THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. The I-~ Light-Medium Indus- n rnr.r trial District~is mainly intended to~preserve .and enhance areas containing a wide range of manufacturing and other industrial activities with controlled external impacts in locations generally depicted for light-medium industry in the Metropolitan Area Genera, Plan, refinement plans, and spe- cial area plans. Section 15. Section 9.450 of the Eugene Code, 1971, is hereby amended to read and provide: 9.450 Permitted Buildings an,d~,,,,,,Uses. In the I-2 Light-Medium I~ndustrial~rDistrict, the following buildings and uses are permitted as hereinafter specifically provided, subject to~ the general provisions, exceptions, and performance standards set forth in this ordinance. In addition, those uses permitted in the I-1 district as contained in sections 9.443 and 9.444 shall be permitted in the I-~ district, except restaurants, financial institutions, and non-accessory offices not directly permitted in the I-2 district. when located in the I-2 dis- trict, the uses set forth in section 9.444 need not be in an industrial park unless specifically required to be located therein in this section. ~a~ ~ Accessory buildings and uses normally asso- ciated with the buildings and uses permitted and permitted conditionall~r in sections 9.448 to 9.454. ~_b~ Administration and sales offices for indus- trial uses established on the same development site. Buildings and uses existing and legally permitted or permitted conditionally as listed in the zoning ordinance on January 27, 1982, are exempt from sections 9.612 to 9.626 pertaining to non-conforming uses. This exemption is limited to the develop~- n~ent site an which the buildings or uses existed on Januar 27, 1 82 y 9 . ordinance - 7 /906/ Section 16. Section 9.452 of the Eugene Code, 1971, is hereby amended to read and provide: 9,452 Buildin s and Uses Permitted Conditionall In addi- tion to the buildings and uses permitted conditionally listed in sections 9,492 to 9.502, the hearings official may grant a conditional use permit for any of the following build- ings and uses in accordance with the procedures set forth in sections 9.696 to 9.722: ~a~ Uses that could be hazardous, obnoxious, or offensive by~reason of odor or biological agents. Buildings and uses existing and legal~,y permitted or permitted conditionally as listed in the zoning ordinance on January 27, 1982 are exempt from sections 9.612 to 9.626 pertaining to non- conforming uses. This exemption is limited to the development site on which the buildings or uses existed on January 27, 1982. Section 17. A new section is hereby added to the Eugene Code, 1971, to be numbered and provide: 9.454 Buildin s and Uses Permitted with Site Review. 2n the I-2 Light-Medium Industrial District, the following buildings and uses are permitted subject to the provisions and exceptions set forth in sections 9.656 to 9.694 for site review; ~.a} Asphalt mixing and hatching. ~b~ Concrete mixing batch plant}, ~c~ Drive-in theaters for no more than l4 years, site review renewable if not needed for in- dustry~ . ~.d~ Mineral resource mining, recovery, stock- piling and processing ono smelters or ore reduction}. Section 18. The caption preceding Section 9.462 of the Eugene Code, 1971, and Sections 9.462, 9.464 and 9.466 of the Eugene Code, 1971, are hereby repealed. Section 19, The caption preceding Section 9.465 of the Eugene Code, 1971, and Section 9,468 are hereby amended to read and pra- vide: I-3 Heavy Industrial District 9.465 Description and Purpose. The I-3 Heavy Industrial District is mainly intended to preserve and enhance areas generally depicted for heavy industry in the Metro- politan Area General Plan, refinement plans, and special area ordinance ~- 8 9~/ plans. To allow heavy industrial uses listed in this district in other districts could create incompatible conditions for other activities in those other districts. Section 20. Section 9.470 of the Eugene Code, 1971, is hereb Y amended to read and provide: 9.470 Permitted Buildings_and Uses. In the I-3 Heavy Indus- ~_.,~. trial Di~strictl~, the~~~~ following buildings and uses are permitted as hereinafter specifically provided, subject to the general provisions, exceptions, and performance standards set forth in this ordinance. Those uses listed in section 9.452 shall also be per- mitted as conditional uses in this district, and the uses listed in section 9.454 shall be permitted in this district subject to the provisions and exceptions set forth in sec- tions 9..656 to 9.694 for site review. {.a~ Abattoirs ~slaughterhouses~ - indoors only. ~.b} vehicle and building wrecking and salvage; sale of parts salvaged vn-site. A site obscuring fence or wall shall be required, with stacking higher than the fence or wall prohibited. ~c} Incineration or reduction of organic matter. ~d~ Manufacturing, processing, assembling, pack- aging, repairing, ar testing of all items, goods, and materials. ~e~ All industrial uses not listed elsewhere in this ordinance, and those uses listed in section 9.450, are permitted. t.f~ other uses similar in operational character- istics to those permitted or permitted