ORDINANCE N0. ~~
AN ORDINANCE LEVYING ASSESSMENTS FOR
paving, sanitary and storm sewers far Lakeridge Estates on Elkhorn Drive,
extending west of Gilham Road, 165 feet and then extending 345 feet south and
115 feet north of Elkhorn Drive on Metolius Drive, Walf Meadows Lane and Powder
River in the City of Eugene, Lane County, Oregon.
The City Council of the City of Eugene finds that:
On the 16th day of February, 1988, as authorized in the Eugene Code
7.160{8} the City Engineer initiated the proposed local improvement consisting
of paving, sanitary and storm sewers for Lakeridge Estates on Elkhorn Drive
extending west of Gilham Raad, 765 feet and then extending 345 feet south and
115 feet north of Elkhorn Drive on Metolius Drive, Wolf Meadows Lane, and
Rowder River Drive.
After due notice and a public hearing .thereon before the hearing official,
and no remonstrances having. been filed, the City Council authorized.. the
execution of a contract for the construction of the local improvement on the
23rd day of May, 1988.
The actual cost thereof is ascertained, and the initial amount to be
assessed in accordance with applicable provisions of the Eugene Code, 1911 has
been determined to be:

The City Council has established the method of calculating local improve-
ment assessments in Sections 1.170 and 7.175 of the Eugene Code, 1911.
A notice containing the information required by Section 7.185 of the
Eugene Code, 1971 has been pasted on a bul 1 eti n board at City Ilal ~ and given by
ORDINANCE - 2
certified mail to the owners of the parcels of real property subject to the
assessment more than ten days prior to the public hearing before the hearing
official. At the time and place specified therein, a hearings official heard
all evidence and argument presented, has fully considered the same, and no
remonstrances having been filed, has reported his or her adopted findings to
the City Council. The Council has reviewed and considered the assessment
report of the City Engineer and Finance Officer and the hearings official's
findings and summary of the hearing, and based thereon,
THE CITY DF EUGENE DOES ORDAIN AS FOI.I.DWS:
Section 1. The Summary of the hearing conducted by the hearings official
are hereby made a part of the Council's record in these proceedings, and the
hearings official's findings, including those regarding compliance with
Sections 1.16D to 7'.190 of the Eugene Code, 1971, attached as Exhibit A hereto
and incorporated herein by reference are adopted.
Section 2. That the actual cost of paving, sanitary and storm sewers for
Lakeridge Estates on Elkhorn Drive, extending west of Gilham Road, 765 feet and
then extending 345 feet south and 115 feet north of Elkhorn Drive on Metalius
Drive, Wolf Meadows Lane and Powder River Drive, a local improvement in the
City of Eugene is the sum of $196,335.20 which is by this ordinance assessed
against the parcels of property hereinafter described in the amounts set
apposite, respectively.
Section 3. That the City Council does hereby determine and assess each
lot and part of lot being within the described local improvement district as
set forth on the assessment roll attached as Exhibit B hereto and incorporated
herein by reference.

Section 4. That the pity Council does hereby determine that each parcel
of land ar lot hereinabove described is specially benefitted to the extent of
the initial assessment set Earth. The Finance Officer shall give notice of the
assessments to the owners of the assessed parcels advising them the assessment
may be paid i n full , without interest, within ten days of the date of adoption
of this ordinance. Assessments that remain unpaid after the ten day period are
declared to be liens upon the respective lots, parts of lots or parcels of land
against which said several amounts are assessed, and may be paid in up to
twenty equal semiannual installments, including principal and interest at the
rate set by the City Manager as provided in Section 2.022 thru 2.024 of the
Eugene Cade. The City Retarder is directed to enter in the docket of City
Liens a statement in connection with each unpaid assessment containing the
fallowing:
4.1 A description of each lot, part of lot or acreage liable for
such improvement;
4.2 The name of the owner ar reputed owner thereof, that the name of
the owner is unknown; and
4,3 The sum assessed upon said property, the amount and date from
which interest accrues, and the date of entering the same in the docket of
City liens.
Section S. Upon enactment of this ordinance, the City Finance
Officer shall send notice of the assessments by first class to the owners of
the assessed parcels containing the information required by Section 7,190 of
the Eugene Code, 1971, and enclose therewith an application for paying the
assessment in installments according to the terms set forth in Section 4 of
this ordinance.

FINDINGS AND RECOMMENDATIONS
SUBJECT: PAVING, SANITARY AND STDRM SEWERS TO SERVE
LAKERIDGE LOCATED ON ELKHORN DRIVE, EXTENDING
WEST GILHAM ROAD, 7b5 FEET AND THEN EXTENDING
345 FEET SOUTH AND 115 NORTH OF ELKHORN DRIVE ON
METOLIUS DRIVE, WOLF MEADOWS LANE AND POWDER
RIVER DRIVE (88.04)
BACKGROUND
This project was initiated by a petition from the developer, to construct streets and sewers
for a newly platted 30 lot subdivision (Lakeridge). The owner will bear 100% of the
improvement costs based on Eugene Code.
Based on the petition, the City Engineer initiated the project, as provided far in the
Eugene Code 7.160(8), on February 1b, 1988. Property owners were notified of the
pending award hearing 10 days prior to the hearing. The project was authorized for
construction by the City Council on May 23,1988. The low bid was submitted by Wildish
Corvallis Construction Company far amount of $148,061.00.
PROJECT
The project includes 28-foot paving, sanitary and storm sewers.
ASSESSMENT
Under City of Eugene assessment policy, most of the cost is assessed to the abutting
property owners. The developer has requested that the total assessment be divided
equally between the 30 lots. The cost per lot based on low bid was $6,614.93. The actual
final assessment cost per lot is $6,074.89,
The cost to be assessed to property owners are shown below:
2S-foat paving with storm drain $ 27.95/front foot
6" service line $351.86/each
8" sanitary lateral $ .19~square foot
The costs listed below are the Engineer's estimate and preliminary costs quoted to
property owners at the initial hearing following the bid opening.

REC4MMENDATIUN
Costs are comparable to projects of similar size and less than pre-assessment costs quoted
to the property owners, Staff has received notification (attached) that the owner wishes
to pay cash and is waiving the public hearing opportunity. Staff recommends
appropriation of the assessment distribution.
A hearing regarding this project was scheduled for January 25, 1959, at 7:00 P.M, at the
McNutt Room. The Hearings Official received a memorandum from Les Lyle, City
Engineer, which set forth the information provided above. No persons other than staff
appeared at the hearing.
The Hearings Official recommends that the City Council approve the levying of the
assessments as set forth above.
