An Ordinance initiating the vacation of the following described
cul--de~-sac and pedestrian-bikeway easement, to-wit:
As described on Exhibit "A" attached hereto and
incorporated herein by reference. ~Solvang Asso-

THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. The City Council of the City of Eugene herein ini-
tiates the vacation proceedings on its own authority without eti-

tion or consent of the property owners, except as provided b statute

of the above described cul-de-sac and pedestrian-bikeway easement.~r
Section 2. A hearing shall be held upon the proposal to vacate
the cul-de-sac and pedestrian-bikeway easement as herein provided,
and the hearing shall be held on the 13th day of July, 1983, at noon
Pacific Daylight Time of said date, at the Council Chambers at Cit
Y
Hall, Eugene, Oregon, at which time all persons will be heard u on

objections or suggestions with regard to the vacation, and at said
time the, Council will provide for the vacation of the cul-de--sac and
pedestrian-bikeway easement or deny such vacation, and in case the
vacation is made, will provide and make provision for any damages
sustained by local assessment.
Section 3. The City Recorder is hereby directed to immediately
publish once each week for four consecutive weeks in a newspaper ub-~

lished in Eugene, Lane County, Oregon, notice of the proposed vaca-
tion. The notice shall give a description of the area to be vacated
as herein set out, state the date when this ordinance was passed, the
name of any petitioners petitioning for the vacation, and the date

when the petition, together with any objections or remonstrances
which may be made in writing and filed with the Recorder of the City
of Eugene prior to the date of the hearing, will be heard and con-
sidered.
Section 4. The City Recorder shall forthwith and within five
days after the first publication of the notice post, or cause to be
posted, at ar near each end of the proposed vacation a copy of the
foregoing,, which shall be headed "Z~otice of Cul-de-Sac and Pedestrian-~
Bikeway Easement vacations" and which notice shall be posted in at
least two conspicuous places in or on the area proposed to be vacated.
The posting and the first day of publication of the notice shall
be not less than twenty-eight ~28~ days before the time set for hear-
ing.

NOTICE of VACATIONS
TO ALL PERSONS WHOM IT MAY CONCERN:
NOTICE IS HEREBY GIVEN that at a meeting of the City Council
of the City of Eugene, held at the Council Chambers at City Hall,
Eugene, Oregon, on the 8th day of June, 1983, there were passed by
the City Council and approved by the Mayor of the City of Eugene,
Lane County, Oregon, Ordinances setting hearings to be held on the
13th day of July, 1983, at 12:00 noon, Pacific Daylight Time, at
the Council Chambers at City Ha11, Eugene, Oregon, for the purpose
of hearing remonstrances and protests against the vacation by Ordi-
nance of the City Council of the following:
NOTICE OF CUL-DE-SAC AND PEDESTRIAN-BIKEWAY EASEMENT VACATION
A 46 foot radius cul-~de-sac on Marshall Avenue, and a l2 foot
wide pedestrian-bikeway easement linking the Marshall Avenue..
cul-de~-sac with Jacobs Street, located west of Jacobs Street
and south of Concord Avenue, being situated on Assessor's Map
17-04-22-41, Tax Lot 1401, in Eugene, Lane County, Oregon.
RESERVING herein public utility easements for underground pri-
mary voltage and water lines along the northern property line
of Solvang and the right to enter thereupon for purposes of
installation, maintenance and repair, and emergency vehicular
access easements providing turnaround and exit capabilities
over the cul-de-sac and pedestrian-bikeway path. ~Solvang

NOTICE OF STREET VACATION
The public right-of-way located on the east side of River Road,
between Green Lane and Division Avenue, commonly known as Edge-
wood Drive, which runs east from River Road approximately 875
feet Tax Lots 3000, 3100, 3200, 3300, 3400, 3500, 3600,
Assessor's Map 1 704-11-~4 4 and Tax Lots 2900, 3000, 3100,
3200, Assessor's Map 17-04-12-3 D~, in Eugene, Lane County,
Oregon.
SUBJECT To: Retention of a public utility easement over the
vacated area unless a relocation agreement is executed between
EWEB and Hayden Island, Inc., that Hayden Island, Inc. exer-
cises options for purchase of the affected properties prior to
the above hearing date; and, a written agreement regarding
access for Tax Lot 2900 is recorded prior to the hearing date.

The City Council will consider and act upon the proposed vacations,
which are more particularly described in the above referred to Ordi-
nances, on the 13th day of July, 1983, at 1.2:00 o'clock noon, Pacific
Daylight Time, at the Council Chambers at City Ha1l,~Eugene, Oregon,
and will consider ordinances vacating the above. All persons having
objections thereto or remonstrances or protests are hereby notified
to present the same to the City Council in writing prior to said hear-
ing or at said time and place.