conditionally. Buildings and uses existing and legally permitted or permitted conditionally as listed in the zoning ordinance on January 27, 1982, are exempt from sections 9.612 to 9.626 pertaining to non-conforming uses. This exemption is limited to the develop- ment site on which the buildings or uses existed on January 27, 1952. Section 2l. Section 9.472 of the Eugene Code, 1971, is hereby amended to read and provide: 9.472 Special Hazardous Uses Re uirin Permits. Due to the potential hazard to the public health, safety and wel- fare, the manufacturing, processing and/or above-ground storage of the following items, as defined by the fire prevention code of the city, are exceptions to section 9.470, and shall first Ordinance - 9 1906/ require a permit issued by the cityrs fire department: ~a} Bulk storage of flammable liquids tClass I and Class II}. ~.b} Unstable liquids. ~c} Fireworks. ~d} Blasting agents. ~_e} Explosives. ~f} Magazines, Class II. Class I magazines are prohibited.} fig} Hazardous chemicals, including but not limited to corrosive liquids, flammable solids, hi hl g Y toxic materials, oxidizing materials, poisonous gases, and radioactive materials. ~h} Unstable reactive} chemicals. ~.i} Ammonium nitrate. ~..j } Bulk storage of liquified petroleum gases. Section 22. Section 9.474 of the Eugene Code, 1971, is hereby amended to read and provide: 9.474 Buildings and Uses Permitted Conditionally. In addi- tion to the buildings and uses permitted conditionally, listed in sections 9.492 to 9.502, the hearings official may grant a conditional use permit for any use that could be hazardous, obnoxious, or offensive by reason of odor or bio- logical agents in accordance with the procedures set forth in sections 9.696 to 9.722. r Buildings and uses existing and legally permitted or per- mitted conditionally as listed a.n the zoning ordinance on Janu- ary 27, 1982 are exempt from sections 9.612 to 9.626 pertain- ing to non-conforming uses. This exemption is limited to the development site on which the buildings or uses existed on January 27, 1952. Section 23. Section 9,492 of the Eugene Code, 1971, is hereby amended by relettering the present subparagraph ~k} to ~1} and add- ing a new subparagraph ~k} thereto, to read and provide: 9.492 Section 24. ~k} Radio towers and transmitters. Subparagraph ~d } of Subsection ~ 7 } of Section 9.51Q of the Eugene Code, 1971, is hereby amended to read and pro- vide: Ordinance - 10 l qob~ 9.510 General Provisions. ~7} ~d} I-2 and I-3 zones: uses and buildings as permitted outright, conditionally, or with site review in the use district wherein the development will be located. Section 25. Section 9.534 of the Eugene Code, 1971, is hereby amended by repealing subsection ~.4} thereof, renumbering subsection ~ 5 } to ~ 4 } , and amending subsection ~.3 } thereof , to read and pro- vide. .5 Bua.l a.n t~ei g , ,`,,, ,~ imitations. ht L ~,~~.,,.~.... ~.~~_~~ ~3} Industrial: ~.a} In the I-l, I-2, and I-3 districts, no building height shad obstruct solar radiation to; 1. Other main building roof tops in in- dustrial or commercial zoning districts. 2. Potential main building roof tops 20 feet in height in buildable areas in industrial or commercial zoning districts; or, 3. Existing or potential south-facing building walls in buildable areas in residential zoning districts. As used in this section, "solar radiation" is the sun- light generated an December 21 of any year between l0 a.m, and 3 p.m, standard time. Section 26. Subsection ~.3} of Section 9.540 of the Eugene Code, 1971, is hereby amended to read and pravide: 9.540 Front Yards. ~3} Industrial: ~a} Except as provided in sections all lots or development sites in the I-l have a f rout yard of at least 30 feet. €b} Except as provided in sections all lots or development sites in the I-2 trios shall have no front yard requirem~ 9.532 to 9.574, district shall 9.532 to 9.574, and I-3 dis- ~nts. Section 27. Subsections ~3} and ~4} of Section 9.542 of the Eugene Code, 1971, are hereby amended to read and provide: Ordinance - 11 /qor~ 9.542 Interior Yards. ~3} Industrial: All lots ar development sites in the I-l, I-2, and I-3 districts shall have no interior yards re- quired where said lots or development sites abut property lines of co~runercially or industrially zoned property. ~~1hen side or rear property lines of said districts are common with property zoned residentially, interior yards shall be at least 24 feet in the I-1 district and at least 1Q feet in I-2, and I-3 dis- tricts when opposite the residential. districts. Required interior yards next to residential district parcels must be planted with year-round, minimum six foot wide, site obscuring vegetation or separated on the property lines from residential parcels by a sight obscuring six to eight feet high durable fence or wall, except the provisions of section 9.544 ~d} shall apply. Storage is prohibited in I-l, 2-2, and I-3 required interior yards next to residential districts when the site obscuring vegetation option above is chosen rather than the fence ar wall option. ~4} PL. In addition to solar radiation protection requirements in section 9.534, all buildings and