THE CITY DF EUGENE DDE5 DRDAZN AS FDLLDws: Section 1. Section 4.725 of the Eugene Code, 1971, is hereby amended to read and provide: 4.?25 Disorderly Conduct. ~l} No person shall engage in disorderly conduct. ~2} A person commits the offense of disorderly conduct if, with intent to cause public inconvenience, annoyance or alarm, or recklessly creating a risk thereof, that person: Qa} Engages in fighting or in violent, tumultu- ous and threatening physical behavior which creates an unreasonable risk of harm to person or property, or serious public inconvenience or alarm; or, fib} Directs to another person in hearing or in view of a public place words or gestures which when directed to the ordinary citizen are as a matter of common knowledge likely to provoke a violent reaction, and which do provoke a.n the recipient consideration of a violent reaction; or, ~c} Congregates with other persons in a public place: 1. So as to obstruct a public passage, or 2. In dangerous proximity to afire or other hazard, and fails to comply with the lawful order of the police to disperse; or ~d} Interferes with a police officer in the off i-- cer's lawful performance of his or her duties. To interfere with as used in this subsection shall mean any physical act, including a refusal to leave a par- ticular area in response to a lawful order from a police officer, that prevents or could reasonably be expected to prevent' a police officer from performing his or her duties; or ~.e} Creates or maintains a physically offensive or hazardous condition by any act which serves no legi- timate purpose of the actor, thereby disrupting a group of persons; or, ~.f} Spits on, in ar against any surface, sub- stance or person in a public placer or fig} Urinates or defecates in, or in view of, a public place, except in a lavatory; or, Ordinance -~ 1 i9 ~6~ ~h} Jumps or dives from any parking structure, bridge, viaduct, overpass, walkway or other elevated structure; or ~.i~ Throws or drops any object or material from any parking structure, bridge, viaduct, overpass, walk- way or other elevated structure. ~3} For purposes of this section t'public place" means premises which by function, custom, usage, notice or lack thereof, their physical nature or other circumstances at the time, would cause a reasonable person to believe that permis- sion to enter or remain is not requixed. Section 2. That the matters contained herein concern the public health, welfare, and safety and therefore, an emergency is hereby de~- Glared to exist, and this Ordinance sha11 become effective immedi- ately upon its passage by the City Council and approval by the Mayor.
