Miller, et al - SV 83~-1~ On the 8th day of June, 1983, the City Council of the City of Eugene passed Ordinance No. 19145 setting a hearing to be held on the lath day of July, 1983, at the Council Chambers at City Hall, Eugene, Oregon, at which time and place protests and remonstrances could be heard as to the proposed vacation of the above described street. Notice was duly and regularly given of the hearing and a hear~- ing was held pursuant to the Ordinance at the Council Chambers, at City Hall, Eugene, Oregon, on the 13th day of July, 1983, at Noon, Pacific Daylight Time, and at said time and place the Council heard all objections. All persons owning property abutting upon the street to be va~- Gated have consented to the vacation and applied for the same. THE CITY OF EUGENE DQES ORDAIN AS FOLLOWS: Section 1. The City Council of the City of Eugene finds that due and regular notice of the hearing was published and posted as by law required and no valid objections have been made at the hear ing or filed. The consent of the owners of the abutting property has been duly and regularly filed in the proceedings and the public interest will not be prejudiced by the vacation of the street. Section 2. The hearing was held on the 13th day of July, 1983, at noon, Pacific Daylight Time, at the Council Chambers, City Hall, ordinance - 1 i9i~y Eugene, Lane County, Oregon, and all matters necessary to be done in the premises have been duly and regularly completed. Section 3. The hereinabove described street is hereby vacated, and the street so vacated shall revert pursuant to the statutes of the State of Oregon. Section 4. The City Recorder is hereby directed to file a cer- tified copy of this Ordinance with the Recorder of Lane County, Oregon, together with a map or plat of said property, and a certi- fied copy of this Ordinance shall be filed with the Lane County Assessor and another certified copy shall be filed with the Lane County Surveyor. EXCEPT: Any portion within the right-of-way of County Road No. 200 River Road}. ALSO: Beginning at a point South l6°45' East 1104.62 feet and East 280.$0 feet from the intersection of the centerline of County Road 200 with the North line of the Joseph Davis Donation Land Claim No. 48 in Township 17 South, Range: 4 west of the Willamette Meridian; run- ning thence North 15°51' West 25.99 feet; thence East 14 3.0 0 feet; thence South l5 ° 51' East 2 5.9 9 feet; thence west 143.00 feet to the point ~f beginning, in Lane County, Oregon. SUBJECT To: Retention of a public utility easement over the above described area unless a relocation arrangement is agreed to between EWEB and Hayden Island, Inc.; options being exercised by Hayden Island, Inc, for purchase of the affected properties prior to the City Council hearing on July 13, 1983; and, a written agree- ment regarding access far Tax Lot 2900 being recorded prior to the Council hearing on July 13, 1953.
