HomeMy WebLinkAboutOrdinance No. 19182ORDINANCE NO. 1q AN ORDINANCE CONCERN2NG $ED AND BREAKFAST FACILITIES; AMENDING SECTIONS 9,254, 9.312, 9.326, 9.338, 9.340, 9.352, 9.366, 9.384, 9.394, 9,410, 9.422, 9,436, AND 9,5$6 OF THE EUGENE CODE, 1971; AND DECLARYNG AN EMERGENCY. THE CITY 4F EUGENE DOES ORDAIN A5 FoLLQWS: Section 1. Section 9.254 of the Eugene Code, 1971, is hereby amended by adding a new definition for Bed and Breakfast Facility in alphabetical order therein, and amending the definition of Boarding andjor Rooming Houser to read and provide: 9.254 Bed and breakfast facil,it A dwelling where travelers are lodged for sleeping purposes, with a morning meal provided, and far which compensation is paid and received. Boarding andjor rooming house. A building where lodging, with or without mealsr is provided for com- pensation, but shall not include bed and breakfast facilities, nursing homes or group care homes. Section 2, Section 9.31,2 of the Eugene Code, 1971, is hereby amended by adding a new subparagraph fib} thereto and relettering the present subparagraphs (b) through (1) to (c) through (m) , to read and provide: 9.312 fib} Bed and breakfast facilities, subaect to the following development standards: 1~. The facility shall maintain an. up~-to- date guest register; ~2, The facility shall be owner-occupied; 3. The length of stay for guests shall be a maximum of l5 consecutive nights; 4. The number of guest bedrooms shall be limited to two, with a maximum total of five guests at any one. time; Ordinance ~- 1 /9/ da 5. Signing shall be limited to one non- illuminated~wall sign with a maximum area of one- and one-half square feet; 6. There shall be at least 4~Q feet of sep- aration in all directions between facilities. This includes, for example, a 4~0 foot separation from existing bed and breakfast facilities in commercial zoning districts; ~7. Yf an approved facility is not estab- lished within one year of the approval date, or if the use lapses for over one year, the approval shall automatically expire and a new application shall be required and, S. Within one year of approval, the plan- ning director shall review each bed and breakfast facility to ensure all approval conditions are being fulf i11ed. Section 3. Section 9.32G of the Eugene Code, 1971 is hereby amended by relettering the present subparagraphs fib} through ~i} to ~c} through ~j}, and adding a new subparagraph fib} thereto, to read and provide: 9.32G fib} Bed and breakfast facilities, subject to the development standards set forth in section 9.312(b}. Section 4. Section 9.33$ of the Eugene Code, 1971, is hereby amended by relettering the present subparagraphs ~c} through gym} to ~d} through fin} , and adding a new subparagraph ~c} thereto, to read and provide: 9.335 ~c} Bed and breakfast facilities, subject to development standards 1 to 5 set forth in section 9.312 fib} . Bed and breakfast facilities for which a modification of development standards 1 to 5 is sought shall be subject to conditional use procedures. Section 5. Section 9..340 of the Eugene Code, 1871, is hereby amended by relettering the present subparagraphs Cb) through (g) to Ordinance - 2 /918-~ ~c} through ~h} , and adding a new subparagraph fib} thereto, to read and provide: 9.340 fib} Bed and breakfast facilities far which a modi- fication of development standards 1 to 5 set forth in section 9.31~~.b} is sought. In any event, however, the total number of guest rooms, plus the owner or inn-- keepers unit, shall be limited to the maximum number of dwelling units otherwise allowed in this zoning dis~ trict. Section 6. Section 9.35 of the Eugene Code, 1971, is hereby amended by relettering the present subparagraphs fib} through ~a} to ~c} through ~p}, and adding a new subparagraph fib} thereto. to read and provide: 9.352 fib} Bed and breakfast facilities, provided the total number of guest moms, plus the owner or inn- keeper's unit, are limited to the number of dwelling units otherwise allowed in this zoning district. Section 7. Section 9.366 of the Eugene Code, 1971,, is hereby amended by relettering the present subparagraphs (b) through (k) to ~c} through ~1}, and adding a new subparagraph fib} thereto, to read and provide: 9.366 fib} Bed and breakfast facilities, provided the total number of guest rooms, plus the owner or inn-- keeper's unit., axe limited to the number of dwelling units otherwise allowed in this zoning district. Section 8. Section 9.380 of the Eugene Code, 1971, is hereby amended by relettering the present subparagraphs fib} through 4p} to ~c} through {q}, and adding a new subparagraph fib} thereto, to read and provide: 9.380 fib} Bed and breakfast facilities, provided the total number of guest rooms, plus the owner or inn~- ordinance -- 3 i9 ~ g~ keeper's unit, are limited to the number of dwelling units otherwise a1,lowed in this zoning district. Section 9. Section 9.394 of the Eugene Code, 1971, is hereby amended by relettering the present subparagraphs (b) through (q) to (c) through (r), and adding a new subparagraph (b) thereto, to read and provide: 9.394 ~.b} Bed and breakfast facilities, provided the total number of guest rooms, plus the owner or inn- keeper's unit, are limited to the number of dwelling units otherwise allowed in this zoning district. Section 14. Section 9.410 of the Eugene Code, 1971, is hereby amended by relettering the present subparagraphs (c) through (h) to ~d} through ~i} , and adding a new subparagraph ~c} thereto, to read and provide: 9.410 Section 11. ~.c } Bed and brea~kf as t facilities , provided : 1. The use is integrated with a commercial structure; 2. Commercial uses in the structure have the capacity to accomodate a bed and breakfast facility; 3. Gutdvor living area privacy can be maintained; and 4. The total number of guest rooms plus the owner yr innkeeper's unit is limited to the minimum lot or development site area required in the RG district. Section 9.422 of the Eugene Code, 1971, is hereby amended by relettering the present subparagraphs ~1} through ~q-3} to gym} through 4.r-3 } , and adding anew subparagraph ~ 1} thereto, to read and provide: 9.422 ~_1} Bed and breakfast facilities. Section 9.436 of the Eugene Code, 1971, is hereby amended by relettering the present subparagraphs ~l} through ~s-3~ to ~m~ through ~ t- 3 ~ , and adding a new subparagraph ~ 1 ~ thereto, to read and provide: 9.436 Section 13. ~1~ Bed and breakfast facilities. Subsection ~.a~ of Section 9.586 of the Eugene Code, 1971, is hereby amended by adding a new subparagraph 1Q thereto, to read and provider 9.586 Use 10. Bed and breakfast facilities Parking Space Required i I~iniio~~~i ~iii~ii`ui~i~m~i~m~n~r~nii~ I~IIIwYYIY 1 for each guest roam, except for facilities located within a C-3 zoning district. Parking for the owner/innkeeper of the facility shall be as re- quired in the zoning dis- trict in which the facility is located. Section 14. That the matters contained herein concern the public welfare and safety, and in order to insure the orderly admin- istration of the City`s zoning ordinances, an emergency is hereby declared to exist, and this~Crdinance shall become effective immedi- ately upon its passage by the City Council and approval by the Mayor.
