AN ORDINANCE CONCERNING SEWER USER CHARGES;
AMENDING SECTIONS 7.020 AN`D 7.023 aF THE EUGENE
CODE, 1971; ADDING A NEW SECTION 7.045 TU THAT
CODE; PROVIDING AN EFFECTIVE DATE; AND DECLARING
AN EMERGENCY.
THE CITY OF EUGENE DOES QRDAIN AS FOLLOWS:
Section 1. Section 7.020 of the Eugene Coder 1971 is hereby
amended to read and provide:
7.420 Charges -- Established and Levied.
~1} There is hereby levied and imposed on all sewer
users just and equitable monthly rates and charges for sewer
service as provided in this chapter.
~2} Residential sewer users monthly charges for city
and regional sewer service shall be:

Multiple dwelling

~2} All other sewer users monthly rates and charges
for city and regional sewer ser~rice shall be:

~4} All sewer users that discharge wastewater with an
average of B.Q.D. and suspended solids exceeding 400 milligrams
per litre shall pay the monthly city and regional rates and
charges established in subsections ~2} or ~3} of this section
or the s,um of the following, whichever is greater:

where V equals the volume in gallons of wastewater discharged
by the user into the sanitary sewerage system during
the month;
B equals the average B.O.D. in excess of 200 milligrams
per litre of the discharged wastewater; and

S equals the a~rerage suspended solids in excess of 20D
milligrams per litre of~ the discharged wastewater.
Section 2 . Subsection ~ 2 } of Section 7.4 2 3 of the Eugene Code,
1971, is hereby. amended to read and provide;
7.02 3 Charges -~ Add ustments .
~2} The city manager or the manager's designee shall
investigate the application and certify to the Eugene Water &
Electric Board a reduction, if any, in the applicant's monthly
sewer user charges and the conditions and duration of the re-
duction. If it is determined that the applicant has paid
excessive sewer user charges resulting from conditions beyond
the applicant's control, a credit for the excess paid during all
or part of the 12 months preceding the application may also be
allowed. The full cost of investigating the application auth-
orized by this section and any conditions required by the city
manager or the manager's designee shall be borne by the appli-
cant. The city manager's decision regarding an application
shall be final.
Section 3. There is hereby added to the Eugene Code, 1971, a
new section, to be numbered and provide;
7.045 Charges - Cost of Collection. The Eugene Water & Elec-
tric Board may withhold from payments directed by sec-
tion 7.025 of this chapter a reasonable fee for its actual costs
of billing, collecting and remitting sewer user charges. The
fee shall be based on actual costs and established annually by
agreement between the city manager and EWEB.
Section 4. That the matters contained herein concern the public
welfare and safety and therefore, an emergency is hereby declared to
exist, and in order to provide for the orderly implementation of the
provisions hereof, the rates established herein, and the other provi-
sions amended or added to the Eugene Code, 1971 shall become effec-
tive March 1, 1983.
