AN ORDINANCE CONCERNING DISPOSAL OF PERSONAL
PROPERTY; AMENDING SECTION 2.$35 OF THE EUGENE
CODE, 1971; AND DECLARING AN EMERGENCY.
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. Subsection ~ 3 ~ of Section ~. 835 of the Eugene Code,
1971, is hereby amended to read and provide:

~3~ If no person appears and establishes his ownership
of or interest in the property prior to the expiration of six
months after the date that the personal property has come into
the possession of the police department, the city shall sell
the property pursuant to section 2.$4D, or upon approval of the
city manager shall transfer the property to public use by enter
ing it on the city's fixed asset inventory, or if the personal
property is a weapon described in section 4.885 of this code or
declared unlawful to possess by state 1a~r, it shall be destroyed
by the chief of police.
Section 2. That the provisions contained herein affect the public
welfare and safety and therefore, an emergency is hereby declared to
exist, and this Ordinance shall became effective immediately upon
its passage by the City Council and approval by the Mayor.
