HomeMy WebLinkAboutOrdinance No. 19083ORDINANCE NO . 19 0~ AN ORDINANCE CONCERNING THE HUMAN RIGHTS COM~- MISSIONS AND YOUTH COMMISSIQN; AMENDTNG SECTIONS 2.260, 2.27Q, 2.280, 2.255, AND 4.625 OF THE EUGENE CODE, 1971; AND DECLARING AN EMERGENCY. THE CITY OF EUGENE DGES ORDAIN AS FOLLOWS: Section 1. Subsections ~l} ~d} , ~2} , ~3} fib} , ~3} ~d} , ~4} ~ ~5} and ~ 7 } of Section 2.26 0 of the Eugene Code, 19 7l, are hereby amended to read and provide: 2.26 0 Commissions on .Human Rights . ~1} ~d} The commission on the rights of the dis- abled. ~2} Each commission shall consist of seven members. The council shall appoint the members and fill any vacancies, of ter interviews and recommendations by the council subcom- mittee, Members of the commissions shall be appointed through a public process which includes open applications and inter- views of the finalists by the council subcommittee. In order to provide continuity, initial appointments shall include two members selected for cone-year term, three members selected f or a two -year term, and two members selected f or a three--yea r term. Thereof ter all appointments shall be to fill an unex- pir ed term or for a three-year term , a s the ca. s e may b e . ~. 3 } ~b } Members of the commission on the rights o f minorities shall be persons who have actively demon- stra ted interest and expertise in the field of min- ority relations and who are wn rking to eliminate in- justices related to discrimination based on race, color, religion, and nations 1 origin. ~d} Members of the commission on the rights of the disabled shall be persons who have actively demon- strated interest and expertise in the field of prob- lems related to handicapped and disabled persons and who are ~ rking to eliminate injustices related to discrimination against disabled persons. ~4} Each commission shall meet at least once every month at a regularly scheduled place and time. At its initial meeting, each commission shall elect from its members a ~esi-- de nt and vice-president. Ordinance - 1 19083 ~5} To promote the orderly conduct of its affairs, each commission shall adopt rules of procedure for its meet- ing s. Each commission r s authority to adopt rules of procedure is limited to the adoption of such rules that are rrat in con- flict with sections 4.615 to 4.650 of this code and are rea- sonably necessary to carry out the duties imposed by section Z. X65 of this code. ~7 } The city m~,nag er may, within his or her discretion, furnish staf f assistance to any commission. Section 2. Section 2.27D of the Eugene Code, 1971, is hereby amended to read and provide; 2.27 D Human Rights Presidents Council. _M ~.~,. ~1} ^ At its ~f~rst meeting each commission on human rights shall elect a president who shall, in addition to his or her other duties, serve on the human rights presidents council. ~.2} The human rights presidents council shall meet quarterly and a t such other times a s i t deems necessary . At its initia 1 meeting there shall be elected from its members a president and vice-president and a new president and vice- preside nt sha 11 be elected annually thereafter. ~ 3 } ,The human rights presidents council shall coordi- nate the activities of the various commissions, and shall make an annual evaluative report, based upon criteria collectively agreed upon by the commissions, to the commissions, including the youth commission-,----and th e.......... c. ty ----co_unc.a. ~, . --- --- - __ - . ~4 } The c~nmissians, including the youth commission, sha 11 submit to the human rights presidents council a t appro- pria to times, their proposed annual budgets and staf f requests. The human rights presidents council, in conjunction with the city manager, sha 11 review and make recommendations to the budget committee of the city. Section 3 . Section Z. 28 D of the Eugene Code, 19 71, is hereby amended by amending subsection ~~} , deleting subsection ~3} , renum-~ Bering subsections ~4} , ~5} , ~6} , ~7} , and ~8} to ~3} , ~4} , ~5} , ~ 6 } , and ~ 7 } respectively; amending the new subsections ~ 4 } , ~ 5 } , and ~ 7 } , to read and provide ; ~. ~8D Youth Commission.. ~2} The youth commission shall consist of seven mem- bers. The council shall appoint the members and fill any vacancies, after interviews and recommendations by the council Ord i na nce - 2 19083 subcommittee. Members shall be appo,~nted through a public pro- cess which includes open applications and interviews of f final- ists by the council s~bca~mmittee. Thereafter all appointments shall be t~ fill an unexpired term or for athree-year term, as the case may be. ~4} The youth commission shall meet at least once e~~ery month at a regularly scheduled place and time. At its initial meeting it shall elect from its members a president and vice-president. ~ 5 } To promo ~te the orderly conduct of its affairs, i t shall adopt rules of procedure for its meetings. This authority to adopt rules of procedure is limited to adoption of such rules that are m t in canf lict with any provisions of this code and as are reasonably necessary to carry out the duties imposed by section 2.285 of this code. ~7} The city manager may, within his or her dis- cretion, furnish staff assistance to the youth commission. Section 4 . Subsection ~2 } of Section 2.285 of the Eugene Code, 19 71, is hereby amended to read and provide : 2.285 Youth Commission ~- Duties. and Powers. ~2 } The president o f the ~ uth commission shall serge on the human rights presidents council. Section 5. Section 4.625 of the Eugene Code, l9.?1, is hereby amended by amending subsections ~1} " ~l~ ~c} ; ~.1} " ~2} "; ~1} " ~3} "; and ~ 3 } thereof , to read and provide : 4.625 Fair Em to ment Practice Provision in Cit Contracts. ~.1 } ~1 {.1 } ~c} The contractor agrees to post in conspi- cuous places, available to employees and appli- cants for employment, no tices to be provided by the human rights pres.~dents council setting forth the provisions of this na ndiscrimination clause. " ~2} The contractor will prior to commencement and during the term of this contract: Ordinance - 3 19083 ~a~ furnish to the human rights presidents council, upon request and on such form as may be provided by the human rights presidents council, a written report of the affirmative action taken by the contractor in implementing the plan des- cr ibed in paragraph ~.1 ~ ~b ~ within 3 Q days from the date such request is made; and fib). Permit the human rights presidents council to inspect and to copy records of employment., em- ployment advertisements, application forms, and other pertinent data and records of the contractor, far the purpose of investigation to determine com- pliance with paragraph ~l} . " ~.3} If upon investigation the human rights presi- dents council finds reasonable cause to believe that the contractor or any subcontractors of the contractor have failed to comply with any of the items of paragraphs ~ 1 ~ or ~2 ~ , the contractor and the city manager shall be so notified in writing. The city manager shall give the contractor an opportunity to be heard, after 14 days written notice. If the city manager concurs in the findings of the human rights presidents council he or she may suspend, cancel, or terminate :the principal con- tract in whole or in part and/or withhold any funds due or to become due to the contractor, pending compliance by the contractor andfvr its subcontractors, with the terms of paragraphs ~l } and ~ 2 ~ . ~3~ The human rights presidents council will initiate an investigation to determine compliance with the provisions of this section upon the request of a human rights commission, and will make. the results of its investigation available to the commission. Section ~. That the matters contained herein concern the public welfare and therefore, an emergency is hereby declared to exist, and this Ordinance shall become effective immediately upon its passage by the City Council and approval by the Mayor.
