An Qrdinance initiating the vacation of the following described
street, to-wit:
As described on Exhibit "A" attached hereto and
incorporated herein by reference. Miller, et

THE CITY DF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. The City Council of the City of Eugene herein ini-
bates the vacation proceedings on its own authority without peti-
tion or consent of the property owners, except as provided by statute,
of the above described street.
w Section ~. A hearing shall be held upon the proposal to vacate
the street as herein provided, and the hearing shall be held an the
13th day of July, 19 83, at noon Pacific Daylight Time of said date,
at the Council Chambers at City Hall, Eugene., Oregon, at which time
all persons will be heard upon objections ar suggestions with regard
to the vacation, and at said time the Council will provide for the
vacation of the street, or deny such vacation, and in case the vaca-
tion is made, will provide and make provision for any damages sus-
tained by local assessment.
Section 3. The City Recorder is hereby directed to immediately
publish once each week for four consecutive weeks in a newspaper pub-
lished in Eugene, Lane County, Oregon, notice of the proposed vaca-
tion. The notice shall give a description of the area to be vacated
as herein set out; state the date when this ordinance was passed, the
name of any petitioners petitioning for the vacation, and the date
when the petition, together with any objections or remonstrances
which may be made in writing and filed with the Recorder of the City

of Eugene prior to the date of the hearing, will be heard and con-
sidered.
Section 4. The city Recorder sha11 forthwith and within five
days after the first pub~icatian of the notice post, or cause to be
posted, at or near each. end of the proposed vacation a copy of the
foregoing, which shall be headed "notice of Street vacation ,` and
which notice shall be posted in at least two conspicuous places in
or on the area proposed to be vacated.
The posting and the first day of publication of the notice shall
be not less than twenty-eight X28) days before the tune set for hear-
ing.

A 20.00 foot road ~Edgewood Drive} which centerline
is described as follows:
Beginning at~the southwest corner of the Larry Poin-
dexter Donation Land Claim No. 52, Township 17 South,
Range 4 West of the G~illamette Meridian; thence along
the south boundary of said Donation Land Claim, East
267.92 feet to a point that is on the centerline of
County Road No. 200 River Road}; thence leaving said
boundary and running along said centerline South l6°
54'44" East 1144.62 feet to the TRUE POINT OF BEGIN-
NING; thence East 873.80 feet to the end of said
centerline.
ExCEPT: Any portion within the right-of--way of
County Road No. 200 River Road}.

SUBJECT TO: Retention of a public utility easement
over the above described area unless a relocation
arrangement is agreed to between EWEB and Hayden Island,
Inc.; options being exercised by ~~ayden Island, Inc. for
purchase of the affected properties prior to the City
Council hearing on July 13, 1983; and, a written agree-
ment regarding access for Tax Lot 29DD being recorded
prior to the Council hearing on July 13, 1983.

of the City of Eugene, held at the Council Chambers at City Hall,
Eugene, Oregon. on the 8th day of June, x.983, there were passed by
the City Council and approved by the Mayor of the City of Eugene,
Lane County, Oregon, ordinances setting hearings to be held on the
13th day of July, 1983, at 12:00 noon, Pacific Daylight Time, at
the Council Chambers at City Hall, Eugene, Oregon, for the purpose
of hearing remonstrances and protests against the vacation by Ordi-

between Green Lane and Division Avenue, commonly known as Edge-
waod Drive, which runs east from River Road approximately 875
feet {Tax Lots 3000, 3100, 320D, 3340, 3400, 3500, 3600,
Assessor's Map 17-04-11-~4 4 and Tax Lots 2900, 3000, 3100,
3240,. Assessor' s Map 17-04-~12-~3 0 ~ , in Eugene, Lane County,
Oregon.
SUBJECT TO: Retention of a public utility easement over the
vacated area unless a. relocation agreement is executed between
EWEB and Hayden island, inc.; that Hayden Island, Inc. exer-
cises options for purchase of the affected properties prior to
the above hearing date; and, a'written agreement regarding
access for Tax Lot 2900 is recorded prior to the hearing date.

which are more particularly described in the above referred to Ordi-

and will consider Ordinances vacating the above. All persons having
abjectians thereto or remmonstrances or protests are hereby notified
to present the same to the City Council a.n writing prior to said hear-
