AN ORDINANCE I.EVY~NG ASSESSMENTS FOR
storm sewer located east of Spyglass Drive from Spyglass Court to 150 feet
north; through tat 31 of Fairway View P.U.D. in the City of Eugene, Lane
County, Oregon.
The City Council of the City of Eugene finds that:
On the 24th day of dune, 1988, as authorized in the Eugene Cade 7.160(8}
the-City Engineer initiated the proposed local improvement consisting of storm
sewer located east of Spyglass Drive from Spyglass Court to 150 feet north;
through lot 31 of Fairway View P.U.D.
After due notice and a public hearing thereon before the hearing official,
and no remonstrances having been filed, the City Council authorized the
execution of a contract far the canstructi an of the local improvement an the
8th day of August, 1988.
The actual cost thereof is ascertained, and the initial amount to be
assessed in accordance with applicable provisions of the Eugene Code, 1971 has
been determined to be:

The City Council has established the method of calculating local improve-
ment assessments in Sections 1.170 and 7.175 of the Eugene Code, 1971.
A notice containing the information required by Section 7.185 of the
Eugene Cade, 1971 has been posted on a bul]etin board at City Mall and given by
certified mail to the owners of the parcels of real property subject to the
assessment more than ten days prior to the public hearing before the hearing
official. At the time and place specified therein, a hearings official heard

a1i evidence and argument presented, has fully considered the same, and na
remonstrances having been filed, has reported his or her adopted findings to
the City Council. The Council has reviewed and considered the assessment
report of the City Engineer and Finance Officer and the hearings official's
findings and summary of the hearing, and based thereon,
TIE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. The Summary of the hearing conducted by the hearings official
are hereby made apart of the Counci 1's record i n these proceedings, and the
hearings afficia1's findings, including those regarding compliance with
Sections 7.164 to 7.190 of the Eugene Cade, 1971, attached as Exhibit A hereto
and incorporated herein by reference are adapted,
Section 2. That the actual cast of storm sewers located east of Spyglass
Drive from Spyglass Court to i50 feet north; through lot 31 of Fairway View
P.U.D., a 1oca1 improvement in the City of Eugene is the sum of $13,027.12
which is by this ordinance assessed against the parcels of property hereinafter
described in the amounts set opposite, respectively.
Section 3. That the City Council does hereby determine and assess each
lot and part of lot being within the described local improvement district as
set forth on the assessment tall attached as Exhibit B hereto and incorporated
herein by reference.
Section 4. That the City Council does hereby determine that each parcel
of land ar lot hereinabove described is specially benefitted to the extent of
the initial assessment set Earth. The Finance, Officer sha]1 give notice of the
assessments to the owners of the assessed parcels advising them the assessment
may be paid in full, without interest, within ten days of the date of adoption
of this ordinance. Assessments that remain unpaid after the ten day period are

declared to be liens upon the respective lots, parts of lots ar parcels of land
against which said several amounts are assessed, and may he paid i n up to
twenty equal semi-annual installments, including principal and interest at the
rate set by the City Manager as provided in Section 2.022 thru 2.024 of the
Eugene Code. The City Recorder is directed to enter in the docket of City
Liens a statement in connection with each unpaid assessment containing the
fallowing:
4.1 A description of each lot, part of tat nr acreage liable for
such improvement;
4.2 The name of the owner or reputed owner thereof, that the name of
the owner is unknown; and
~.3 The sum assessed upon said property, the amount and date from
which interest accrues, and the date of entering the same i n the Jacket of
City Liens.
Section 5, Upon enactment of this ordinance, the City Finance
Officer shall send notice of the assessments by first c1 ass to the owners of
the assessed parcels containing the information required ~y Section 7.190 of
the Eugene Code, 1971, and enclose therewith an application for paying the
assessment in installments according to the terms set forth in Section 4 of
this ordinance.

FINDINGS AND RECOMMENDATIONS
SUBJECT: STORM SEWER EAST OF SPYGLASS DRIVE FROM SPYGLASS
COURT TO 150 FEET NORTH CONTRACT X88-14}
BACKGROUND
This project was petitioned by a majority of the property owners
abutting the storm sewer named above. The properties petitioning
for the improvements will bear 144 percent of the assessable
costs.
Based on the petitions, the City Engineer initiated the project,
as provided for in the Eugene Code 7.10(8), on June 24, 1988.
Property owners were notified of the pending award hearing 14
days prior to the hearing. The project was authorized for
construction by the City Council on August 8, 19$$, The low bid
was submitted by Kenneth R. Bostick Construction Co,, for an
amount of $14,382.04,
PROJECT
The project includes 36" storm sewer, imported embankment and
crush rock material.
ASSESSMENT
Under City of Eugene assessment policy, most of the cost is
assessed to the abutting property owner (there is only one pro
perty owner for this project}. The costs to be assessed are:
$9,845.21 Property owner
$3,1$2.54 City cost
Costs listed below are the Engineer's estimate and preliminary
costs quoted to the property owner at the award hearing following
bid opening.
$14,900.04 Property owner
$ 3,470.40 City cost

RECOMMENDATIONS
Costs are slightly less than projects of similar size and lower
than preliminary costs quoted at the award hearing. Staff recom-
mends appropriation of the assessment distribution.
This project was scheduled for January 30, 1989, at 7:00 P,M, at
the City Council Chambers, The Hearings Official received a
memorandum from Les Lyle, City Engineer, which set for the infor-
mation provided above. No persons other than staff appeared at
the hearing.
The Hearings Official recommends that the City Council approve
the levying of the assessments as set forth above,