additions constructed after September S, 1982 shall have required inter-- iar yards as follows: PL Building or Addition Height Minimum Required Interior Yards 15 feet --~----------------------~ 10 feet Over 15 feet ---------~~---------~-- 15 feet When a required interior yard is used for parking or storage and is next to a residential district parcel occupied by a dwelling, it must be screened with year-round, minimum six foot wide, site obscuring vegetation or separated from the residential parcel by a site obscuring six foot high fence or wall, except the provisions of section 9.544~d} shall apply. Section 28. Subparagraph 3. of subsection fie} of Section 9.544 of the Eugene Code, 1971, is hereby amended to read and provide: 9.544 (e) 3. In any commercial or industrial district, except C-1 and I-l, parking spaces shall be permitted in any required yards. Provided, however, the re- quired landscape provisions of Section 9.5423} are, adequately complied with. In the I-l district park- ing spaces may be located in required front yards if more than 20 feet from all abutting streets. Section 29. Section 9.546 of the Eugene Code, 1971, is hereby amended by amending Subsection ~1}~.c} thereof, renumbering Subsec- ordinance - 12 l 9G~6~ tion ~ 3 } to ~4 } , and adding a new subsection ~ 3 } thereto, to read and provide: 9,546 Lot Area; Lot Area Per Dwelling Unit. (1) ~c} In the RG district each lot ar development site shall have a minimum area of 20,000 square feet. ~3} In the I-2 and I-3 districts, the minimum lot size is 6,000 square feet. Section 30. Section 9.554 of the Eugene Code, 1971, is hereby amended to read and provide: 9.554 Residential District Regulations as to Schools, Churches, Public and Semi-Public Buildings. All buildings erected, used or maintained far a school, church, or public or semi- public building or use, institution, or similar use under the regulations of this ordinance shall be subject to the following requirements: . ~a} Front ard. All buildings and additions within 100 feet of adjacent property in a residential district shall have a front yard of at least ten feet. fib} Interior ~rards. All buildings and additions ~~,~~. are subject to the solar radiation protection require- ments of section 9.534 for structures in PL districts. At a minimum, buildings and additions shall have re- quired interior yard setbacks as follows: Building or Addition Height Interior Yards 15 feet ------~---_______________ 10 feet over l5 feet --------~------------ 15 feet When a required interior yard is used far parking or storage and is next to a residential district lot or parcel occupied by a dwelling, it must be screened with year-round, minimum six foot wide, sight obscur- ing vegetation or separated from the residential prop- erty by a site obscuring, six foot high fence or wall, except as otherwise required in section 9.544 for fences and walls in connection with traffic vision clearance. Section 31. Section 9.582 of the Eugene Code, 1971, is hereby amended to read and provide: 9.582 Required Off-Street Parking. off-street parking shall be provided on the development site for all AG, RA, ordinance - 13 / 90~ R-l, C-1, I-l, I-Z, I-3 and PL zones. In all other zones, the required parking shall be on the development site or within 440 feet of the development site which the parking is required to serve. A11 required parking must be under the same ownership as the development site served, except through special covenant agreements as approved by the city attorney, which bind the parking to the development site. Cff-street parking is not required in the C-3 district, except for dwell- ing units. In I--1 districts, when practical, off-street park- ing and loading areas shall be designed to share access to public and private streets. Likewise, contiguous lots in in- dustrial parks shall be designed, when practical, as a group so as to limit access to private and public streets. Section 3~. Section 9.557 of the Eugene Code, 1971, is hereby amended to read and provide: 9.557 Required Bicycle Storage. ~1} Bicycle storage spaces shall be provided in con- junction with all multiple dwelling units ~3 ar more units? in accordance with the following: : ~a~ Dwelling, multiple 1 space per unit 1b~ Dwelling, quad or quint ~ spaces per unit ~c~ Each space shall be a minimum length of six feet, a minimum width of two feet, and shall be pro- vided with a minimum overhead clearance of six feet. ~2} Bicycle storage spaces shall be provided in indus- trial districts in accordance with the following; ~a} Minimum spaces equal to l00 of the number of spaces required fvr automobiles, to be calculated by rounding up to the nearest whole number. ~b~ Locking and cover to be provided for all required spaces. drdinance - 14 ~90~/ ~c} The spaces to be located a maximum of two times the distance between building entrances used by automobile occupants and the nearest parking spaces to those entrances. ~d} Each space shah, be a minimum length of six feet, a minimum width of two feet, and shall be pro vided with a minimum overhead clearance of six feet. ~.e} The following uses in industrial districts are exempted from the above requirements: 1.
