ORDINANCE N0. 19591
AN ORDINANCE CONCERNING THE CITY'S WEATHERIZATION
CODE FOR COVERED RESIDENTIAL BUILDINGS; AMENDING
SECTION 8.31a OF THE EUGENE CODE, 1971 TO PROVIDE
A NEW EFFECTIVE DATE; ESTABLISHING A COUNCIL REVIEW
DATE; REPEALING ORDINANCE NOS. 18751 AND 19213; AND
DECLARING AN EMERGENCY.
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. Section 8.310 of the Eugene Cade, 1971, is amended to pro-
vide:

Issued prior to,July 1, 1974, shall, after January 1, 1991, have the follow-
ing weather~zat~an:
~a} Plaster shall be free of cracks, holes, crumbling or other
deter~orat~on.
fib} Exterior windows and doors shall be water and wind-proof,
free of cracks, rot or other deterioration.
~~c} Exterior walls, roofs and foundations shall be water and
wind-proof, free of cracks, splits, buckling, breaks, rot, crumblin
g
or deterioration.
~d} Exterior wall coverings shall be adequately painted or
otherwise weatherproofed and free of weathering and other deteriora-
tion.
fie} Exterior window and door frames providing access from
unconditioned to conditioned space sha11 be properly caulked.
~f} Exterior windows and doors providing access from uncondi-
tioned to conditioned space sha11 be properly weatherstripped.
fig} Attics shall be insulated to an R value of 30 ar greater
except those:
1. that were insulated to an R value of 11 prior to
January 1, 1991;
2. that have a vert~r.~~ rlaar ha~rrht of ~~ ~nrhor nv+

3. that have structural obstructions which prevent
installation of R-3o insulation, so long as it has been
insulated to the highest R value reasonably possible; or
4. where placing of insulation would cause otherwise
1 awful ly instal 1 ed electrical wiring to become unsafe or
would create afire hazard.
~h} Attics shall be constructed sa as to have:
1. cross ventilation for each separate space;
2. ventilation openings constructed to prevent entrance
of rain and snow;
3. net free ventilation openings of 1/15a of the area of

the space ventilated or openings of 1/300 of the area of the
space ventilated provided 50 percent of the required openings
are located in the upper portion of the space ventilated at
least three feet above eave or cornice vents with the balance
of the required ventilation provided by eave or cornice vents.
~ i } Floors shal 1 be insulated to an R val ue of 19 or more
where the crawl space has a vertical clear height of 18 inches or
more, except where insulation exists that was installed prior to
January ~, 1991;
~} Crawl space shall have a vapor barrier with a performance
at least equivalent to 6 mils thick polyethylene, except where
the crawl space has a vertical clear height of less than 18 inches
or where the installation of such a vapor barrier would create
deteriorating conditions such as poor drainage or decreased sail
bearing capacity,
~k} Domestic water heaters shall be insulated to a total R
value that i s equivalent to R-16 or more i f passi bl e without
modifying existing plumbing.
~l} .Heating and return air ducts in unconditioned spaces
shall be insulated to an R value of 11 or more and if the uncondi-
tioned space has a vertical clear height of 18 inches or more,
except where insulation exists that was installed prior to
January 1, 1991.
Section 2. The City Manager is hereby directed to prepare a report for
the Council's consideration that contains:
a. A summary of the voluntary EwEB and BPA sponsored weatheri-
nation programs; and
b. A review and analysis of the impact of the weatherization
standards imposed in Sections 8,270 to 8.310 of the Eugene Code, 1971.
Section 3. Ordinance No 18757 adopted by the Council on February 9,
1981 and approved by the Mayor On February 10, 1981, and Ordinance No. 19213
adopted by the Council and approved by the Mayor an January 11, 1954, are
hereby repealed.
Section 4. Except as herein specifically amended, the provisions of
Ordinance No. 19150 adopted by the Council and approved by the Mayor on June
15, 1983 remain in full force and effect.

Section 5. That the matters contained herein concern the public health,
welfare, and safety and therefore, an emergency is hereby declared to exist,
and this Ordinance shall become effective immediately upon its passage by the
City Council and approval by the Mayor.
