THE CITY OF EUGENE DOES ORDAIN Aa FOI~EOwS: Sectian 1. The first paragraph of Section 4.355 of the Eugene Code, 1971 is hereby amended, and a new definition for "Police ser- vice dag" is hereby added in alphabetical order therein, to read and provide 4.355 Animal Control - Definitions. For purposes of sections 4.355 to 4.455 of this chapter, the fallowing words and phrases shall mean: Police service dog. A dog used in police work under the control of a peace officer as defined in aRS 161.015, whether or not the dog is being so used at the time in question. Unless specifically referred to therein, neither a police service dog or its handler are subject to any of the restrictions or regulations contained in sections 4.355 to 4.455 of this chapter. Section 2. Anew section 4.455 is hereby added to the Eugene Code, 1971, to read and provide; 4.455 Interference with a Po~.ice Service Dog. ~1} Na person shall intentionally, knowingly, or reck- lessly kill, injure, torment, kick, strike, stone, interfere with, or tamper with a police ser~rice dog while the dog is be- ing caged, kenneled, transported, exhibited, exercised, or engaged in discharging or attempting to discharge any lawful duty or function. ~Z} No person sha~,l cause or direct any animal to attack or otherwise interfere with a police service dog while the dog is being caged, kenneled, transported, exhibited, exer- cised, or engaged in discharging or attempting to discharge any lawful duty or function. ~3} A police officer may destroy an animal attacking a police service dog if no lesser means are reasonably avail- able to prevent injury to the police service dog. Section 3. Section 4.874 of the Eugene Code, 1971, is hereby amended to read and provide: Ordinance - 1 /911 4.874 Animals. .Except far police officers and their police service dogs, and as OAS 346.60 provides to the con- trary with reference to blind persons and their dog guides, no person may bring any animal into the mall or allow any animal in his charge to be in the mall unless the anima? is caged. Section 4. That the matters contained herein concern the public welfare and safety, and therefore, an emergency is hereby declared to exist, and this Ordinance shall become effective immediately upon its passage by the City Council and approval by the Mayor.
