AN ORDINANCE AUTHORIZING THE INSTITUTION OF PRO-
CEEDINGS IN EMINENT DOMAIN FOR THE ACQUISITION
BY CONDEMNATION OF FEE SIMPLE TITLE FOR THE
WIDENING OF ROOSEVELT BOULEVARD FRAM WEST BELT-
LIivE ROAD TO MAPLE STREET; AMENDING ORDINANCE N0.
18865; AND DECLARING AN EMERGENCY.
The City Council of the Casty of Eugene finds that:
On September 14, 1981 the City Council authorized the institu-
tion of proceedings in eminent domain for the acquisition of prop-
erty interests far the widening of Roosevelt Boulevard from West
Beltline Road to Maple Street through the adoption of Ordinance No.
18865, which was approved by the Mayor on that date.
Subsequent to the adoption of Ordinance No. 18865, the City
Engineer has amended the original construction plans, and the
amended plan includes property not authorized for acquisition by
Ordinance No. 1SS65.
The Council specifically adopts the findings contained in
Ordinance No. 18865, and further finds that the amended plans of
the City Engineer Constitutes the mast beneficial and practical
location for the improvements and are in accordance with provisions
of the Eugene Code, 1971 and applicable policies and agreements of
the City of Eugene. Now, therefore,
THE CITY QF EUGENE DGES ORDAIN AS FOLLOWS:
Section 1. Based upon the above findings, and the findings
of Ordinance No. 18865, which are incorporated herein by reference,
the City Council hereby directs that Ordinance No. 18865 be, and
the same is hereby amended by adding to Exhibit "A" thereto the
fallowing property interest to be acquired in the manner authorized
therein:

Section 2. That the matters contained herein concern the ublic

welfare and safety and therefore, an emergency is hereby declared to
exist, and this Ordinance shall become effective immediately upon
its passage by the City Council and approval by the Mayor.
