An ordinance rescheduling the public hearing on the vacation of the following described alley, to-wit: As described on Exhibit "A" attached hereto and incorporated herein by reference, Hayward, Gonyea, et al Av 8z-1} THE CITY of EUGENE DOES oRDAIN A5 FoZEOWS: Section 1. Pursuant to Ordinance No. 19054 adapted by the Council and approved by the Mayor on January 1~, 1983, the City Council of the City of Eugene initiated the vacation. proceedings herein on its awn authority without petition or consent of the prop- erty owners, except as provided by statute of the above described alley. Section Z. A hearing was called upon the proposal to vacate the alley as therein provided, to be held on the 14th day of March, 1953. Prior to the hearing, deficiencies in the posting and publi- cation of notice of the hearing were discovered, and, therefore, the Council hereby declares that a hearing shall be held upon the proposal to vacate the alley as herein provided, to be held on the Z7th day of April, 1953, at noon Pacific Daylight Time of said date, at the Council Chambers at City Hall, Eugene, oregon, at which time all persons will be heard upon objections or suggestions with regard to the vacation, and at said time the Council will provide for the vacation of the alley or deny such vacation, and in case the vacation is made, will provide and make provision for any damages sustained by local assessment. Section 3. The City Recorder is hereby directed to immediately publish once each week for four consecutive weeks in a newspaper pub- ordinance - 1 /gri8 lished in Eugene, Lane County, Oregon, notice of the proposed vaca- tion. The notice shall give a description of the area to be vacated as herein set out; state the date when this ordinance was passed, the name of any petitioners petitioning for the vacation, and the date when the petition, together with any objections or remonstrances which may be made in writing and filed with the Recorder of the City of Eugene prior to the date of the hearing, will be heard and considered. Secti_on_4. The City Recorder shall forthwith and within five days after the first publication of the notice post, or cause to be posted, at or near each end of the proposed vacation a copy of the foregoing, which shall be headed "Notice of Alley vacation," and which notice shall be posted in at least two conspicuous places in or on the area proposed to be vacated, The posting and the first day of publication of the notice shall be not less than twenty-eight ~ 2 8 } days before the time set for hear- ing. Council Chambers at City Hall, Eugene, Oregon, on the 14th day of March, 1983, there was passed by the City Council and approved by the Mayor of the City of Eugene, Lane, County, Oregon, an Ordinance setting a hearing to be held on the 27th day of April, 1983, at 12:00 noon, Pacific Day- light Time, at the Council Chambers at City Hall, Eugene, Oregon, far the purpose of hearing remonstrances and protests against the vacation by Ordinance of the City Council of the fallowing: The South half of the fourteen X1,4} foot north/ south alley between Tax Lots 8401 and 8500, Assessor's Map 17-03~-31-1 2, located north of 7th Avenue between Charnelton and Olive Streets in the City of Eugene, Oregon. Hayward, Gonyea, et al - AV 82-1} The City Council will consider and act upon the proposed alley vacation, which is more particularly described in the Ordinance re- ferred to above, on the 27th day of April, 1983, at 12:00 o'clock noon, Pacific Daylight Time, at the Council Chambers at City Hall, Eugene, Oregon, and will consider an Ordinance vacating the above.
