provide employee parking or strong incen-
tives for employees to arrive at work by means other than
private automobile.
b. The business will provide incentives to customers to walk, or
ride a bicycle or bus to the establishment. Incentives could
include, for example, displaying a rack with public bus route
maps and schedules, selling bus tokens, and offering bus tokens
to customers who present valid bus transfers.
c. The business will contribute toward providing urban amenities
in the area identified in the 19th and Agate Special Area
Ordinance - 3
Study adopted by the council on July 11, X988. Amenities
could include, for example, benches, low-level lights, a bus
shelter, or other open space improvements.
d. The business will encourage its employees and customers not to
park on streets in residential areas by actions such as past-
ing visible notices to this effect.
Section 5. The City Recorder, at the request of or with the concurrence
of the City Attorney, is authorized to administratively correct reference
errors contained herein or in other provisions of the Eugene Code, ~97~, to
the provisions amended or added herein.
Section 6. That the matters contained herein concern the public welfare
and safety and therefore, an emergency is hereby declared to exist, and this
Ordinance shall become effective immediately upon its passage by the City
Council and approval by the Mayor.
