AN ORDINANCE CONCERNING LICENSING PROVISIONS FOR
FIRE SAFETY AND HAZARDOUS MATERIALS PERMITS;
AMENDING SECTIONS 3.a05, 3.175, 3.171,~AND 3.180
OF THE EUGENE CODE, 1911; ADDING NEW SECTIONS
3.151, 3.190, 3.192, 3.194, 3.196, AND 3.198 TO
THAT CODE; AND DECLARING AN EMERGENCY.
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. Section 3.005 of the Eugene Code, 1911, is amended by add-
ing the following under the definitions for Licensed Businesses, immediatel

3.005 Definitions. Far the purposes of this chapter, the followin words

and phrases shall mean:
Fire Safet and Hazardous Materials.
Ap 1~i~cant. A person who applies for a permit but who has not
yet received that permit.
Checklist review. Review of the amount and classification of
hazardous materials located at each facility for which an a licant

has applied for a permit.
Facilit . All buildings, equipment, structures and other
stationary items which are 1 ocated on a s i ngl a site or an cont i u -

ous or adjacent sites and which are owned or operated by the same
person, company and/or corporation. For the purposes of this
chapter, any motor vehicle and/or rolling stack located on the
site of a facility will be considered as part of the facility.
Person. An individual, partnership, association, corporation,
trust, firm, estate, organization or other ]ego] entity,
Section 2. Sections 3,175, 3.117, and 3.15o of the Eugene Code, 1971,
are amended, and anew Section 3.181 added thereto, to provide:
3.175 Fire 5afet -License Re wired. No person shall use a buildin or

by sections 4,101 to 4.102 of the Uniform Fire Code as ado ted and amended b

therefor. When mare than one fire safety permit is required for the same
facility, such fire safety permits may be consolidated into a sin le license.

3.111 Fire Safet -License Review. In reviewing the application, the
.city may request the city's Fire Code Enforcement Division to pro-
v~de a written report regarding the ability of the applicant to meet the
requirements of this code.
3.180 Fire Safet -Term of License. Afire safety permit remains valid
as long as all conditions and information described in the appli-
cation remain in effect and as long as the fire safety licensee complies with
those code sections referenced in section 3.175 of this code, and all other
applicable provisions of this chapter.
3.181 Fire Safet -Sus ension or Revocation of License or Permit. The
city may suspend ar revoke afire safety license or permit issued
thereunder ~f there are v~oiations of section 8.190 and 8.200 of this code
or a violation of any other applicable provision of this cha ter.

Section 3. A caption, and Sections 3.190, 3.192, 3.194, 3.195, and
3.198 are added to the Eugene Cade, 1911, to provide:
Hazardous Materials
3.190 Hazardous Materials - License Re uired. No person shall store
a
use, handle, manufacture, process, dispense and/or dispose of any
regulated hazardous material as defined by articles 14, 15, 17, 78, 19 80
82, and 86 of the Uniform Fire Code without first obtainin a hazardous y

materials permit as required by sections 4.101 to 4.102 of the Uniform Fire
Code as adopted and amended by sections 8.190, 8.200, and 8.205 of this code.
When more than one hazardous materials permit is required for the same facil-
ity, such permits may be consolidated into a single hazardous materials
license,
3.192 Hazardous Materials - License Review. In reviewing the a lication

city may request the city s Fire Code Enforcement Division to

requirements of this code.
3.194 Hazardous Materials - Criteria for Issuance of License.
. ~1} In addition to any other requirements of this code, the city
may consider any danger to public health or safety, or to public or private
property that may result from approval of an application in determining
whether to approve the application.
€2} Upon finding the applicant has met the criteria of subsection
~1} of this section and ~s in compliance with this code and rules ado ted

under this chapter, the city may approve the application and issue the
hazardous materials license.

3.196 Hazardous Materials - Sus ensign Revocation of License. The cit

volving the use or storage of hazardous materials at the facilit for which

this chapter.
3.198 Hazardous Materials - A lication Review. The city will be in its
review of a haz • g •
ardous materials license appl~cat~on when the appl~-
cant has submitted the required fees and a hold harmless agreement, and the
Fire Code Enforcement Division has completed the checklist review.
Section 4. The City Recorder, at the request af, or with the concur-
rence of the City Attorney, is authorized to administratively correct an

reference errors contained herein, ar in other provisions of the Eu ene Code

1971 t0 the provisions added, amended or repealed herein.
Section 5. That the matters contained herein concern the ublic wel-

fare and safety and therefore, an emergency is hereby declared to exist and
this ordinance shall become effective immediately upon its assa e b the
